WHEREAS, Tentative Tract Map 90-05, hereinafter "Map" submitted h ADI

came before the ity Council for public hearing and action on August 7, 199 ;
and
WHEREAS, the Director of Planning Services has recommended approval of the
map subject to all conditions set forth in the Planning Services Department,
report; and
WHEREAS, the City Council has read and ~ said report and has con-
sidered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1: E ~al F
The City Co ncll finds that the previously c rtified Fin 1EIR for Tentative
Parcel Map 7-09 and General Plan Ama dment/ one Change 9-03 of June 13,
1989, have een considered and found o be a equate for his tentative tract
map. The m tigation measures identif ed in he EIR are o be implemented
with Specif c Plan 8g-04/Development eview 9-15.
Section 2: Find :
The City Council makes the following findings regarding Tentative Tract Map
90-05 and the Map thereof:
The tentative tract map is consistent with the Comprehensive Plan of
the City of Poway and the specific plan for the Creekside Plaza.
The design or improvement of the tentative tract map is consistent with
all applicable general and specific plans; in that the design is con-
ditioned to conform to the development standards of the adopted specif-
ic plan.

The site is physically suitable for the type of development proposed;
in that the site is located within the central commercial corridor.
The site is physically suitable for the density of the development pro-
posed, in that the lot is relatively flat and lends itself to shopping
center development.

The design o the subdivision is not likely to cause substantial
environmenta damage and avoidable injury to humans and wildlife or
other habita ; in that these factors were in the
Environmenta Impact Report {EIR). The project provides for the reten-
tion of some mature trees.
The tentative tract map is not likely to 'cause serious public health
problems; in that all lots will be served by public water and sanitary
sewer service.

The design of the tentative tract map will not conflict with any ease-
ment by the public at large, now of record, for access through or use
of the property within the proposed subdivision.
Section 3:
Council Decision:
Tentative Tract Map No. 90-05, copy of which is on file in the Planning
Services office, is hereby approved subject to all of the following con-
ditions:
Within 30 days of approval, the applicant shall submit in writing that all
conditions of approval have been read and understood.
APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVICES REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:
A reciprocal access and maintenance agreement shall be recorded prior to
final map approval. This agreement shall insure access to all parcels over
driveways and parking areas and maintenance thereof, to the satisfaction of
the City Engineer.
2. Building slab and footing locations shall be verified prior to recordation
of final map, where building footprints coincide with property lines.
3. Abutters rights of access to Co~unlty, Poway, and Midland Roads, shall be
waived on the final map except at the approved driveway locations.
4. Sewer, water, and storm draln easements sha)] be dedicated on the final map
to the satisfaction of the City Engineer, or by separate instrument.
5. A flowage easement conforming to the approved hydraulic report for Poway
Creek shall be dedicated on the final map or by separate 1
