WHEREAS, modification of Condition 1 Use Permit 89-10 submitted by the City
of Poway, applicant, for the purpose o expanding the size of the Hamburger
beyond that noted in Specific Plan 89-0 and CUP 89-10 situated in the City of
Poway, County of San Diego, State of Ca ifornia, described as a portion of the
southeast quarter of the northeast quarter of Section 12, Township 13 south,
Range 2 west, San Bernardino Meridian, regularly came before the City Council for
public hearing and action on July 14, 1992; and
WHEREAS, the City Council has read and considered said report and has
considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does hereby resolve
as follows:
The City Council finds that the Negative Declaration issued with SP 89-06
and CUP 89-10 adequately discusses the tal concerns of this
project.
Sec :
The City Council hereby finds:
That the location, size, desi n, nd operating ch of
th proposed use will be com ati le with and will not adversely
af ect or be materially detri..ent 1 to adjacent uses, residences,
bu ldings, structures, or na ura in that the design,
ma erials, and colors are consistent with the existing restaurant
wh ch is located in the active section of the park adjacent to
ex sting 1 uses.

That the harmony in scale, bulk, coverage, and density is consistent
with adjacent uses in that it is architecturally compatible with the
existing building and surrounding development.
That there are available public facilities,
to accommodate the building addition.

That there will not e a harmful effect upon desirable neighborhood
characteristics in t at the building modification is consistent with
the design and tha the scale of the existing facility is not
intended to draw add tional traffic beyond that anticipated with the
specific plan.

n that the off-street parking lot will be provided in the park and
hat three of the roads bordering the property will be widened and
mp oved to include on-street parking, that the building addition
wil not expand the seating capacity of the Hamburger Factory, and
tha the outdoor dining patio was included in the original park
mas er plan and specific plan.
That the site is suitable for the type and intensity of use or
development which is proposed, in that the building addition is
located in the active section of the park near the ' 1 zones.
Tha there will not be significant harmful effects upon
tal quality and natural in that proposed
mit gation measures and project design modifications will mitigate
tha impacts to a level of insignificance.
That there are not other relevant negative impacts of the proposed
use that cannot be mitigated.
That the proposed use will not adversely affect the City of Poway
Gen ral Plan for future and well as resent development in that the
des gn, style, and location of he building addition is in
con ormance with Specific Plan 89-0 which is with the
goa s and strategies of the General lan.
Section 3: Cit Council
The City Council hereby approves Conditional Use Permit 89-10(M) subject
to the following condition:
Within 30 days of approval the applicant shall submit in writing
that all conditions of approval have been read and understood.
