Conditional Use Permit 90-12(M) submitted by the Cit'
of Powa', applicant, for the purpose of modifying a previousl'
approve conditional use permit for development of a City park o
the rea property de cribed as portions of Section 13 Tow ship 1
South, ange 2 West, an Bernardino Meridian, in the City o Poway,
County of San Diego, tate of California, regularly came be ore the
city Council for pub ic hearing and action on October 8, 1 91; and
the City Council has approved the Parks and
Recreation Advisory Committee 9ations for a revised site
plan for Hilleary Park which would replace the approved ballfield
with a soccer field and a practice soccer area; and
the City Council has read and considered said report
and has considered other evidence presented at the public hearing.
NOW, the City Council does hereby resolve as
follows:

The City Council finds that the previously issued Negative
Declaration adequately discusses the environmental of
this project.
S' :
The proposed project will be consistent with the existing
general plan nd there is a reasonable robability that
the project w 11 be consistent with the roposed general
plan because he land use designation f r this property
is unlikely t change during the Genera Plan Update.
That the locat on, size, design, and o er ting
characteristics o the proposed use will be co a ible
with and will no adversely affect or be ma r ally
detrimental to a Jacent uses, residences, bu d ngs,
structures, or na ural , in that the s lng of
passive and active recreation areas of the par within
residential neighborhoods is found to be ~ for
the 1 needs of the neighborhood and the
community at large.
That the harmony in scale, bulk, coverage, and density is
consistent with adjacent uses, in that it is
architecturally compatible with the surrounding
development.

That there are available public facilities, services, and
utilities to the new park.
That there will not be a harmful effect upon
neighborhood characteristics, in that the ~,
parking, and pedestrian access have all been designed to
address the overall neighborhood needs.
That the generation of traffic will not adversely impact
the surrounding street nd/or the City's Circulation
Element, in that an of -street parking lot will be
provided in the park and t e north side of Hilleary Place
will provide on-street par ing. Community Church and the
park can provide reciprocal parking for Sunday services
and league sport events.
That the site is suitable for the type and intensit' of
use or development which is proposed, in that the ark
provides both active and passive recreati hal
opportunities both to the neig an to
the community at large.
That there will not be significant harmful effects upon
environmental quality and natural in that
proposed mitigation and project design
modifications will mitigate the impacts to a level of
insignificance.
That there are no other relevant negative impacts of the
proposed use that cannot be mitigated.
The proposed use will not adversely affect the City of
Poway General Plan for future as well as present
development, in that the General Plan designates parks as
one of the conditional uses permitted in the OS zone.
The City Council hereby approves Conditional Use Permit 90-
12(M) subject to the following conditions:
within 30 days of approval the applicant shall submit in
writing that all conditions of approval have been read
and understood.
2. Approval of CUP 90-12(M) is based on its conformance with
- the conditions in City Council Resolution P-90-94.
