cons ruction of a new 4,692 square foo sanctuary and additional
park ng on the existing church lot loca ed at 13710 Midland Road,

WHEREAS, on February 19, 1991, the City Council held a hearing
on the above- item.
NOW, the City Council does hereby resolve as
follows:

The City Council finds that this project will not have a
significant adverse impact on the t and hereby

operated at this location for 30 years in a manner
compatible with the surrounding residential neighborhood.

t e Zoning Development Code have been met. The project
w 11 meet the applicable property development standards
for off-street parking, setbacks, lot coverage· and
building height. The 52 foot high steeple and cross
structure is consistent with Ordinance 272 which permits

the construction of steeples and other community
landmarks that exceed 35 feet in height.
That there are public , , and
utilities to serve the proposed use in that four EDUs of
sewer capacity have been allocated to the project and all
facilities and can be provided for through the
conditions of approval.
That there will not be a harmful effect upon desirable
neighborhood characteristics, in that the physical
separation between residential and church uses will be
adequate.
That the generation of traffic will not adversely impact
the surrounding streets and/or the City's Circulation
Element in that a condition of approval will require the
payment of Traffic Mitigation Fees, widening of Midland
Road and the construction of an expanded off-street
parking lot for church services and activities.
That the site is for the type and of
use and develo ment proposed in that the property is
located in a r sidential neighborhood that can use its
services and uildings. The proposed parking and

per Ordinance No. 304 Section 7 as it is a conditional
use.

That the proposed development is in conformance with the
Poway General Plan, which permits in
single-family zones subject to approval of a conditional
use permit.
That the proposed development will not have an adverse
aesthetic, health, safety, or architecturally related
impact upon adjoining properties, as noted under the
findings in the preceding section.
That the proposed development is in compliance with the
Zoning Ordinance, in that all development standards of
the RS-2 zone as well as the special standards applicable
to semi-public uses will be met in development of the
project.
The proposed development encourages the orderly and
harmonious appearance of structures and property w thin
the City because it complies with the design guide ines
of the General Plan and is compatible with the Old oway
Specific Plan which is immediately north of the su ject
property.

The City Council hereby approves County Use Permit 60-61M2 and
Development Review 90-16 subject to the following conditions:
within 30 days of approval (1) The Applicant shall submit
in writing that all conditions of approval have been read
and understood; and (2) the property owner shall execute
a Covenant on Real Property.
The use conditionally granted by this permit shall not be
conducted in such a manner as to interfere with the
reasonable use and enjoyment of surrounding residential
and semi public uses.

This approval shall become null and void if building permits
are not issued for this project within two years from the date
of project approval.

Ail parking lot landscaping shall consist of a minimum of one
15 gallon size tree for every three spaces. For parking lot
islands, a 12 inch wide walk adjacent to parking
stalls shall be provided and be separated from vehicular areas
by a six inch high, six inch wide portland concrete cement
curbing.
Parking lot lights shall be low pressure sodium and have a
height of 18 feet from the finished grade of the
parking surface and be directed away from all property lines,
adjacent streets and residences.
Ail two-way traffic aisles shall be a of 25 feet wide
and emergency access shall be provided, maintained free and
clear, a of 24 feet wide at all times during
construction in accordance with Safety Department
requirements.
Ail parking spaces shall be double striped and have a
dimension of 8.5 ft by 18.5 ft.
A six foot high wood fence shall be constructed along the
entire westerly property line. Said fence shall be maintained
in good repair by the church at all times.
A detailed landscape and irrigation plan shall be submitted to
and approved by the Public Services Department and Planning
Services Department prior to the issuance of building permits.
Street trees, a of 15 gallons or larger, shall be
installed in accordance with the City of Poway ordinance and
shall be planted at an average of every 30 feet on Apache Road
and 20 feet on Midland Road.

thriving condition, free from weeds, trash, and debris.

A development review shall be filed with the Planning Services
Department and approved by City Council for Phase II of the
master plan.
The conditional use permit shall be subject to annual review
by the Director of Planning for compliance with the
conditions of approval and to address that may have
occurred during the past year. If the permit is not in
compliance with the of approval, or if the Planning
Services Department has received complaints, the required
annual review shall be set for a public hearing before the
City Council, to consider tion or revocation of the
use permit.

Grading of the subject property shall be in accordance with
the Uniform Building Code, City Grading Ordinance, approved
grading plan and g i report, and accepted grading
practices.
A soils report shall be prepared by a qualified engineer
licensed by the State of California to perform such work
at first submittal of grading plan.
A geological report shall be prepared by a qualified engineer
or geologist and submitted at the time of application for
grading plan check.
The final grading plan shall be subject to review and approval
by the Planning and Engineering Services Departments and shall
be completed along with rough grade approval prior to

A pre-blast survey of surrounding property shall be conducted
to the satisfaction of the City Engineer prior to any rock
blasting. Seismic recordings shall be taken for all blasting
and blasting shall occur only at locations and levels approved
by the City Engineer.

Prior to any work bein performed in the public right-of-way,
a right-of-way permit hall be obtained from the Engineering
Services Department an appropriate fees paid, in addition to
any other permits requ red.
The applicant shall pay the Traffic Mitigation Fee at the
established rate prior to the issuance of a building permit
for each phase.

Intersection drains will be required at locations specified by
the Director of Engineering and in accordance with
standard engineering practices.

where water crosses the roadways.
The Master Plan of Draina e Fee shall be paid at the
established rate in accorda ce with the Drainage Ordinance
prior to issuance of a build ng permit. The developer shall
pay the Midland Drainage Bas n Fee in the amount of $4,336.38
prior to of building permits.
Concentrated flows across driveways and/or sidewalks shall not
be permitted.
The developer shall be responsible for the to
undergrounding of public utilities for the existing sanctuary
and the new building prior to certification of occupancy.
Removal of the utility poles shall not be required if the
waiver of protest is signed by the applicant.
Water, sewer, and fire protection systems plans shall be
designed and constructed to meet requirements of the City of
Poway and the County of San Diego Department of Health.
The applicant shall, withi 30 days after 3 approval
of the conditional use perm t and development review apply for
a Letter of Availabili y (LOA) to reserve sewerage
availability an post wi h the City, a non-refundable

reservation fee equal to 20% of the appropriate sewerage
connection fee in effect at the time the LOA is issued.

true 90 degree cutoff and prevent projection of light
above the horizontal from the lowest point of the lamp or
