Res P-90-58RESOLUTION NO. p_90-58 A OF H CITY C U IL OF T ECI Y F P W , CALl 0 IA APPROV NG T NT TIV ACT MA -14 AN DEV LO MEN VIEW 8 - ASSESS R'S AR EL ,U ER 317-4 -11 WHEREAS, Te t tlve Tract Map 89-14, her inafter "Map" and Development Review 89-32, submitte y Poway Land, Inc., and A I Pr perties, applicant, for the purpose of subd v ding the real propert si uate in the City of Poway, County of San Diego, S a e of California, desc ibe as hat portion of the northwest quarter of the southeast quarter of Sec ion 13, ownship 14 South, Range 2 west, San Bernardino Meridian into 65 lots an the ins allation of a modular home on each lot, regularly came before the City Council for public hearing and action on August 7, 1990; and WHEREAS, the Director of Planning Services has recommended approval of the map subject to all conditions set forth in the Planning Services Department, report; and WHEREAS, the City Council has read and considered said report and has con- sidered other evidence presented at the public hearing. NOW, THEREFORE, the City Council of the City of Poway does resolve as follows: Section 1: Environmental Find The City Council fi ds that the previously certified Final EIR for th Haley Trust Property, Ten attve Parcel Map 87-09 and General Plan Amendment Zon Change 89-03, and a opted mitigation plan adequately addresses the po ent al environmental impac s of the proposed development. The necessary mit gat on measures are contained in the conditions of approval of the attached reso u- tion. Section 2: Fi : Tentative Tract Me The City Council makes the following findings in regard to Tentative Tract Map 89-14 and the map thereof: The tentative tract map is consistent with all applicable general and specific plans, in that the General Plan designation for the subject property provides for mobile home park development. The design or improvement of the tentative tract is consistent with all applicable general and specific plans in that the tract map is designed with the MHP {Mobile Home Park} development standards. The site is physically suitable for the type of development proposed in that the gentle to moderate topography will allow for the construction of the access road and building pads on each of the lots. No. P-90- 58 Page 2 ® The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat in that a study has been prepared of the that would be affected and mitigation measures proposed to minimize such effects are contained in the conditions of approval. The tract map is not likely to cause serious health problems in that the property would be served by sanitary sewer service and domestic water provided by the City. The design of the tentative tract map will not conflict with any ease- ment acquired by the public at large now of record for access through or use of the property within the proposed subdivision. That this project will not create adverse impacts on the environment. Mitigation measures have been recommended based on the previously adopted EIR. That the proposed development is in conformance with the intent and purpose of the Zoning Ordinance in that all performance standards will be met through project construction. That the proposed d velopment encourages the orderly and h appearance of struc ures and property within the City because it is similar to and comp ements the adjacent development and it complies with the design gui elines of the General Plan regarding the use of textured building materials, generous roof overhangs, recessed doorways and windows, and generous planting areas. Resolution No. p-90-58 Page 3 Sectlon 3: Clt Councll Decision= Tract Map 89-14 and Review 89-32, a copy of which is on file in the Planning Services Office, is hereby approved subject to all Of the following conditions: Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. APPLICANT SHALL CONTACT THE DEPARTNENTS OF PLANNING AND BUILDING SERVICES REGARDING CONPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT Site development requirements for handicapped accessibility found in Chapter 71 of the State of California Building Standards Code must be adhered to. All new buildings shall be accessible throughout. e A six foot high tan slumpstone masonry wall shall be installed at the top of graded slope along Community Road for purposes of screening and noise attenuation to the satisfaction of Planning and Public Services. 3. A six foot high tan slumpstone wall shall be installed along the rear prop- erty lines for lots adjacent to the Midland Road right-of-way. e A wall composed of two feet of tan slumpstone and three feet of wrought iron fencing for a total height of five feet shall be installed along the rear property lines for the lots adjacent to Poway Creek. 5. Complete fencing for each lot shall be installed prior to occupancy to the satisfaction of the Director of Planning Services. 6. No outdoor storage, maintenance of portable storage buildings or storage of inoperable vehicles shall be permitted within the project. ® A minimum of three floor plans and three elevations, and variations of roof materials and colors shall be required. Each unit shall be fitted with a decorative entry porch, roof overhangs, and wood siding. Be The RV Storage Lot F shall be screened from adjacent lots by means of a six foot solid wood fence and dense irrigated landscaping buffer. The fence shall contain a top rail and shall be painted to match the adjacent masonry peri- meter screening wall. 9. Each housing unit shall be provided with an automatic garage door opener. 10. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Resolution No. P-90-58 Page 4 11. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. 12. The developer shall integrate an appropriate variety of approved roof materials and colors into the design of the residential development in a manner which is both compatible and complementary among each of the residen- tial units. 13. 14. 15. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit issuance. Trash receptacles shall be enclosed by a six foot high masonry wall with view-obstructing gates pursuant to City standards. Location shall be sub- ject to approval by the Planning Services Department. Trash enclosures shall not be located adjacent to street frontages. Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. 16. The applicant shall comply w th the latest adopted Uniform Building Code, Uniform Mechanical Code, Uni orm Plumbing Code, National Electric Code, Uniform Fire Code, and all o her applicable codes and ordinances in effect at the time of building perm t issuance. 17. 18. 19. 20. LANDSCAPING The Poway Creek Channel Revegetation Plan as prepared by Pacific Southwest Biological Services and as approved by the State Department of Fish and Game shall be implemented i~rnediately following the channel grading operation. The mature California Pepper Tree on the south bank of the creek channel's eastern terminus shall be retained and protected in place. The mature, multi-trunk western Sycamore located in the creek channel directly north of Lot J shall be retained and protected by means of an island constructed within the improved channel. All landscaping adjacent to both Community and Midland Roads will be improved to LMD standards and maintained by the appropriate district. A detailed landscape (LMD) and irrigation plan shall be submitted to and approved by the Public Services Department prior to the issuance of building permits. Existing on-site trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall e approved for removal at the discretion of the Planning Services epartment during the review of the Master Plan of existing on-site trees. hose trees which are approved for removal shall be replaced on a tree-for- ree basis as required by the Planning Services Department. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway Ordinance and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. All landscaped areas shall be maintained in a healthy and thriving con- dition, free from weeds, trash, and debris. All landscape plans and landscape development will conform to the City of Poway Guidelines to Landscape Development and City of Poway Landscape Standards. All developments required to public LMD imp will be responsible to maintain those facilities for a 12 month period to City standards. 13. Annex into the appropriate LMD prior to final map approval. Construction of all LMD improvements shall be completed prior to building occupancy. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. RECREATION The developer shall improve the equestrian/pedestrian trail system in accor- dance with the adopted standards and to the satisfaction of the Director of Conmunity Services prior to building permit issuance. An open space easement shall be granted to the City over, upon, across a d under the area defined on the final maps as an equestrian/pedestrian tra 1 and no building, structures or other things shall be constructed, erecte , placed or maintained on subject easements except for the construction an maintenance of said trail and structures appurtenant to the trail. ® Dedication of the Master planned equestrian/pedestrian trails shall be required to the satisfaction of the Director of Public Services in accor- dance with the Master Plan of Trails Element. e The developer shall pay the Park Fee at the established rate at the date of final inspection, or the date of the Certificate of Occupancy, whichever occurs later. EXISTING STRUCTURES Existing sewage disposal facilities shall be removed, filled and/or capped to comply with appropriate grading practices and the Uniform Plumbing Code. APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVICES REGARDING CO#PLIANCE WITH THE FOLLOWING CONDITIONS: GRADING Grading in Poway Cr ek shall conform to the approved Hydraulic Study and the recon~nendations con alned therein. The bottom width shall be 70 feet and the side slopes sba 1 be 2:1. The grading for the creek shall not encroach on the existing nor h bank. All slopes shall be 2:1 except in the Friars Formation they shall be a mini- mum of 3:1. Grading of the subject property shall be in Ordinance, approved grading plan and g grading practices. with the Grading report, and accepted A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work at first of a grading plan. The final grading plan sh ll be subject to review and approval by the Planning Services and Eng neering Services Departments and shall be completed prior to recordation of he final subdivision map or issuance of building permits, whichever comes irst. STREETS AND $IDENALKS All interior streets shall be private and shall be constructed to Planned Development Road Standards per Section 12.20.080 of the Poway Municipal Code; except Poway Creek Lane shall be improved to 30 foot {curb-to-curb). 2. Parking will not be allowed on any of the interior streets and shall be posted to the satisfaction of the City Engineer. 3. Sidewalks shall be installed on both sides of Poway Creek Lane and one side of Creek View Lane. 4. Curb and gutter shall be Type "G" per the Regional Standards. Commun Community Road shall be improv d to City Standards for Secondary Arterials. This shall include a raised me lan and widening on the east side, along the western boundary of the projec . These imp shall include sidewalk, curb and gutter, paving, and u ilities. In addition, it will be necessary to widen the existing box culvert at Poway Creek. ommun ty Road shall be constructed with two 12 foot sour bound lanes and hree ! foot northbound lanes. Resolution No. P-90-55 Page 8 The design of Community Road must be compatible with the proposed Creekslde Development north of Poway Creek; The final design is subject to the approv- al of the City Engineer. Midland Road Midland Road shall be to Local Collector Standards (60 feet/40 feet) south of Fairgate Drive. The intersection of Midland Road and Poway Creek Lane shall be designed to the satisfaction of the City Engineer. A pedestrian bridge shall be constructed across Poway Creek. The location and design shall be to the satisfaction of the Director of Planning Services and the City Engineer. General All interior streets shall be private and shall be constructed to Planned Development Road Standards per Section 12.20.080 of the Poway Municipal Code. Reciprocal access and maintenance and/or agreements shall be provided insuring access to all parcels over private roads, drives or parking areas and maintenance thereof to the satisfaction of the Director of Engineering Services. Vehicular access to the property to the south, known as Parcel Number 317-480-06 (TTM 87-03/CUP 87-06), shall be provided without charge, cost, or fee to said property, and otherwise shall be to the satisfaction of the Director of Engineering Services. 4. Resolution No. P-90-58 Page 9 e All damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to exoneration of bonds and improvements, to the satisfaction of the Department of Engineering Services. Prior to any work being performed in the public right-of-way, an encroach- ment permit shall be obtained from the Engineering Services office and appropriate fees paid, in addition to any other permits required. g. The developer shall pay one half the cost of a City approved landscaped median along Poway Road prior to final map approval. 10. The developer shall pay the Traffic Mitigation Fee at the established rate at the date of the final inspection or the date the Certificate of Occupancy is issued, occurs later. DRAINAGE AND FLOOD CONTROL 1. A drop shall be constructed at the east end of Poway Creek in con- formance to the approved Poway Creek Hydraulic Study. Two additional 10' x 8' reinforced concrete box culverts shall be added to the existing culvert at Community Road. These new boxes and the existing boxes shall be lengthened to accommodate the widening of Community Road. The existing trunk sewer line shall be relocated to Poway Creek Lane within the limits of the project. ® The on-site sewer shall be public and shall be designed to City Standards. Prior to acceptance of property for sewer service, annexation to the sewer improvement area shall occur. The applicant shall pay for a water system analysis to establish the proper size and location for the public water system. The amount will be deter- mined by the cost of the analysis and shall be paid upon demand by the City. 10. The applicant shall, within 30 da s after receiving appr val of the ten- tative tract ap, apply for a Let er of Availability {LO ) to reserve sewerage avai ability and post wi h the City, a nonrefun able reservation fee equal to 0% of the appropria e sewerage connection ee in effect at the time the LOA s issued. 11. Cable television services shall be provided and installed underground. The developer shall notify the Cable company when trenching for utilities is to be accomplished. APPLICANT SHALL CONTACT THE SAFETY SERVICES DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Should this subdivision be further divided, each final map shall be sub- mitted for approval by the Director of Engineering Services. 5. All provisions of the Subdivision Ordinance of the Poway Municipal Code shall be met as they relate to the division of land. Those portions of the subject property proposed to be held under common ownership shall be labeled such and identified by a separate lot number on the final map. 7. Prior to final map approval, all dedications shall be made and easements granted as required above.
