HEREAS, Conditional Use Permit 93-01 and Development Review 93--1,

WHEREAS, on April 27, 1993, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
The potential impacts of the proposed use were addressed by the previously
Certified Final EIR and Final Subsequent EIR for the South Poway Planned
Community.
These documents assumed that limited amounts of hazardous materials would
be stored in the business park in with manufacturing and
research uses. Potential impacts of such uses were again reviewed w' n
the specific plan was amended in 1989. A Negative Declaration w h
mitigation measures was issued at that time. The potential impacts of e
proposed ' 1 pest control service were adequately addressed by e
referenced documents.

specific plan which designates this site for industrial uses.
The proposed location, size, design, and operating characteristics
of the proposed use are in accord with the title and purpose of this
resol tion, the purpose of and land use designation in which the
site s located, and the Poway General Plan and the South Poway
Speci ic Plan; in that distribution and contracting service
activ ties were anticipated uses within the South Poway Specific
Plan area.
That the location, size, design, and operating characteristics of
the proposed use will be compatible with and will not adversely

scale of the proposed ac ivi y does not exceed assumptions made when
traffic impacts for the bus ness park as a whole were reviewed.
That the site is suitable for the type and intensity of designated
use which is proposed, in that it is in an area designated for light
industrial use.
That there will not be significant harmfu effects upon
tal quality and natural in tha the use will be

The proposed project will be consistent with the existing specific
plan and general plan in that it is an industrial building located
on a site designed for Light Industrial (LI) use.
The proposed development will not have an adverse aesthetic, health,
safety, or architecturally related impact upon adjoining properties,
because the building has been designed in accordance with the area-
wide development plan and because the project will incorporate
adequate landscaping, parking, and appropriate screening for truck
parking areas.

The proposed development is in compliance with the South Poway
Development Standards and the South Poway Planned Community
Development Plan and all amendments thereto.

The roposed development encourages the orderly and h
appe rance of structures and property within the City through its
cons stency with the SPPC plan which provides high standards for
dev, opment throughout the 2500 acre planned community.
Section 3: :
The City Council hereby approves Conditional Use Permit g3-01 and
Development Review g3-o! subject to the following conditions:
Within 30 days of approval (1) the applicant shall submit in writing
that all conditions of approval have been read and understood; and
{2) the property owner shall execute a Covenant on Real Property.
The use conditionally granted by this permit shall not be conducted
in such a manner as to interfere with the reasonable use and
enjoyment of surrounding light industrial uses.

This conditio al use permit shall be subject to annual review by the
Director of Panning Services for compliance with the conditions of
approval and o address concerns that may have occurred during the
past year. I the permit is not in compliance with the conditions
of approval, or the Planning Services Department has received
complaints, the required annual review shall be set for a public
hearing, before the City Council, to consider modification or
of the use permit.

The applicant shall obtain a business license from the Customer
Services Department prior to L of business activity.

Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.

the South Poway Development Standards, the Zoning Ordinance, and all other
~pplicable City Ordinances in effect at the time of building permit

The tilt-up concrete fence shall be continued around the northeast corner
of the parking lot as shown on Attachment F of the staff report dated
April 27, 1993.
The design and materials used for the awning at the back of the building
must be ap roved by the Director of Planning Services prior to issuance of
building ermits. If a metal awning is proposed, material samples shall
be provid d to verify that it is not sheet or corrugated metal which is
restricte by the Development Standards (Volume II, page 63, 1.b).
All rooftop must be screened from view, either by parapet walls
or by roof screens. Prior to issuance of building permits, plans must be
prepared which clearly show all proposed rooftop equipment and screening
elements.
Additional color, texture, or architectural details shall be proposed for
the building exterior prior to approval of building permits.
Design and location of the trash enclosures shall satisfy the
of the Planning Services Department. Trash enclosure walls
may be tilt-up panels to match the building or split face block.
Enclosure shall have solid gates.
The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit '
10. This approval shall become null and void if building permits are not
issued for this project by April 27, 1995.
PARKING AND VEHICULAR ACCESS
All parking lot landscaping shall include a minimum of one 5 gallon size
tree for every three spaces. For parking lot islands, a m nimum 12 inch
wide walk adjacent to parking stalls shall be provided an be separated
from vehicular areas by a six inch high, six inch wide por land concrete
cement curb.
Parking lot lights shall be low pressure sodium and have a maximum height
of 25 feet from the finished grade of the parking surface and be directed
away from all property lines, adjacent streets and buildings on adjacent
lots.
All two-way traffic aisles shall be a minimum of 25 feet wide. A minimum

LANDSCAPING
A detailed landscape and irrigation plan shall be submitted to and
approved by the Planning Services ~ prior to the issuance of
building permits. The landscape plan shall include trees and shrubs to
screen the truck parking and loading areas at the back of the lot.
All landscaped areas shall be maintained in a healthy and thriving
condition, free from weeds, trash, and debris.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.

GRADING
Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
A soils report shall be prepared by a qualified engineer licensed by the
State of California to perform such work at first submittal of a
grading/private improvement plan.
The grading/private improvement plan, prepared on a standard size sheet,
at 20 scale by a registered civil engineer shall be subject to review and
approval by the Planning Services and Engineering Services Departments and
shall be completed prior to issuance of a grading permit.
A pre-blast survey of surrounding property shall be conducted to the
satisfaction of the City Engineer prior to any rock blasting. Seismic
recordings shall be taken for all blasting and blasting shall occur only
at locations and levels approved by the City Engineer.
5. All new slopes shall be a minimum of 2:1 (horizontal to vertical).
6. A final compaction report shall be submitted and approved prior to
issuance of building permits.
Site grading shall be certified by the project civil engineer prior to
issuance of building permits.
STREETS AND SIDEWALKS
All parking lot structural sections shall be submitted to and approved by
the Director of Engineering Services. Pavement sections shall conform to
the minimum required by the Poway Municipal Code Section 12.20.080.

constructed prior to occupancy to the satisfaction of the Director of

All damaged off-site public works facilities, including parkway trees,
shall be repaired or replaced prior to exoneration of bonds and
improvements, to the satisfaction of the Department of Engineering
Services.
Prior to any work being performed in the public right-of-way, an
encroachment permit shall be obtained from the Engineering Services
Department and appropriate fees paid, in addition to any other permits
required.
Driveways shall have a minimum width of 30 feet and shall be designed as
an alley apron with ten foot minimum radius. Where driveways are adjacent
to sidewalks, pedestrian ramps shall be required.

UTILITIES
1. All proposed utilities within the project shall be installed underground.
Utility easements shall be provided to the specification of the serving
utility companies and the Director of Engineering Services.
3. The developer shall be responsible for the relocation and undergrounding
of existing public utilities as required.

Water, sewer, and fire protection systems plans shall be designed and
constructed to meet requirements of the City of Poway and the County of
San Diego Department of Health.
The applicant shall pay for a water system analysis to establish the
proper size and location for the public water system. The amount will be
determined by the cost of the analysis and shall be paid upon demand by
the City.
Existing telephone, gas, electric, and all other public utilities and
app shall be shown on the grading/private plans.
All on-site water mains shall be public. A 20 foot easement shall be
dedicated to the City over public water mains prior to occupancy.

Prior to occupancy, the sewer and water systems serving the project shall
be installed to the satisfaction of the City Engineer.

Roof covering shall be fire retardant as per UBC Section 3203(e) and City
of Poway Ordinance No. 64.
The building shall display their numeric address in a manner visible from
the access street. Minimum size of the building numbers shall be 18
inches on the front facade of the building, street facing side. Building
address shall also be displayed on the roof in a manner satisfactory to
the Director of Safety Services.
Every building hereafter constructed shall be accessible to Fire
Department apparatus by way of access roadways with all-weather driving
surface of not less than 20 feet of unobstructed width, with adequate
roadway turning radius capable of supporting the imposed loads of fire
apparatus having a minimum of 13'6" of vertical clearance. The road
surface type shall be approved by the City Engineer, pursuant to the City
of Poway Municipal Code.
The building will 'e required to install an approved fire sprinkler
system. The build ng sprinkler system shall be designed to meet a
.33/3000 design dens ty at the roof. The entire system is to be monitored
by a central ~ company. System post indicator valve, with tamper
switch, also monitored, shall be located by the City Fire Marshal prior to
installation. Approximate locations will be at the driveway entrance from
Flint Place.

Two new fire hydrants are required, to meet a minimum design criteria of
2500 gallons per minute (GPM). The location of the hydrants shall be
determined by the City Fire Marshal. Approximate locations will be at
the driveway entrance from Flint Place and at an additional location a
maximum of 300 feet from the driveway entrance.

A 'Knox' Hazardous Materi 1 Data Storage and Key Cabinet, with weather
housing, shall be require for the building at a location determined by
the City Fire Marshal. "Knox" padlock shall be required for the fire
sprinkler system Post Ind cater Valve.
Fire Department access for use of fire fighting equipment shall be
provided to the immediate job site at the start of
construction and maintained at all times until construction is completed.
Permanent access roadways for fire apparatus shall be designated as 'Fire
Lanes' with appropriate signs and curb markings.
The applicant shall provide a detailed plan for all storage areas and a
complete inventory of all hazardous and toxic substances to be stored on
the site.

A hazardous materials business plan stall be filed with the County Health
Department and a copy provided to the Fire Department.
Should this subdivision be further divided, each final map shall be
submitted for approval by the Director of Engineering Services.
All p of the Subdivision Ordinance of the Poway Municipal Code
shall be met as they relate to the division of land.
Prior to occupancy, all dedications shall be made and easements granted as
required.
This a proval is based on the existing site conditions represented on the
propos d site plan and grading/private improvement plan. If the actual
condit ons vary from those representations, the site plan must be changed
to ref oct the actual conditions. Any substantial changes to the site
plan must be approved by the Directors of Planning Services and
Engineering Services and may require approval of the City Council.
