90-12 and Minor Development Review 90-79,
by Leroy Marten, applicant; and
Section 17 of the Poway Municipal Code
provi es that such decision of the City Council is final and
effec ive within ten calendar days unless a request for rehearing
is fi ed in accordance with Section 17 , and
pursuant to Section 17 the City Council
finds that there is new and different evidence not available at the
previous hearing on January 15, 1991, namely:
That landscape screening was found to be y, from

court.
NOW, the City Council does hereby resolve as
follows:
Section 1 :
1. Pursuant to Section 17 ~ the City Council grants
the request for rehearing.
The rehearing is to be held within 40 days of January 29,
1991, unless the time limits are waived by the applicant
in writing.
Pursuant to Section 17 the decision of January
15, 1991, to approve 90-12 and Minor Development
Review 90-79 by Resolution No. P-91-06 is hereby
rescinded and has no further force and effect.
