WHEREAS, Development Review 92-09, submitted by Dominy-Cecil Associates,
applicant and Retirement Enterprises, Inc, owner, requests approval for
construction of a 53,000 square foot medical office on a 3.36 acre site located
at 12750 Gateway Park Drive, in the CO (Commercial Office) zone; and
WHEREAS, on September 8, 1992, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con, relative
to this application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
The City Council finds that the Negative Declaration previously approved
for Variance 89-19 and Development Review 89-31 {which expired on January
16, 1992) adequately addressed the potential the potential impacts of this
project.
Section 2:
The proposed development is in conformance with the Poway General
Plan, in that the General Plan designates the site for ' 1
office development and the proposed project is a medical office
building.
That the proposed development will not have an adverse aesthetic,
health, safety, or architecturally related impact upon adjoining
properties, in that the proposed buildings are architecturally
compatible with surrounding ' 1 developments, and will be
buffered from adjacent residential development.

Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
issuance of building permits.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit

Trash receptacle shall be enclosed by a six foot high masonry wall with
view-obstructing gates pursuant to City standards. Location shall be
subject to approval by the Planning Services Department.
A decorative masonry wall and a five foot wide raised planter shall be
provided between the project and residentially oned property to the north
as required by Municipal Code Section 17.10.10. The wall sh ll have a
minimum of eight feet except where the appl cant can demons ~ate that
djac nt residentially zoned property is four eet higher than t e subject
ot, n which case the wall may be reduced to six feet in he ght. The

The lease space area within the building shall be limited to 47,360 square
feet. Future tenant improvements which cause office space to encroach
into the hallways and lobby areas shown on the approved plans shall be
prohibited.

Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit '

This approval shall become null and void if building permits are not
issued for this project within two years from the date of project
approval.
All parking lot landscaping shall consist of a minimum of one 15 gallon
size tree for every three spaces. For parking lot islands, a minimum 12
inch wide walk adjacent to parking stalls shall be provided and be
separated from vehicular areas by a six inch high, six inch wide portland
concrete cement curbing.
Parking lot lights shall be low pressure sodium and have a maximum height
of 18 feet from the finished grade of the parking surface and be directed
away from all property lines, adjacent streets and residences.
All two-way traffic aisles shall be a minimum of 25 feet wide and
emergency access shall be provided, maintained free and clear, a minimum
of 24 feet wide at all times during construction in accordance with Safety
Services Department req
All parking spaces shall be double striped.
A detailed landscape and irrigation plan shall be submitted to and
approved by the Public Services Department and Planning Services
Department prior to the issuance of building permits.
2. All landscaped areas shall be maintained in a healthy and thriving
condition, free from weeds, trash, and debris.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.

CONPLIANCE WITH THE FOLLOWING CONDXTIONS:
GRADING
Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
A soils report shall be prepared by a qualified engineer licensed by the
State of California to perform such work at first submittal of grading
plan.
3. A geological report shall be prepared by a qualified engineer or geologist
and submitted at the time of application for grading plan check.

A pre-blast survey of surrounding property shall be conducted to the
satisfaction of the City Engineer prior to any rock blasting. Seismic
recordings shall be taken for all blasting and blasting shall occur only
at locations and levels approved by the City Engineer.

Prior to any work being performed in the public right-of-way, an
encroachment permit shall be obtained from the Engineering Services
department and appropriate fees paid, in addition to any other permits
required.

Director of Engineering Services and in accordance with standard
engineering practices.

The Master Plan of Drainage Fee shall be paid at the established rate in
accordance with the Drainage Ordinance prior to building permit
~ flows across and/or sidewalks shall not be
permitted.
All proposed utilities within the project shall be installed underground
including existing utilities less than 34.5 KV along Circulation Element
roads and/or highways.
Utility easements shall be provided to the specification of the serving
utility companies and the Director of Engineering Services.
The developer shall be responsible for the relocation and undergrounding
of existing public utilities as required.
Water, sewer, and fire protection systems plans shall be designed and
constructed to meet requirements of the City of Poway and the County of
San Diego Department of Health.
A looped water system shall be constructed north-south through the west
side of parcel from north side on-site main to Gateway P rk Drive to
pr vide needed on-site fire hydrant(s), fire sprinkler serv ce and water
me er service. If sewer extension on-site is to be ei inches as
in icated at Gateway Park Drive, it shall be a main exten n with main
ho e.
Prior to acceptance of property for sewer service, annexation to the sewer
improvement area shall occur.
The applicant shall pay for a water system analysis to establish the
proper size and location for the public water system. The amount will be
determined by the cost of the analysis and shall be paid upon demand by
the City.
The ap licant shall, within 30 days after receiving approval of the
develo ment review apply for a Letter of Availability {LOA) to reserve
sewera e availability an post with the City, a nonrefundable reservation
fee eq al to 20 percent of the appropriate sewerage connection fee in
effect at the time the LOA is issued.
All new public utility lines, i.e., water, sewer, and drainage shall have
an easement, a minimum of 20 feet wide for each line, dedicated to the
City prior to issuance of a certificate of occupancy.

Elevators shall be sized to accommodate emergency personnel and hospital
gurney.
Two new fire hydrants to be installed, one at the driveway entrance on
Gateway Park Drive and one along the fire lane north side of the building.
Building address with a minimum o ix inches shall be displayed on the
street facing side of the bui d ng and on the roof in a manner
satisfactory to the Director of Sa e y Services. Minimum size of building
numbers is six inches on facade o uilding.
A knox security box to be placed on the building prior to occupancy -
Model 4400 with tamper switch.
An automatic fire sprinkler system shall be installed in the building.
Post indicator valve nd Fire Department connection to be located by the
City Fire Marshal. , e post indicator valve shall have a tamper switch
and knox lock instal ed. The entire system shall be monitored by an
approved central moni oring agency.

Designated fire lanes shall be provided and approved by the Fire Marshal.
Appropriate markings and signs, as specified by the Department of Safety
Services are required.
Material Safety Data Sheets (MSDS) shall be provided by each occupant, for
any hazardous materials and/or toxic substances used in the building.
Installation of any nitrous oxide systems shall meet current Uniform Fire
Code requirements.
Provide automobile barrier along the top of the slope, east side of the
building, to prevent cars/trucks from The Gateway above of creating an
accident by driving over the edge and doing damage to the building.
