Res P-90-56RESOLUTION NO. p-90-56 F H CIT' COUN IL F T E IT P-W , C IFOR IA APPR VIN C ND T NA E P MIT 8-04A A D M NO D V OP'E RE EW g -56 AS ESS R' P R L U ER 7-19 -44 WHEREAS, the amendment to Conditional Use Permit 88-04 and Minor Development Review 90-56, submitted by Bruce Carey, applicant, for the purpose of establishing a new car dealership at 13541Poway Road regularly came before the City Council on August 7, 1990; and WHEREAS, the Director of Planning Services has recommended approval of the project subject to all conditions set forth in the Planning Department report; and, WHEREAS, the City Council has read and said report and has con- sidered other evidence presented at the public hearing. NOW, THEREFORE, the Council does hereby resolve as follows: Section 1 : The City Council finds that the project will not have a significant adverse impact on the environment and hereby issues a Negative Declaration as con- tained in the conditions of approval. Conditional Use Permit 88-04A That the locat on, size, design, an operating characteristics of the proposed use w ll be compatible wit adjacent uses; in that the pro- posed automobi e sales and se vic usiness adjoins other commercial uses on two si es and where i ad o ns residential uses, the conditions of approval require construct on f an eight foot block wall and a landscape buffer to separate he wo uses. That the harmony in scale, bulk, coverage, and density is consistent with the adjacent uses; in that the proposed modular building is tem- porary and the permanent facility will be similar in size to adjacent 1 buildings. ® That there are ublic facilities, services, and utilities; in that sewer and water serv ce is available for the project; in that sewer units were allocate to the site through approval of the underlying map {TPM 88-04 . That there will be no harmful effect upon desirable neighborhood characteristics as the project's activities will be buffered from adja- cent b and residences, by walls and landscaping. That the proposed development is in compliance with the Zoning Ordinance; in that the project meets the applicable standards of the CC zone. Section 11 Decision: Conditional Use Permit 88-04 Amendment and Minor Development Review 90-56, for which plans are on file in the Planning Department, are hereby approved subject to the following conditions: Within 30 days of approval: (1) The applicant shall submit in writing that all conditions of approval have been read and understood; and {2) the property shall execute a covenant on real property. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and commercial uses. ® Within 24 months from the date of this approval, the dealership shall obtain a new conditional use permit to provide for the construction of a permanent sales and service complex. The temporar sales office shall be removed from the site upon comple- tion of the ermanent sales/service complex but in no case shall it remain on si e for a period in excess of 36 months from the date of this approva . APPLICANT SFLALL CONTACT THE DEPARTNENT OF PLANNING AND BUILDING SERVICES REGARDING CONPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Parking for disabled customers and/or employees shall be provided adjacent to the modular office unit. 2. Disabled access ramps and landings shall comply with Section 3307 of the State of California Building Standards Code. m Modular office building must be approved by and bear a label from the State of California, Department of Housing and Community Development. The modular office must be approved as a commercial coach for use as a B-2 occupancy. e The modular office shall be made to comply with State of California, Title 24, Disabled Access requirements throughout including all features of path of travel and sanitation facilities within the structure. 5. Restroom facilities shall be provided in accordance with Uniform Building Code Section 705. Resolution No. P-90-56 Page 4 e A foundation support and seismic tie-down design must be submitted to and approved by the Building Division prior to building permit issuance. In addit on, lights shal not be located upon the building which spill light upon or which increase light impacts upon said properties, and shall be of low pressure sodium type and less than 18 feet in height. A substitute paging system shall be approved by the Director of Planning Services. Planning Services Department s all conduct an annual review of this permit for compliance with the condit ons of approval or to address problems with the operation of the use. If he permit is not in compliance or the depart- ment has received complaints, he review shall be set for a public hearing before the City Council to consider modification or revocation of the per- mit. 11. Inoperable vehicles shall not be stored on the site. 12. CUP 88-04A and NORA 90-56 shall expire on August 7, 1992 if building permits are not issued. SITE OEVELOP#ENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permit issuance. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit e Prior to any use of the project site or business activity being con~nenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. Resolution No. P-90-56 Page 5 The applicant shall comply w th the latest adopted Uniform Building Code, Uniform Mechanical Code, Uni orm Plumbing Code, National Electric Code, Uniform Fire Code, and all o her codes and in effect at the time of building perm t issuance. 6. Site development requirements for handicapped accessibility found in Chapter 71 of the State of C Building Standards Code must be adhered to. PARKING AND VEHICULAR ACCESS 11 parking lot landscaping shall consist of a minimum of one 15 gallon size ree for every three parking spaces. For parking lot islands, a minimum 12 nch wide walk adjacent to parking stalls shall be provided and be separated rom vehicular areas by a six inch high, six inch wide portland concrete cement curbing. All two-way traffic a sles shall be a minimum of 24 feet wide and emergency access shall be provi ed, maintained free and clear, a minimum of 24 feet wide at all times dur ng construction in accordance with Safety Services Department requiremen s. 3. All parking spaces shall be double striped. e The car storage area sha)l be fenced and black topped. Solid wood fencing six feet in height with top rail and painted or stained to match the modular sales office shall be constructed on the north, east, and west sides. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Public Services Department and Planning Services Department prior to the issuance of building permits. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Ordinance and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. e All landscaping shall be mai tained in a health and thriving condition, free from weeds, trash, and ebris. The trees hall be encouraged and allowed to retain a natural orm. Pruning shou d be restricted to maintain the health of the trees and o protect the publ c safety. Unnatural or excessive pruning is not permitted. APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVXCES REGARDING -- COMPLIANCE WITH THE FOLLOWING CONDITIONS: Resolution No. P-90-56 Page 6 GRADING A grading plan for the development of the property shall be submitted to the City's Engineering Services for review and approval prior to issuance of a grading permit and start of grading operation. Rough grading of the site must be completed and shall meet the City's Engineering Services inspector's approval prior to issuance of a building permit. e A right-of-way permit shall be obtained from the City's Engin erlng Services Department for any work to be done within the public street r ght-of-way or any City-held easement. The new modular office shall be plan checked and approved by the Department of Safety Services. 2. Building addressing and roof numbers are to comply with current standards. 3. Designated fire lanes shall be marked and signed.
