the City; and
this habitat is utilized by the
gnatcatcher, a candidate species under the Endangered Species Act;
and
the Poway Comprehensive Plan the
preservation of open space and habitat for wildlife as an important
community objective; and
an interim replacement standard is needed until the
City-wide gnatcatcher study is completed by May 1991 and its
acted upon by the City Council as part of the
General Plan update.
NOW, the City Council does hereby resolve as
follows:

The City Council finds that the proposed interim standard for
replacement of Coastal sage scrub habitat is categorically
exempt from the requirements of the California tal
Quality Act, Class 13 - Acquisition of Lands for wildlife
tion Purposes.

The proposed action is with the existing
general plan and applicable specific plans; and, there is
reasonable probability that the proposed action will be
consistent with the proposed §eneral plan.
That the interim standards are only applicable where
mitigation is required under CEQA and where unavoidable
impacts to sage scrub habitats which are not of high
quality and/or contain concentrations of gnat or
other sensitive species.
That an interim standard of a 1:1 replacement ratio is
established for projects which remove disturbed habitat
not harboring any sensitive species.

That an interim standard of a 2:1 rep ratio is
established for projects which remove Coastal sage scrub
habitat as part of the development.
That a mitigation fund be created that would be
administered by the City for the acquisition of habitat
within the City or elsewhere in the county and that
expenditures for acquisition shall occur within six
months of payment into the fund by project applicants.
Applicants are responsible to help identify suitable
habitat areas for acquisition and, where feasible,
acquire the habitat mitigation sites in consultation with
the City.
