park were given a written 30 -day advance notice of the event by the Community Services
Department.
RECOMMENDATION
It is recommended that the City Council approve Temporary Use Permit 95 -19 subject to
the conditions contained in the attached proposed resolution.

SUBJECT: Temporary Use Permit 95 -19, Jack Cook and City of Poway,
Applicants: A request to conduct a community band festival on
Saturday, May 20, 1995 and Sunday, May 21, 1995 at Old Poway
Park.
BACKGROUND
Section 17.26.030 of the Poway Municipal Code allows temporary events including
circuses, carnivals, rodeos, parades or similar outdoor entertainment with the
approval of a temporary use permit by the City Council.
FINDINGS
Jack Cook of the Pomerado Community Band in conjunction with the City of Poway
propose a two day community band festival which will be held in Old Poway Park
the weekend of May 20, 1995 and May 21, 1995. Approximately 8 concert bands,
ranging in size from 35 - 60 members will each present free hour long
performances in the gazebo area of the park during the two day event. The hours
the bands are to play are between noon and 6 p.m. on Saturday, and 1:30 p.m. to
6:00 p.m. on Sunday. It is anticipated that the event will draw a maximum
overall attendance of a couple thousand people.
The festival coordinators have received verbal approval to use the Farmers Market
area on Sunday and after the market on Saturday for event parking. Parking will
also be available on the vacant City owned lot located on the northeast corner
of Adrian Street and Midland Road, the public parking lot located on Aubrey north
of the park and three vacant City owned lots located between Adrian and Temple
Street one half block east of Midland Road. A few privately -owned lots in the
area have also been identified for additional parking. A condition of approval
for the temporary use permit requires that written approval be obtained from the
property owners for any private lots that will be used for event parking.
Several Volunteer Park Rangers will assist in traffic control and other event
operations.

The proposed festival has been organized and set up to have minimal impact on
surrounding residential and commercial uses. Staff therefore recommends that TUP
95 -19 be approved subject to conditions.
ENVIRONMENTAL REVIEW
The proposed use is Categorically Exempt, Class 4 from the California
Environmental Quality Act in that the festival is a minor temporary use of land
having negligible effects on the environment.
FISCAL IMPACT
None.
ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE
Notice of the event was handled similar to other special events in Old Poway
Park. Area residents who live on Sycamore Avenue immediately adjacent to the
west side of the park were given a written 30 -day advance notice of the event by
the Community Services Department.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 95 -19
WHEREAS, Temporary Use Permit 95 -19, submitted by Jack Cook /Pomerado
Community Band and the City of Poway, applicants, requests approval to hold a
community band festival on May 20, 1995 and May 21, 1995 in the Old Poway Park
which is located in the Open Space Recreation zone; and
WHEREAS, on May 16, 1995, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findings:
Pursuant to the procedures of the City of Poway implementing the
California Environmental Quality Act of 1970, the above - referenced project
is Categorically Exempt, Class 4 in that the event is a minor temporary
use of land that will have negligible effects on the environment.
Section 2: Findings:
The use is in accordance with the purposes and standards of Section
17.26.020 of the Zoning Ordinance.
Section 3: City Council Decision:
The City Council hereby approves Temporary Use Permit 95 -19 subject to the
following conditions:
Upon approval the applicant shall submit in writing that all conditions of
approval have been read and understood.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
SITE DEVELOPMENT
1. Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
2. Any necessary permits for electrical power shall be secured from the
Building Services Division and inspections shall be conducted before power
is allowed to be used.
3. Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit issuance.
4. All temporary signs shall be removed by May 22, 1995.

5. Written authorization shall be obtained from the property owners of all
privately owned lots used for event parking and shall be provided to the
Planning Services Department prior to the date(s) of the festival.
6. All event parking shall be provided free of charge.
7. Additional restroom facilities shall be provided.
8. Emergency vehicle access shall be maintained to all buildings.
9. Prior to any use of the project site or business activity being commenced
thereof, all conditions of approval contained herein shall be completed to
the satisfaction of the Director of Planning Services.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
