P- 90-77 A OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA USE PERMIT 90-11 PARCEL NUMBER conditional Use Permit 90-11 by the City of Poway, applicant, requests approval to construct a farm animal facility on approximately 0.35 of an acre of land in the southwest section of the Lake Poway Park area in the Open Space zone; and WHEREAS, on October 16, 1990, the City Council held a hearing on the above-referenced item. NOW, the City Council does hereby resolve as follows: Section 1: ~al Findil : The City Coun il finds that this project will not have a significant a verse impact on the t and hereby issues a Nega ive with mitigation as contained in t e conditions of approval. That the location, size, design, and oper ting characteristics of the proposed use will be compa ible with and will not adversely affect or be y detrimental to adjacent uses, residents, build ngs, structures, or natural , in that the proposed use is compatible with the adjacent Open Space and recreational uses and the use is adequately screened and buffered from residential uses in the vicinity. That the scale, bulk, coverage, and density is consistent with adjacent uses, in that all development standards of the Zoning Development Code are met. The project will meet the applicable property development standards. That there are available public facilities, , and utilities in the proximity to serve the proposed use. That there will not be a harmful effect upon neighborhood characteristics, in that adequate odor, noise, and mitigation will be implemented through the of approval. Resolution No. P- 90-77 ~-- Page 2 SITE 1. That the site is suitable for the type and intensity of use and development proposed in that the site is located in an Open Space zone and is from uses. That there will not be significant harmful effects upon the quality and natural That there are no other relevant negative impacts of the proposed use that cannot be mitigated. That the impacts, as described above, and the location of the proposed use will not affect the City of Poway General Plan for future as well as present development in that the General Plan designates this site as Open Space and an animal shelter is a permitted use with an approved conditional use permit. Section 3: The City Council hereby approves Conditional Use Permit 90-11 subject to the following conditions: within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. An annual review by the City Council will occur until such time that the animal facility use ceases. Six month reviews will occur for the first 18 months of operation. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential, l, and municipal uses. Prior to occupancy, a Joint use agreement between the City and Poway Unified School District shall be executed providing for the division of responsibilities for operation and maintenance of the facility. An effective animal waste management program shall be eveloped and implemented for the site. Animal stalls shall e cleaned on a daily basis. All animal manure shall be isposed of in sturdy cans with fly-tight lids or plastic rash bags sealed and placed i a dumpster to b picked up as often as to control f les and odor, bu a of twice a week. Fiy sprays, dis nfectants, and o her forms of insect deterrents shall be use in conjunction w th the daily cleaning of the facility. A fly control sys em shall be installed in the barn. Landscaping is to be installed per the plan on file with the Planning Department.
