WHEREAS, the City Council periodically finds it
amend the South Poway Specific Plan; and
y to
Section 65450, et seq. of the California t
Code describes the procedures for amending Specific Plans; and
on July 30, 1985 the City Council adopted a
resolution approving the South Poway Planned Community (SPPC)
Development Plan, and said plan has been prepared and adopted as a
Specific Plan, and provides for the sy implementation of
the Poway General Plan; and
Volume II (Development Standards of the SPPC
Development Plan) contains procedures for amending the subject
development plan; and
the City Council has initiated South Poway Specific
Plan Amendment (SPA 84-01Q) involving amendment of the building
setback requirements contained in Volume II, Development Standards,
South Poway Planned y; and
on Novemb r 5, 1991, the City Council of the City of
Poway held a properly no iced public hearing in accordance with the
California Co e and the California tal Quality
Act (CEQA) to t is request; and
at said public hearing, the City Council determined
that the proposed amendment was categorically exempt from
tal review under the p of Class 5 which includes
minor modifications to land use standards.
NOW, be it resolved that the City Council does
hereby amend the text to the South Poway Specific Plan (volume II)
as
Volume II (Development Standards) Chapter 3, Section
IIIB. The setbacks section shall hereby be amended by
adding the following new NOTE NO. 9 to read as follows:
Front and street side yard for buildings
may be averaged as illustrated in Exhibit iA.
Buildings may not encroach more than five feet into
the required 35 foot setback. In all cases, the
encroachment shall be offset by an equal building
area which observes a proportionately greater
setback. The average building setback must be 35
feet.
