WHEREAS, Variance 92-0 and Development Review 92-01 submitted by Pa kway
Busines Centre Partners, L d., applicant, requests construction of a 5 ,078
square o t warehouse on Lo 14 and a portion of Lot 15 n Parkway Bus ness
Centre e ween South Poway xpressway and Danielson Stree in the LI ( ight
Industr a ) Land Use Designa ion. Variances are requested o allow observance
of a 35 oot setback on South Poway Expressway, where a 0 foot setback is
required and to permit a 15 foot high crib wall where a 12 foot high wall is the
maximum permitted by the development standards; and
WHEREAS, on August 4, 1992, the City Council held a public hearing on the
above referenced items.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Sec :
The City Council finds that the potential tal impacts of
evelopment Review 92-01 were adequately discussed in the 1985 EIR and the
988 Subsequent EIR for the South Poway Planned Community (SPPC}.
ariance 92-07 is categorically exempt from tal review as it
nvolves minor alterations to land use limitations (Class 5).
Variance 92-07
That g anting the variance or its modification will not be
incompa ible with the City of Poway General Plan because the
propose structure meets all applicable development and design
standar s.
That ' re are special circumstances applicable to the property
(size pe, topography, location, or surroundings) or the intended
u e of he property, and because of this, the strict application of
t e Zon ng Ordinance deprives the property of privileges enjoyed by
o her properties in the vicinity under identical zoning
c assification.
The special circumstances include the fact that the building pad is
from 18 to 20 feet below the grade of South Poway Expressway which
decreases the n ed for a large setback and makes this deviation less
noticeable. T ere is also a three - four foot high berm which
screens views nto the subject and the visual impact of
siting the bui ding closer to the roadway.
e
That granting the variance or its modification is necessary for the
preservation and enjoyment of a substantial property right possessed
by other property in the same vicinity and zone and denied to the
Resolution No. P- 92-38
Page 2
pro eft for w ich the variance is sought; in that
pro er+ s are eveloped with similar large stor ge and distributio~
fac li s. W tho t the approval of the it would be
dif ic for t is arge building to meet the esign standards of
the pa The sub ect lot has two front yar s. the
setback on South Po ay Expressway allows an increased fron yard
area on Danielson which allows the applicant the flexibil ty to
provide offsets and variation in the building facade per estab ished
Development Standards.
That granting the va iance or its modification will not be
~a~er!ally detrimental o the public health, safety, or welfare or
to the proper y or imp in such vicinity and one
in which the property s located; because the g ade differen ial
will minimize the visibility of this deviat on from set ack
standards and the 15 foot crib wall will be fu ly landscape to
create an attractive backdrop for the industrial uilding.
The ranting of this variance does not constitute a special
p ivi ege inconsistent with the limitations upon other properties in
t e v cinity and zone in which such property is situated; because
t is s one of the few lots where grading design has blocked views
o the building pad from South Poway Expressway.
The granting of this variance does not allow a use or ctivity which
is not otherwise expressly authorized by the Zon ng Ordinance
governing the parcel of property; in that storage an distribution
facilities are permitted uses in the L1 Land Use Des gnation.
-01
The proposed structure will be consistent with the existing specific
plan and general plan in that it is designed for light industrial
use which is with the Land Use Designation shown in the
South Poway Specific Plan.
The proposed development will not have an adverse aesthetic, health,
safet , or architecturally related impact upon adjoining properties,
becau e the building has been designed in accordance with the area-
wide evelopment plan and because the project incorporates varied
archi ectural details, adequate landscaping, and appropriate
screening for loading areas and doors.
The proposed development is in compliance with the South Poway
Development Standards and the South Poway Planned Community
Development Plan an all amendments thereto.
The roposed development encourages the orderly and h
appe rance of and property within the City through its
cons stency with the SPPC plan which provides high standards for
deve opment throughout the 2500 acre planned community.
