ER 317- 01- , 31 WHEREAS, Conditional Use Permit 92-11, submitted by Pete McConahay, applicant, requests approval to operate a pawn shop within the existing 1 center located at 13168 Poway Road in the CG zone; and WHEREAS, on January 12, lgg3, the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section ] : The City Council finds that this project is categorically exempt Class 1 from the California E tal Quality Act in that the project involves interior or exterior alterations to such things as plumbing and partitions within an existing ' 1 building. Section 2: Fil : The proposed project will be with the existing general plan in that the proposed project is located in the Commercial General zone which permits pawn shops subject to issuance of a conditional use permit. That the location, size, design, and operating characteristics of the pro osed use will be compatible with and will not adversely affect r be materially detrimental to adjacent ' 1 uses, residen s, building , structures, or natural The propose business wi be located in a center with o her retail and service uses and t applicant will be require to obtain a secondhand dealers icense in order to assure tha the business operates in a lawful manner. That the scale, bulk, coverage, and density is consistent with adjacent uses, in that the pawn shop will be located in an existing center and no expansion or exterior alteration to the building is proposed. That there are available public facilities, and utilities to serve the proposed use as all facilities and services can be provided for through the proposed conditions of approval. That there will not be a harmful effect upon desirable neighborhood characteristics, in that the physical separation between residential and ' 1 uses will be adequate. Resolution No. P-93-03 Page 2 That the generation of traffic will not adversely impact the surrounding stree s and/or the City's Circulation Element in that the proposed reta 1 use is not anticipated to cause a significant increase in traff c and the center has adequate parking spaces for this establishmen . 7. That the site is suitable for the type and intensity of use and development proposed as no increase in ' is proposed beyond that which already exists on the site. 8. That there will not be significant harmful effects upon the tal quality and natural due to the minor nature of the changes proposed. That there are not other relevant negative impacts of the proposed use that cannot be mitigated. 10. That the impacts, as described above, and the location of the proposed use will not adversely affect the City of Poway General Plan for future as well as present development. sion: The City Council hereby approves Conditional Use Permit 92-11 subject to the following conditions: Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. o The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and ' 1 uses. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING CONPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. o Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit ' The property owner shall comply with all applicable standards for disabled access. 4. The applicant shall obtain a secondhand dealers license as described in Section 5.32.040 of the City of Poway Municipal Code. SIGNS Resolution No. P- 93-03 Page 3 The unmaintained landscape strip shown on Attachment 4 of the staff report dated January 12, lgg3 shall be replanted with ground cover, shrubs, and trees per City of Poway Landscape Standards by the property owner. Landscape and irrigation plans shall be approved by the Department of Planning Services prior to issuance of permits for the tenant improvement. Installation must be complete prior to occupancy. Prior to any use of the project site or business activity being commenced thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. Any permanent or temporary signs proposed for shall be designed and approved in conformance with the Sign Ordinance. The applicant shall submit a sign application to the Planning Services Department prior to the installation of any sign. The conditional use ermit shall be submitted to annual review by the Director of Plannin Services for compliance with the conditions of approval and to addr ss concerns that may have occurred during the past year. If the permit s not in compliance with the conditions of approval, or if the Planning Services Department has received complaints, the required annual review shall be set for a public hearing before the City Council to consider modification or revocation of the use permit. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: The applicant shall submit plans for tenant improvements to the Safety Services Department for review. The applicant shall apply for a business certificate prior to opening the shop. 3. Fire clearance shall be obtained. 4. The store shall display an address at least six inches in height and easily seen.
