Conditional Use Permit 90-12 submitted by the City of
Poway, applicant, for the purpose of 3 a City park on
the real property as portions of Section 13 Township 14
South, Range 2 West, San Bernardino Meridian, in the City of Poway,
County of San Diego, State of California, as follows:

NOW, the City Council does hereby resolve as
follows:
The City Cou cil finds that the project will not have
significant a verse impact on the t and hereby
issues a Nega ive Declaration with mitigation as
contained in t e conditions of approval.
Section 2: Findin ~:
The proposed project will be consistent with the existing
general plan and there is a reasonable robability that
the project will be with the roposed general
plan because the land use designation f r this property
is unlikely to change during the Genera Plan Update.
That the locat on, size, design, and o er ting

with and will no adversely affect or be ma r ally
detrimental to a jacent uses, residences, bu d ngs,
structures, or na ural , in that the s ing of
passive and active recreation areas of the par within
neig is found to be y for
the recreational needs of the neighborhood and the
community at large.
That the harmony in scale, bulk, coverage, and density is
consistent with adjacent uses, in that it is
architecturally compatible with the surrounding
development.
That there are available public facilities, , and
utilities to the new park.

That there will not be a harmful effect upon desirable
neighborhood characteristics, in that the screening,
parking, and pedestrian access have all been designed to
address the overall nelg needs.
That the generation of traffic will not adversely impact
the surrounding street ~d/or the City's Circulation
in that an parking lot will be
provided in the park and t e north side of y Place
will provide on-street par lng. Community Church and the
park can provide reciprocal parking for Sunday
and leage sport events.
That the site is suitable for the type and intensit- of
use or development which is proposed, in that the ark
provides both active and passive recreati hal
opportunities both to the immediate neighborhood an to
the community at large.
That there will not be significant harmful effects upon
environmental quality and natural , in that
proposed mitigation and project design
modifications will mitigate the impacts to a level of
insignificance.
That there are no other relevant negative impacts of the
proposed use that cannot be mitigated.
The proposed use will not adversely affect the City of
Poway General Plan for future as well as present
development, in that the General Plan designates parks as
one of the conditional uses permitted in the OS zone.
The City Council hereby approves subject to the following
conditions:

Site shall be developed in accordance with the approved site
plans on file in the Planning Services Department and the
conditions contained herein.
Revised site plans and building elevations incorporating all
conditions of approval shall be submitted to the Planning

The City shall obtain a streambed alteration permit from the
California Department of Fish and Game prior to initiation of
grading activities.
The Director of Community Services shall appoint a committee
to review the type of play equipment to be purchased for
Hilleary Park. Said committee shall have a of three
residents from the Hilleary Park neighborhood.
The park and pedestrian on-site trails shall be designed to be
accessible to the handicapped throughout.
A six foot barrier shall be placed between the soccer field
and Community Road. Said barrier shall be a vinyl clad chain
link or dense shrubs to stop stray balls.

Ail parking lot landscaping shall consist of a of one
15 gallon size tree for every three spaces. For parking lot
islands, a 12 inch wide walk adjacent to parking
stalls shall be provided and be separated from vehicular areas
by a six inch high, six inch wide portland concrete cement
curbing.

Parking lot lights shall be low pressure sodium and have a
maximum height of 18 feet from the finished grade of the
parking surface and be directed away from all property lines,
adjacent streets and residences.
Ail two-way traffic aisles shall be a minimum of 25 feet wide
and emergency access shall be provided, maintained free and
clear, a minimum of 24 feet wide at all times during

construction in accordance with Safety Services Department
requirements.
Ail parking spaces shall be double striped and have a
dimension of 8.5' x 18.5'.
Two handicapped parking spaces shall be provided in the
parking lot.

A landscape and irrigation plan shall be to
and approved by the Public Department and Planning
Services Department prior to the issuance of building permits.
Shade trees shall be included in the vicinity of the tot lot
to provide shade for play equipment.

Ail landscaped areas shall be in a healthy and
thriving condition, free from weeds, trash, and debris. The
irrigation system shall be double plumbed to utilize reclaimed
water when available.
A low river bench design with Western Sycamores (platanus
), Fremont Cottonwoods (P pulus fremontii), and Black
Willow (Salix gooddingii) compr sing a dense canopy of a
clustered understory intersperse with trails, benches, and
tables shall be included on the andscape plan.
The maintenance clearing of Rattlesnake Creek shall be
eliminated and flood control should be addressed through the
general expansion of the channel width, where opportunities
exist. Secondary benches with canopy trees shall be provided
for containment of over-bank flooding.
Exotic plant infestations along the defined Rattlesnake Creek
should be controlled through an eradication program desi ned
to remove such species as Giant Cane (Arundo don x ,
Ca torbean (Ricinus ), Tamarisk (Tamarix p ,
an Eucalyptus (Eucalyptus ssp.) while replacing plant n s
wi native plants including willows (Salix ssp), wes e n
Co onwoods, and Western Sy Said program shall e

Intersection drains will be required at locations specified by
the Director of Engineering and in accordance with
standard engineering practices.
The proposed project falls within areas indicated as subject
to flooding under the National Flood' Program and is
subject to the provisions of that program and City Ordinance.
