P- 90-84 A OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ARCEL MAP 90-04, USE ERMIT 90-10, REVI W 90-12, AND IGN PERMI 90-44 PARCEL NUMBER 317-130-60, 28 Tentative Parcel Map 90-04, Conditional Use Permit 90-10, Development Review 90-12, and Sign Permit 0-44, hereinaft r "Map" described as a portion of the southwes quarter of t e northeast quarter of Section 13, Township 14 Sou h, Range 2 Wes , San Bernardino Base and Meridian, in the County o San Diego, Sta e of Cal submitted by Wal-Mart Stores Incorporate , applicant, requests approval of a three lot parcel map and to construct a 125,999 square foot retail building with garden and auto service centers and a 15 foot high ~ sign for the property located at 17170 y Road in the CC Zone; and on November 13, 1990, the City Council held a hearing on the above-referenced item. NOW, the City Council does hereby resolve as follows: The City Coun il finds that this project will not have a significant a verse impact on the environment and hereby issues a Nega ive with mitigation as contained in t e conditions of approval. The City Council makes the following findings regarding Tentative Parcel Map 90-04 and the Map thereof: The proposed project will be consistent with the existing general plan and there is a probability that the project will be consistent with the proposed general plan. The design or improvement of the tentative parcel map s consistent with all applicable general and specif c plans; in that the design is conditioned to conform o the development standards of the 1 Communi y zone. No. P- 90-84 Page he site is phys cally suitable for the type of evelopment propose ; in that the site is located within he central commerc al corridor. he site is physica ly for the density of the evelopment propose , in that the lot is relatively flat and lends itself to I development. The design of the project is not likely to cause ubstantial environmental damage and avoidable injury to umans and wildlife or other habitat; in that these actors were considered in the or the project. A Negative Declaration with mitigation will be issued for the project. The tentative parcel map is not likely to cause serious public health problems; in that all lots will be served by public water and sanitary sewer service. The design of the tentative parcel map will not conflict with any easement by the public at large, now of record, for access through or use of the property within the proposed i subd Conditional use Permit 90-10 The City Council makes the following findings regarding Conditional Use Permit 90-10: That the locat on, size, design, and oper ting characteristics o the proposed use will be compa ible with and will no adversely affect or be mater ally detrimental to a jacent uses, residents, build ~g , structures, or natural in that the use wi e located within the propose shopping center and an eig t foot wing wall and three oot berm and five foot wa 1 combination will be provide to screen the project and o provide acoustical mit gation from multi-fami y residential uses to the north and east and lighting for the project has been designed to glare and spillage. That the e will not be a harmful effect upon desirable neighbor ood characteristics since construction of the new bull lng will require the erection of a berm and wall combinat on wall to partially screen service bays from views in all directions. That the site is suitable for the type and intensity of use or development which is proposed, in that the General Plan and Zoning Development code allow auto ~ as a 1 use in the CC zone with benefit of a conditional use permit. Tha there will not be significant harmful effects upon env ronmental quality and natural because any env ronmental issues raised in the Initial Study will be mit gated in the conditions of approval to a level of ins gnificance. That the impacts, as described above, and the location of the proposed use will not adversely affect the City of Poway General Plan for future as well as present development because this property has been designated for Commercial Community uses. Review 90-12 City Council makes the Development Review 90-12: following findings regarding That the proposed development is in conformance with the Poway General Plan, in that auto are allowed in the Commercial Community zone with approval of a 1 use permit. The Wal-Mart retail operation is permitted by right in the Zoning Development Code. That the proposed development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties, as noted under the findings in the preceding sections. Resolution No. P-90-84 Page 4 That the proposed development is in compliance with the Zoning Ordinance, in that all development standards will be met in development of the project. The proposed development encourages the orderly and h rmonious appearance of structures and property within t e City because it complies with the design gu o the General Plan and proposes structures that are s milar in architectural style to other buildings in the adjacent shopping center. SITE 1. City Council makes the following finding regarding Sign Permit 90-44: In accor ance ith Resolution No. 85-067, City Council finds tha the al-Mart project has unusual circumstances in that t e bu lding is setback over 600 feet from the street an is sightly below grade and hereby approves a t sign o 15 feet as ~ from the nearest top of curb on Community Road. The City Council hereby approves Tentative Parcel Map 90-04, Conditional Use Permit 90-10, Development Review 90-12, and Sign Permit 90-44 subject to the ~ 3 conditions: Within 30 days of approval (1) The Applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and commercial uses. Site development requirements for handicapped accessibility found in Chapter 71 of the State of California Building Standards Code must be adhered to. All new buildings shall be accessible throughout. Location shall be subject to approval by the Planning Services Department. Said trash enclosure shall not be located adjacent to roadways unless adequately screened by the berm/wall combination. Prior to any use of the project site or business activity being fl thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Directors of Planning and Engineering Services. For a new commercial development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Permit and Plan Checking Fees, School Fees, prior to building permit Traffic Mitigation, Drainage, Water Base Capacity, Sewer Line Charge, and shall be paid prior to parcel map approval or building permit whichever occurs first. Permit and plan checking fees shall be paid upon submittal of a map, improvement, and/or grading plans, as applicable. Resolution No. P-90-84 Page 6 Sewer Annexation, Street Light Energy Charges, and Fire Protection Fees must be paid in full prior to scheduling of the parcel map for City Council approval. As part of the first annual review of the CUP for the auto center, the applicant shall submit an acoustical analysis to fulfill the mitigation monitoring provisions of AB 3180 and the City's Noise Ordinance. Should noise complaints be received from surrounding residents, more frequent review and additional mitigation may be required. In the absence of noise complaints, further acoustical analysis shall not be required for subsequent reviews. A sample of the "black steel picket" fence shall be approved by the Director of Planning Services prior to issuance of building permits. Ail masonry screen walls shall be constructed of split face of slumpstone block. The use of cinder block is prohibited. A bus shelter and bus turnout shall be constructed on Hilleary Place. Said turnout shall be approximately 160 feet in length as determined by the Director of Community Services and the County Transit Department. The shelter shall be designed using the City's standard drawing. This turnout will be incorporated in the project landscape setbacks and will not affect the proposed parking layout. '19. Ail two-way traffic aisles shall be a minimum of 25 feet wide and emergency access shall be provided, maintained free and clear, a minimum of 25 feet wide at all times during construction in accordance with Safety Services Department requirements. The main entry aisle shall be a minimum of 34 feet to promote the theme of a grand entry. Ail parking spaces shall be double striped such that each space is eight feet six inches wide center to center. A restriping program shall be vigorousl' pursued by the maintenance crew for the center. All di ectional arrows in the parking area shall remain visible and e painted as often as y for public safety. Thermoplas ic arrows shall be used at the main entry aisle and on all one way aisles to ensure durability. The striping and signing program for the parking lot shall be submitted to the Traffic Engineer and Director of Planning Services prior to approval of improvement plans. A detailed landscape and irrigation plan shall be submitted to and approved by the Planning Services Department prior to the issuance of building permits. Landscape Plan Check Fees shall be paid at the established rate. Resolution No. P-90-84 Page 8 The Landscape Plan shall be revised to be consistent with the civil plans submitted for Wal-Mart by Safino, Butcher, and Ormonde. All landscape plans shall conform to the City of Poway to Development and City of Poway Landscape Standards. Street tre s, a minimum of 15 gallon size or larger, shall be installed - accordance with the City of Poway ordinance and shall be p nted at an average of every 30 feet on Hilleary Place and 0 feet on Community and Midland Roads. Ail landscaped areas shall be in a healthy and thriving free from weeds, trash, and debris. The project shall be annexed into the appropriate Landscape Maintenance District (LMD) prior to final map approval. Vine pockets on six columns of the westerly elevation shall be installed prior to certificate of occupancy. The I stallation of vines on the screening walls is strong y 9ed to reduce the likelihood of graffi i. If, upon annual review by staff, graffiti is a prob em for the project, the addition of vines shall become mandatory. Ail cart stacking rack areas in the parking lot shall be surrounded by landscaping. The island of pavement at the southerly driveway on Community Road shall be landscaped with low growing plants. 10. The 20 foot peripheral setback from the property line for the out lots shall be landscaped prior to certification of occupancy for the wal-Mart building. SIGNS Any additional signs proposed for this development, other than the 15 foot t and 150 square foot channel letters on the front facade, shall be designed and approved in conformance with the Sign Ordinance. Signage for the auto and garden service centers shall be limited to i channel letters no greater than 18 inches in height. This standard was developed and implemented at Twin Peaks Plaza. Development of the two lots shall be by City Council through t e development review procedure. Any condition of approval will be limite to on- site improvements. If proposed expansion is submitte within five years of this approval, no additional off-site improvements will be required. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work at first submittal of grading plan. A geological report shall be prepared by a qualified engineer or geologist and submitted at the time of application for grading plan check. A p survey of surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting. Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. Rough grade approval must be completed prior to issuance of a building permit. Hilleary Place shall be constructed (Traffic Index - 7.0) with 50 feet of pavement, concrete curb and gutter, and a conc ete meandering sidewalk on the south side with minimum o 70 feet of right-of-way. Also, Hilleary Place s all be str ped with a two-way left turn lane providing 200 eet of a r ght turn lane and a 100 foot gap at each intersec ion. *3. Concrete curb, gutter, and sidewalk shall be constructed on all streets surrounding the proposed development including the corner parcel at the intersection of Midland Road and Hilleary Place. *4. The sour erly driveway on Communi y Road shall be designed with a righ turn only exit with a 4 foot radius and raised median. Developer shall acquire an encroachment permit for any private improvements placed within the public right-of-way. Modify the striping from Poway Road to Von's driveway to match south Community Road. Restripe Midland Road from Poway Road through the intersection at Hilleary Place. Restripe the Midland y Road intersection southbound approach lanes to provide a single left-turn lane, a left/thru lane, and a right-turn lane. Ail surrounding streets shall be restriped to include bike lanes with a width of four feet. Signalize the Community Road/Hilleary Place intersection and the Midland Road/Hilleary Place intersection. Ail public utility lines (i.e., drainage, water, sewer) not located within a public street shall have improved access over and along their respective easement. The developer shall pay the Traffic Mitigation Fee at the established rate prior to parcel map approval. AND FLOOD Intersection drains will be required at locations specified by the Director of Engineering and in accordance with standard engineering practices. A drainage system capable of handling and disposing of all surface water originating within the subdivision, and all surface waters that may flow onto the subdivision from adjacent lands, shall be required. Said drainage system shall include any and as required by the Director of Engineering Services to properly handle the drainage. Portland cement cross gutters shall be installed where water crosses the roadways. The Master Plan of Drainage Fee shall be paid at the established rate prior to final map approval. Concentrated flows across driveways and/or sidewalks shall not be permitted. Storm drains shall not be constructed under any structures. Developer shall dedicate to the City of Poway a 40 foot wide drainage easement across the property. A separate on-site reclaimed water system for landscaping an i rigation shall be sized and installed to the satisfaction o t e City Engineer. Connection between the on-site system an t e City's reclaimed water main proposed for Community Roa s all be made when sufficient reclaimed water capacity is available. Water and sewer main lines and appurtenances that will be installed at locations other than public streets shall have an easement, a minimum of 20 feet wide, dedicated to the City of 10. For lines within the development, dedication shall be offered on the parcel map, whereas off-site lines shall have the easement dedicated by a separate instrument recorded prior to map approval. Ail proposed utilities within the project shall be installed underground including existing utilities along Circulation Element roads and/or highways less than 34.5 KY. utility easements shall be provided to the specification of the serving utility companies and the Director of Engineering Services. The developer shall be responsible for the relocation and undergrounding of existing public utilities prior to certification of occupancy. Water, sewer, and fire p systems plans shall be designed and constructed to meet requirements of the City of Poway and the County of San Diego Department of Health. Prior to acceptance of property for sewer to the sewer improvement area shall occur. annexation The applicant shall pay for a water system analysis to establish the proper size and location for the public water system. The amount will be determined by the cost of the analysis and shall be paid upon submittal of improvement plans. The applicant shall, within 30 days after receiving approval of the tentative parcel map, conditional u e permit, and development review, a ply for a Letter of Ava lability (LOA) to reserve sewerage vailability an post wi h the City, a nonrefundable reserva ion fee equal to 20% of he appropriate sewerage connection ee in effect at the time the LOA is issued. Developer shall construct a public street light system conforming to City of Poway standards at no cost to the public, subject to the following: Cut-off luminaries shall be installed which will provide true 90 degree cutoff and prevent projection of light above the horizontal from the lowest point of the lamp or light emitting refractor or device. b. Annexation to the lighting district shall be accomplished and evidence of annexation shall be accomplished at the time of final inspection or Certificate of Occupancy, whichever occurs later. Minimum size o building numbers is 18 inches on facade of building. The buildings will be required to install an approved fire sprinkler system meeting NFPA 13 standards and City policies. A sump or pit is required to prevent contaminants from entering the storm drain system. ls or R AND A ration bond in an amount acceptable to the City Engineer shall be posted prior to map approval. Developer shall provide the City of Poway with copies of all available digitized topographic and improvement data reflecting initial conditions and as-built conditions of the development. Final parcel maps shall conform to City standards and procedures. Should this subdivision be further divided, each final map shall be submitted for approval by the Director of Engineering Services. Ail provisions of the Subdivision Ordinance of the Poway Municipal Code shall be met as they relate to the division of land. Prior to final map approval, all dedications shall be made and easements granted as required above. The t map approval shall expire on 13, 1992.
