WHEREAS, Variance 92-13 and Development Review 92-11, submi ted
PizzaMakers, Ltd., applicant, for the purpose of constructing a restauran on t ~
northwest corner of the Poway Road and Oak Knoll Drive intersection in t e Ci y
of Poway, County of San Diego, State of California came before the City ounc 1
for public hearing and action on November 17, 1992; and
WHEREAS, the City finds that the proposed development, as d signed, i n t
onsistent with the Poway General Plan Goal II, Policy B, Stra egy 20 o t e
ommunity Development Element and Sections 17.50.070 and 17.5 .010.B o t e
unicipal Code in that the proposed ' 1 project is de ermined o e
ncompatible with the surrounding residential land uses as follows:
The proposed development is incompatible with adjacent residential uses
without additional buffering and compliance with setbacks (Strategy 20}.
There are no special circumstances applicable to the property justifying
variance from setback requirements (Poway Municipal Code Section
17.50.070.A).
Granting of the variance would be materially detrimental to nearby
properties by allowing on-site parking closer to said properties and
encouraging on-street parking (Sections 17.50.070.C, 17.52.010.B(5)).

Granting of the variance will be incompatible with Strategy 20 of the
General Plan by allowing contiguous incompatible land uses without
adequate buffering and setback of parking (Sections 17.50.070.F,
17.52.010.B(6)).
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby deny
Variance 92-13 and Development Review 92-11.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 8th day of December, 1992.
