P-91-54 A OF THE CITY COUNCIL OF THE CITY OF POWAY, MINOR USE PERMIT 91-01 AND MINOR REVIEW 91-38 PARCEL NUMBER 275-332-28 Minor Conditional Use Permit 91-01 and Minor Development Review 91-38, submitted by Helen Klentz/Rae Sage on behalf of Anne Winton Realty, applicant, requests approval to expand an existing real estate office building located at 16616 Espola Road, in the RR-C zone; and on August 13, 1991, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, to this app NOW, the City Council of the City of Poway does hereby resolve as follows: This project is categorically exempt under the p of CEQA (Class 1), minor alteration of existing private structures. Section 2: Findi! 5: The proposed location, size, design, and operating characteristics of the ro osed use is in accord with the title and purpose of th s esolution, the purpose of the zoning in which the s e s located, the Poway Gene al Plan and development po ic es and standards of the Ci y, because the building is an existing legal structure wh ch has been used lawfully and in compliance with the Zon ng Ordinance and General Plan. That the locat on, size, design, and oper ting characteristics o the proposed use will be compa ible with and will no adversely affect or be mater ally detrimental to a jacent uses, residents, build ngs, structures, or natural , in that the use will not change, and the extent of the physical change to the building is not significant, and the sales office is located on the corner of a major arterial, therefore access to the property does not intrude into the single family residential neighborhood. That the harmony in scale, bulk, coverage, and density is consistent with adjacent uses, because the building is small in comparison to single family homes. Resolution No. P-91-54 Page 2 That there are available public facilities, services, and because the use will be located in an 1 building. That there will not be a harmful effect upon desirable neighborhood characteristics, in that the sales office has operated harmoniously with the surrounding neighborhood for an extended period of time. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element, in that there is adequate off street parking provided, and the addition of 44 square feet will not be material to the generation of additional traffic. That the site is suitable for the type and y of use or development which is proposed, in that it is n the corner of a busy intersection, and has been the si e of a real estate sales office since the inception of a 1 surrounding residential property in the immedia e vicinity. That there will not be significant harmful effects upon quality and natural in that the site is wholly disturbed and the area of expansion is not significant. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. 10. That the impacts, as described above, and the location of the roposed use will not ~versely affect the City of Powa General Plan for uture as well as present deve opment in that the ex sting use conforms with the p of the General P an and the Zoning The City Council hereby approves Minor Conditional Use Permit 91-01 and Minor Development Review 91-38 subject to the following conditions: within 30 days of approval, the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a on Real Property.
