P-92-52 ES UT O' F T IT 0 N L 0 T C T F P A' APPROVT.G 0 IT N S E T 92-02 AS ES ' L M E ~ - -55 WHEREAS, Minor Conditional Use Permit g2-02, submitted by Richard Woodaman, applicant, requests approval to operate four indoor batting cages within an existing building located at 12845 Poway Road, in the Commercial General zone; and WHEREAS, on October 6, 1992, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application NOW, THEREFORE, the City Council does hereby resolve as follows: The City Council finds that the project will not have a significant adverse impact on the t and hereby issues a Negative Declaration. The proposed project will be consistent with the existing general plan. The proposed location, size, design, and operating characteristics of the proposed use are in accord with the title and purpose of this resolution, the purpose of the land use designation in which the site is located and the Poway General Plan. That the location, size, design, and operating characteristics of the roposed use will be compatible with and will not adversely affe t or be materially detrimental to adjacent uses, residents, bull ings, structures, or natural in that the use will be loca ed within an existing industrial building. That the harmony in scale, bulk, coverage, and density is with adjacent uses, because the use will be located existing building. within an That there are available public facilities, because the use will be located in an existing and utilities, · 1 building. That there will not be a harmful effect upon desirable neighborhood characteristics, in that the use will be located inside a building. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Circulation Element, in that the use will operate within a 1 center where existing street improvements and off-street parking are adequate. That there will not be significant harmful effects upon tal quality and natural in that the use will be contained within an existing building on a fully developed site. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. The City Council hereby approves Minor Conditional subject to the following conditions: Use Permit 92-02 Within 30 days of approval: (1} The applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding light industrial uses. APPLXCANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVXCES REGARDING COHPL]ANC£ ~ZTH THE FOLLOgXN6 COND]TZONS: The Planning Services Depa tment shall conduct an annual review of Minor Conditional Use Permit 9 -02 for com liance with the conditions of approval. If the departmen has receive complaints, or the use is not in compliance, the review wi i be forwar ed to the Council, who may add conditions to the permit or amend exist ng conditions of approval. In the event noise emanating from the use ecomes a nuisance to the adjacent tenants (the City receives complaints , the applicant hall have a noise study promptly prepared. The Plannin Services Depar ment will determine whether the project complies with ity Noise Stan ards. If noise mitigation is found necessary, the applicant shall comp y. The applicant shall obtain a business license from the Customer Services Department prior to t of business activity. The applicant shall obtain an approved temporary use permit for any on- site outdoor promotional events. 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Resolution No. P-92-52 Page 3 Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. 4. Disabled access must be provided throughout the facility for both employees and 5. If the number of employees on duty exceeds four, separate sanitary facilities shall be provided for each sex. )IGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COHPLIANCE WITH THE FOLLOWING CONDITIONS: Building/new suite is to have new fire sprinkler system installed. Minimum one hour wall construction on interior walls of new suite. 3. Provide a key for suite for "Knox Box". The minor conditional use permit shall lapse and shall become void October 6, 1994 if the site has not been occupied in accordance with the conditional use.
