P-91-57 A OF THE CITY COUNCIL OF THE CITY OF POWAY, APPROVING CONDITIONAL USE PERMIT 91-09 AND REVIEW 91-27 PARCEL NUMBER 317-281-17, 18; 31~ Conditional Use Permit 91-09 and Development Review 91-27 b' the Cit' of Poway, applicant, for the purpose of ~ a Sorts Com lex on the real property described as portions of Sec ion 24 ownship 14 South, Range 2 West, San Bernardino Mer±d an, in t e City of Poway, County of San Diego, State of California, described as follows: the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, the City Council does hereby resolve as follows: The City Cou cil finds that the project will not have significant a verse impact on the ~ and hereby issues a Nega ive with mitigation as contained in t e conditions of approval. Conditional Use Permit 91-09 The pro osed project will be consistent with the existing specifi plan and general plan and there is a reasonable p f that the project will be consistent with the propose general plan. That the size, design, and operating of the proposed use will be compatible wi h and wi 1 not adversely affect or be materially de rim ntal o adjacent uses, buildings, structures, or na ura in that the siting of active areas of the park within the South Poway Planne Community (SPPC) is found to be y for the 1 needs of the business park and the community at large. That the harmony in scale, bulk, coverage, and density is consistent with adjacent uses, in that it is architecturally compatible with the surrounding development. 4. That there are available public facilities, services, and utilities to the new sports park. Resolution No. P-91-57 Page 2 That there will not be a harmful effect upon desirable neighborhood charac eristics, in that the screening, p rking, and pedestr an access have all been designed to impacts to t e nearest neighborhood. T e sports park prov des a less intensive land use than 1 ght industrial development, provides landscape ], on-site parking with predominant hours of use would be offset from normal business hours with peak traffic flows. The existing roads are adequate in size to accommodate the projected traffic volumes. The primary use of the sports park is expected to occur during off-peak hours and weekends. That there will not be significant harmful effects upon environmental quality and natural , in that proposed mitigation and project design modifications will mitigate the impacts to a level of insignificance. That the proposed development will not have an advers aesth tic, health, safety, or architecturally relate impac upon adjoining properties, in that the propose build ngs are compatible with and will complemen exist ng buildings in the area. Section 3: lcil Decision: The City Council hereby approves Conditional Use Permit 91-09 and Development Review 91-27 subject to the following conditions: City Council shall review the CUP after the first year for compliance with the conditions of approval and to address that may have occurred during the past year. Should subsequent arise, the City Council will address such on a case-by-case basis to determine if modification or revocation is y. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding industrial uses, i or residential uses. Poles shall be vandal and low-maintenance, and light fixtures shall be energy-eff cient and incorporate glare- control features to reduce lig t pollution. The tennis court lights shall conform to the standards of Section 17.30.020 of the Municipal Code for Recreational Courts. Ultra low flow plumbing fixtures shall be installed throughout buildings in the sports park. This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. Resolution No. P- 91-57 Page 5 PARKING AND ACCESS Ail parking lot landscaping shall consist of a minimum of one 15 gallon size tree for every three spaces. For parking lot islands, a 12 inch wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a six inch high, six inch wide portland concrete cement curbing. Parking lot lights shall be low pressure sodium and have a maximum height of 18 feet from the finished grade of the parking surface and be directed away from all property lines, adjacent streets and residences. Driveways shall have a minimum width of 30 feet and shall be designed as an alley apron with ten foot minimum radius. Where driveways are adjacent to sidewalks, pedestrian ramps shall be rquired. Monuments shall be permanently protected or relocated when they conflict with the permanent improvement. Street improvements shall include curb, gutter, paving, streetlights, underground utilities, striping, and traffic control Prior to occupancy, the following streets shall be improved to the satisfaction of the City Engineer: Stowe Drive from Community Road to the most easterly property line. McIvers Court from Stowe Drive northerly to the end of the cul-de-sac. Crosthwaite Circle from Stowe Drive to the most northerly property line of the Sports Park complex. DRAINAGE AND FLOOD CONTKOL A drainage system capable of handling and disposing of all surface water originating within the property, and all surface waters that may flow onto the property from adjacent lands, shall be required.
