P-90-70 A OF THE CITY COUNCIL OF THE CITY OF POWAY, CA APPR0VINGAN OF COUNTY SPECIAL USE PERMIT P-73-130M3W PARCEL NUMBERS the of County Special Use Permit P-73- 130M3W, Cal y, applicant, for the pu pose of continuing the aggregate operation on the real property s tuated in the City of Poway, County of San Diego, State of Call ornia, described as a portion of the west half and a portion o the east half of the northeast quarter of Section 25, Township 4 South, Range 2 West, San Bernardino Meridian, regularly came before City Council for public hearing and action on September 18, 1990; and the of Planning has 9ed approval of the extension of the County special use permit subject to all conditions set forth in the Planning Department report; and and has the City Council has read and considered said report fl other evidence presented at the public hearing. NOW, the City Council of the City of Poway does hereby resolve as follows: The City Council finds that a Final Subsequent EIR (SCH ) for the subject property was certified by the City Council on August 7, 1990 by Resolution No. 90-163. This document is adequate for consideration of the proposed extension of the existing special use permit which was approved by the County of San Diego in 1973 and extended in 1975. The City Council makes the following findings in regard to the extension of County special use permit P-73-130M3W. The extension of this i use permit for six months is compatible with the South Poway Planned Community. Complete findings for the new 1 use permit will be made as part of the March 5, 1991 rehearing. Additional and revised conditions are proposed to address issues of compatibility with the surrounding neighborhood and land uses. Resolution No. p_90-70 Page 2 ~cision: The City Council hereby the of County Special Use Permit P-73-130M3W subject to the following conditions: Within 30 days of approval: (1) The applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. 1. Comply with all conditions of the special use permit, attached as Exhibit A, except as modified by Conditions 2 through 6. 2. The Cadillac Fairview stockpiled material be processed first. CalMat shall not disturb any of the property y unmined in order to facilitate the springtime biological survey. Implementation f Reclamation Plan 89-05 shall be held in abeyance with t e exception that CalMat shall post the bond required t ereby (by Condition No. 1 on Page 3 of Resolution No. 0-164) not later than October 16, 1990. 5. Hours of operation shall be limited to: Monday - Friday Saturday 6:00 a.m. - 6:00 p.m. 8:00 a.m. - 6:00 p.m. Maintenance activities must cease at 9:00 p.m. Monday - Saturday.
