P- 93-18 A RE OL ION OF TH CITY U IL OF T E TY F POW Y, APPROVING REIN TA MEN OF C UNTY U RMIT P77-71 AN D ELO MENT EVIEW ASSES OR'$ PA CEL N .BER 2 3-8 -09 WHEREAS, Re nstatement of County Use Permit P77-71M and Development Review 93-02, submitted y St. John of Damascus Orthodox Church, applicant, requests approval for of a new 3,870 square foot and additional parking lot at 16 03 Espola Road in the RR-C zone; and WHEREAS, on April 20, 1993 the City Council held a hearing on the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E : The Negative Declaration issued on August 28, 1990 adequately addressed the potential impacts of this project and no further tal review is S: se Peri 7-71M That the location, size, design, and operating characteristics of the proposed use will be compatible with and will not adv rs ly affect or be materially d 1 to adjacent uses, resi en s, buildings, st or natural The churc as operated at this location for years in a manner compatible wi h he surrounding residential neighborhood. Existing church uses adjoin the site on the east and west. The new sanctuary is separated from nearby residential development by existing church buildings and streets. That the scale, bulk, coverage, and density is consistent with adjacent uses, in that all development standard of the Zoning Ordinance have been met. The project will meet the applicable property development standards for off-street parking, setbacks, lot coverage, and building height. o That there are available public facilities, and utilities to serve the proposed use in that two EDUs of sewer capacity have been allocated to the project and all facilities and services can be provided for through the conditions of approval. That there will not be a harmful effect upon desirable neighborhood characteristics, in that the physical separation between residential and church uses will be adequate. lhat the generation of traffic will not adversely impact the surrounding streets and/or the City's Transportation Master Element Resolution No. p-93-18 Page 2 in that a of approval will require the payment of Traffic Mitigation Fees and the construction of an expanded off-street parking lot for church services and activities. The proposed development encourages the orderly and h appearance of structures and property within the City because it complies with the design guidelines of the General Plan. Secti( n: The City Council hereby approves Reinstatement of County Use Permit 77-71M and Development Review 93-02 subject to the following conditions: Within 30 days of approval {1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2} the property owner shall execute a Covenant on Real Property. All conditions contained in City Council Resolution P-90-64 are reinstated except as modified herein. Resolution No. P-93-18 Page 3 This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and semi-public uses. o This conditio al use permit shall be subject to annual review bythe Director of Panning Services for compliance with the conditions of approval and o address concerns that may have occurred during the past year. I the permit is not in compliance with the conditions of approval, or the Planning Services Department has received complaints, the required annual review shall be set for a public hearing before the City Council, to consider modification or revocation of the use permit. CONPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE APPROVED BY THE OEPARTMENTS OF PLANNING ANO ENGINEERING SERVICES. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Prior to issuance of building permits for the main sanctuary the applicant shall: Install driveway on Old Espola Road along with storm drain system, curb, gutter, and sidewalk from south side of driveway to northwesterly terminus. b. The project grading may omit the parking area delineated on Attachment C of the staff report dated April 20, 1993.
