OF THE CITY OF POWAY, CALIFORNIA

REVIEW 90-09
PARCEL NUMBER 31'
Variance 90-13 and Development Review 90-09,
submitted by Daley ' l Ventures, I c., applicant, requests
ap roval of a 74,591 square foot industria building and a 14 foot
hi h retaining wall, where six feet s the height
pe mitted, on Lot 6 in the Parkway Centre in the PC
(Panned zone; and
on November 27, 1990, the City Council held a hearing
on the above-referenced item.
NOW, the City Council does hereby resolve as
follows:
Section 1: Environmental Findi~ :
The City Council finds that the potential 1
impacts of this project were adequately d' in the EIR
and Subsequent EIR for the South Poway Planned Community.
Section 2: Find :
-09
The proposed project will be consist nt with the existing
general plan and there is a reasona le probability that
the roject will be consistent with he proposed general
plan and, that the proposed evelopment is in
conf rmance with the South Poway Planned Community
Deve opment Plan, in that the proposed light 1
buil lng conforms to the land use plan and development
stan ards for the planned community.
That the propose development will not have an adverse
esth tic, healt , safety, or architecturally related
mpac upon adJo ning properties, in that the proposed
uild ng is sim lar to and will complement existing
ild ngs in the vicinity.
That the proposed development is in compliance with the
Zoning Ordinance because it to the SPPC
Development Standards text.
e
That the proposed development encourages the orderly and
harmonious appearance of structures and property within
the City through their consistency with the SPPC plan
Resolution No. P-90-93
Page 2
which provides high standards of development for a
planned community.
90-13
That there are special circumstances applicable to the
roperty, (size, shape, topography, location, or
ings) or the intended use of the property, and
ecause of this, the strict application of the Zoning
evelopment Ordinance deprives the property of privileges
enjoyed by other properties in the vicinity under
identical zoning classification.
The special circumstances include t e slope east
and south of the proposed wall. T e L-sh p~d retaining
wall is y in order to set he bui d n into the
slope. Othe buildings in the ndustr a ark have
minimized the r setbacks by combin ng bui d n wall and
retaining wal and the strict limit on reta ning wall
height would prive this developer of that privilege.
That granting the or its modification is
y for the preservation and enjoyment of a
substantial property right possessed by other property in
the same vicinity and zone and denied to the property for
which the is sought.
In that a zero foot interior side yard setback is
permitted by the development standards and the subject
] wall permits this development to the
side yard setbacks in a manner similar to other
structures in the business park.
That granting the or its modification will not
be mat rially detrimental to the public health, safety,
or wel are, or injurious to the property or improvements
in suc vicinity and zone in which the property is
locate because the wall will be on three sides
and wi 1 be located so far from the parking and building
entrance that it will not be very noticeable.
The granting of this do not constitute a
special privilege inconsistent with he 1 upon
other properties in the vicinity an zone in which such
property is situated, because t ere is a unique
combination of circumstances on this site including the
existing slopes and building location which Justify the
request.
5. The granting of this variance does not allow a use or
activity which is not otherwise expressly authorized by

the zoning development regulation governing the parcel of
property in that retaining walls are permitted by the
South Poway Development Standards.
Tha granting the or its will not
be ~compatible with the Poway Genera Plan, because the
var nce will be instrumental in permi ting this property
to e developed with the type of bui ding and use that
the General Plan has designated as appropriate for this
site.
