ENVIRONMENTAL REVIEW This project is categorically exempt (Class 4e) under the provisions of the California Environmental Quality Act as the events are temporary in nature and have negligible or no permanent effects on the environment. FISCAL IMPACT The city will be providing budgeted services such as traffic control, street cleaning, park set -up and maintenance, mowing of lots for temporary parking and other budgeted personnel costs as a sponsor of the Poway Days events. ADDITIONAL PUBLIC NOTIFICATION AND CORRESPONDENCE Notice was sent to the Poway Chamber of Commerce, Poway Days Committee, Kiwanis Club and the Poway Rodeo Committee. RECOMMENDATION It is recommended that the City Council approve Temporary Use Permit 95 -57 subject to conditions contained in the attached resolution. Fitch, Assistant City Manager Reba Wright- Quastler, Director of Planning Services Marijo Van Dyke, Associate Planner DATE: September 5, 1995 SUBJECT: Temporary Use Permit 95 -57, Poway Days Committee, Applicant: A request for the approval of a temporary use permit for the annual Poway Days events. BACKGROUND Section 17.26.020 of the Zoning Ordinance provides regulations for temporary uses within the City. The ordinance requires that outdoor entertainment events such as carnivals, parades, and rodeos be reviewed and approved by the City Council. This temporary use permit is for all of the Poway Days events including the Poway Days Parade, Community Day Carnival, City- Chamber Softball Game, Tour de Poway Bicycle Race, Rodeo Barbecue, Poway Rodeo and Rodeo Dance, beginning September 16 through October 1, 1995. The Poway Days Committee representing the City of Poway, Poway Chamber of Commerce, and the Poway Rodeo Committee is requesting authorization to hold the following Poway Days events: Poway Days Parade - September 16 The annual Poway Days Parade will be held on Saturday, September 16, 1995 between the hours of 10:00 a.m. and 12:00 p.m. Approximately 200 entries will follow the route shown on Attachment B. The route begins at the intersection of Pomerado Road and Poway Road and ends at the intersection of Poway Road and Bowron Road. The staging area will be in the Miller's Outpost parking lot. The horse staging area will be in the alley behind Miller's Outpost. The parade planning has been coordinated with the Department of Safety Services and the Poway Sheriff's Department. ACTION: See Summary Sheet 2 of 15 SEP 5 1995 ITEM 23 3 of 15 0 Agenda Report September 5, 1995 Page 2 Community Day - September 16 0 This year's Community Day activities will begin at noon on Saturday, September 16 at the Poway Community Park. Booths will be available for rent by groups to be used for food, games, contests, entertainment, and displays. Beer will only be allowed to be sold from a fenced beer garden area. Tour de Poway - September 17 The annual Tour de Poway will be held on Sunday, September 17, 1995. The 50 mile loop will start at 7:30 a.m. following the route shown on Attachment C. The 25 mile loop will begin at 8:00 a.m. following the route shown on Attachment D. The 15 mile loop will begin at 8:30 a.m. following the route shown on Attachment E. City - Chamber of Commerce Softball Game - September 28 The annual City of Poway - Poway Chamber of Commerce softball game will be held at 5:30 p.m. on Thursday, September 28, at the Lake Poway Ballfield as part of a "Sundowner" which will be jointly sponsored by the Poway Chamber of Commerce and the Poway Days Committee. Rodeo Bar -B -Que - September 23 The annual Poway Days Rodeo Bar -B -Que will be held on Saturday, September 23 at the Poway Valley Riders Association (PVRA) arena. The event will begin at 6:00 p.m. and end at midnight. The event will be sponsored by the Poway Rodeo Committee and will include dinner, beverages, casino gambling for prizes, music provided by a band, entertainment and dancing. Poway Rodeo Trail Ride - September 24 Sunday, September 24, 9:00 a.m. to 2:00 p.m. the ride is planned to start at Garden Road Stables and go to Goodan Ranch for lunch and then return to Garden Road Stables. About 100 participants are expected. Golf Tournament - September 28 "Nine in the Light - Nine at Night, With a Steak in the Between ". The tournament will be held on Thursday, September 28 at Oaks North Golf Course, with the steak dinner served at the Hamburger Factory. Poway Days Rodeo and Rodeo Dance - September 29. 30. and October 1 The Poway Days Rodeo will begin at 7:30 p.m. on September 29 and 30. It will begin at 2:30 p.m. on October 1. The Friday and Saturday night rodeo performances will be followed by a dance at the PVRA arena. Parking for the rodeo will be provided on the PVRA property, Tierra Bonita and Twin Peaks Schools and on vacant lots in the surrounding area off of Twin Peaks and Tierra Bonita Roads as shown on Attachment F. ENVIRONMENTAL REVIEW This project is categorically exempt (Class 4e) under the provisions of the California Environmental Quality Act as the events are temporary in nature and have negligible or no permanent effects on the environment. FINDINGS Pertinent departments have been contacted and specific conditions or requirements have been established for each of the Poway Days events. The events will be advertised from banners that are to be hung from utility poles along Poway, Pomerado, and Twin Peaks Roads. In addition, Poway Days signs shall be placed on the two entrance signs along Poway Road and rodeo signs will be placed on the Community Event Kiosks throughout the City; however, it was agreed that, in addition to the Community Events Kiosks, the Rodeo may use its 4'x8' signs in the same locations as last year, with the understanding that their use is to be phased out. If the Rodeo Committee decides to use any additional signs, they must be placed on the Community Event kiosks. P- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 95 -57 WHEREAS, Temporary Use Permit 95 -57, submitted by the Poway Days Committee, applicant, requests approval of the Poway Days events to be held at various locations throughout the City extending from September 16 through October 1, 1995. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Findings: Pursuant to the procedures of the City of Poway, implementing the California Environmental Quality Act, the above - referenced project is categorically exempt, Class 4e, in that the Poway Days events are temporary in nature and have negligible or no permanent effects on the environment. Section 2: Findings: That the proposed use is in accordance with the purposes and standards of Section 17.26.020 of the Zoning Ordinance. Section 3: City Council Decision: The City Council hereby approves Temporary Use Permit 95 -57 subject to the following conditions: APPLICANT SHALL CONTACT THE COUNTY HEALTH DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. All food and drink concessions operated for profit shall secure the necessary Health Department permit and State seller's permit. 2. Provide a list of food concessions, if applicable, prior to each event. 3. Inform all food concessionaires to contact this department prior to opening. 4. Require waste water disposal from food units to acceptable sewer or holding tanks. 5. Request that non - profit food booths comply with same requirements as commercial booths. 6. Inform all vendors using mobile units that their vehicles must comply with California Administrative Code, Title 17. Specifically, all doors must be self - closing, service windows must be 216 square inches or less, and shatterproof guards are required for all light bulbs. SEP 51995 ITEM 23 6 of 15 0 0 Resolution No. Page 2 7. Vendors preparing food in temporary booths must provide floors, walls and ceilings for the entire stand. APPLICANT SHALL CONTACT THE SHERIFF'S DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. One or more identifiable members of the event committee shall be on -site at all times when the parking areas are in use to assist with security of parked vehicles, to aid in the movement of vehicles in and out of the lots, to provide information to motorists and to minimize traffic congestion on surface streets. 2. All beverages shall be dispensed in paper cups -- no bottles or cans are allowed. 3. The event committee shall designate an on -site location for police, fire and paramedic units out of the main activity areas and maintain sufficient access for emergency vehicles at all times. 4. All music activities shall be terminated on or before 12:30 a.m. on the day following the event, and at no time shall the noise level exceed the permissible decibel (dB) level for the area's zoning designation. 5. The event committee shall have personnel designated at all times and at specified locations to provide liaison with representatives of the City's Fire and Sheriff's Departments. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. All fire hydrants shall remain clear of obstructions 25 feet in all directions. 2. The storage and removal of all trash material shall be provided so as not to constitute a fire hazard. 3. All materials used for decorative purposes shall be non - flammable. 4. All electrical cords and connections shall be utilized only in an approved manner. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Any necessary building or electrical permits shall be secured. 2. In all unpaved parking areas, temporary markers shall be provided to delineate parking areas and aisles and to ensure that no parking occurs within 100 feet of any existing residential structure. 7 of 15 SEP 51995 ITEM 23 0 0 Resolution No. Page 3 3. A minimum of two trash receptacles per acre of parking area or per single parking area, whichever is more restrictive shall be provided. 4. All signs for the events must be approved by the Director of Planning Services prior to installation and shall be removed promptly, within ten days following the event. 5. The representatives of the event committees shall meet with representatives of each of the City departments concerned at least one week prior to each event to ensure that all conditions of approval will be met. 6. The sites shall be utilized in accordance with this resolution and the approved site plans on file in the Planning Department, except as may otherwise be provided herein, prior to commencement of the activity. 1. Provision for temporary electrical power will require an electrical permit and an inspection approval by the Building Inspection Division. 8. The applicant shall obtain an insurance bond indemnifying the City from possible liability in an amount not less than $1 million for events which utilize City property. 9. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable City ordinances presently in effect. 10. The event sites shall be left free of debris, litter or any other evidence of the temporary use upon completion of the use. The following conditions shall be applicable to the Poway Day's Rodeo Bar -B -pue to be held at the Poway Valley Riders Association arena: 1. One chemical restroom per 200 visitors expected shall be provided. 2. A copy of the Alcoholic Beverage Control license of "Beer Sale Only" shall be provided no later than September 22, 1995. 3. A copy of the agreement with the adjacent property owner(s) for parking rights shall be provided no later than September 22, 1995. The following conditions shall be applicable to the Poway Days' Parade to be held on September 16, 1995 and beginning at Pomerado and Poway Roads and ending at the intersection of Poway and Bowron Roads: 1. The westbound lanes of Poway Road shall be kept open for emergency vehicles. Street intersections along the parade route will be kept clear of spectators for emergency traffic. 2. The Chamber of Commerce, sponsor of the parade, shall place all necessary barricades and cones along the parade and detour routes. SEP 51995 ITEM 23 8 of 15 0 0 Resolution No. Page 4 The following conditions shall apply to the Poway Days' Rodeo and dance to be held on September 29, 30, and October 1 at the Poway Valley Riders Association arena: 1. One chemical restroom per 200 visitors expected shall be provided. 2. A temporary "NO PARKING - TOW -AWAY ZONE" shall be established on the west side of Tierra Bonita Road from Donart Drive north to Poway Valley Road, to provide a wider pedestrian walking area into and out of the PVRA grounds, and to ensure sufficient access for emergency vehicles -- fire, paramedic and law enforcement. "NO PARKING" signs shall be placed along this area approximately 250 feet on center. 3. The rodeo committee shall designate an on -site location for police, fire and paramedic units out of the main activity areas and adjacent to the south vehicle gate of the PVRA property. 4. All music activities shall be terminated on or before 12:30 a.m., and at no time, shall noise level exceed the permissible decibel (dB) level for the areas zoning designation, i.e., RR -A and RR -C zone. 7:00 a.m. - 10:00 p.m. 50dB 10:00 p.m. - 7:00 a.m. 40dB 5. A waiver of Poway Municipal Code Section 5.12.110 is granted to allow the sale of alcoholic beverages and the attendance of minors at the dance following the rodeo performance between the hours of 9:00 p.m. and 12:30 a.m. 6. A copy of the Alcoholic Beverage Control license for "Beer Sale Only" shall be provided no later than September 22, 1995. 7. The rodeo grounds shall be patrolled by uniformed private security guards (a minimum of two private security guards) to assist with crowd control inside the rodeo area during hours of operation, and by members of rodeo and dance committee to maintain security of equipment and control of personnel remaining /residing on property after hours of operation. 8. The Poway Valley Riders Association shall provide security in parking areas during hours of operation. 9. A 24 -foot access (fire lane) shall be maintained along the northern edge of the property from Tierra Bonita Road to the western boundary with adequate turnaround for fire and medical apparatus. A sign shall be posted with copy reading "FIRE LANE - NO PARKING ". 10. Aisle spacing, as specified on the site plan shall be maintained. 11. Parking lot areas which are covered with weeds, grass, brush, etc., shall be bladed to bare earth so as not to constitute a fire hazard. SEP 51995 ITEM 23 9 of 15 Ll 0 Resolution No. Page 5 12. A fire inspection will be conducted the day before the rodeo opening. 13. A copy of agreement with the adjacent property owner(s) for parking rights shall be provided no later than September 22, 1995.
