P-93-34 F TH CIT' C UNCIL F TH CI Y 0 POW Y, C LI RNIA AP ROVI G TA IVE ARt; M 93-05 ASSES OR'S A~ L ' MBE S 3~ -26 -09 AND 10 WHEREAS, Tentative Parcel Map 93-05, hereinaf er "Map" Chia-She Hou pplicant, for the purpose f subdividing real proper situated in the ~ ty o oway, County of San Diego, tate of California, descri ed as the westerly 13.5 eet and the easterly 171.~, feet of the westerly 385.-5 feet of that ort on o ot 3 in the northeast qua er of the southwest quarter of Section, T wnship 1 south, Range I West, San Bernardino Meridian into three lots, regu arly came before the City Council for public hearing and action on July 13, 19 3; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services report; and WHEREAS, the City Council has reviewed and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E : The City Council finds that the project will not have a significant adverse impact on the and hereby issues a negative declaration with of drainage and noise impacts. The City Council makes the following findings in regard to Tentative Parcel No. 93-05 and the Map thereof: The parcel is t with all applicable general and specific plans in that the proposed land use is Residential Single- Family 2 (1-2 du's/net acre) and the proposed lots are a minimum of one-half acre in size. The design or improvement of the parcel map is with all applicable general and specific plans in that it provides for three single-family home sites. Co The site is physically suitable for the type of development proposed in that it is level, and within the urbanized area of the City. The site is physically suitable for the density of the development proposed in that three one-half acre parcels are proposed where surrounding parcels are of like size. The design of the subdivision is not likely to cause substantial tal damage and avoidable injury to humans and wildlife or Resolution No. P- 93-34 Page 2 their habitat in that no known rare or endangered species exist on the site. Section 3: Ci Council Decision: The City Council hereby approves Tentative Parcel Map 93-05 subject to the following conditions: Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. APPLICANT SHALL CONTACT THE DEPARTHENT OF PLANNING SERVICES REGARDING COHPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPHENT Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit ' Prior to any use of the project site or business activity being commenced thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. PARKING AND VEHICULAR ACCESS All driveways shall conform to City of Poway specifications. -- Resolution No. P-93-34 Page 3 LANDSCAPING Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway ordinance and shall be planted at an average of every 30 feet on interior streets and 20 feet on exterior streets. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. ADD Development review or minor development review shall be accomplished proper to the issuance of a building permit. The applicant shall or post sufficient to a noise wall of matching size and materials as the City- constructed wall immediately adjacent to the east and running the complete length of the north property line. APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVICES REGARDING COHPLIANCE WITH THE FOLLOWING CONDITIONS: GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading p o The grading plan shall contain a certificate signed by a registered civil engineer that the grading plan has preserved a minimum of 100 square feet of solar access or each dwelling unit and for each future building site within the subdivision. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work at first submittal of a grading plan. A geological report shall be prepared by a qualified engineer or geologist and submitted at the time of application for grading plan check. The final grading plan, prepared on a standard size she t, shall be ubj ct to review and approval by the Planning Services an Engineering erv ces Departments and shall be completed prior to recor ation of the ina subdivision map or issuance of building permits, wh chever comes irs . 6. If required, a pre-blast survey of surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting. Resolution No. P-93-34 Page 4 Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. All residents within 500 feet shall be notified 24 hours prior to any blasting. Chancellor Way, within a 60 foot right-of-way, from the westerly terminus of the existing improved portion of the street fronting the applicant's property to Adah Lane shall be improved with 20 feet of pavement, (Portland cement concrete to match existing street) per San Diego Regional Standard Drawing G-J8, 5-1/2 inches thick {minimum). The a licant shall dedicate to the City for street rights-of-way of Chanc ilor Way and Adah Lane to the City. Right-of-way widths are 60 feet for C ancellor Way and 30 feet for Adah Lane. Dedication which shall be rejec ed shall be made on the parcel map. Street striping and signing where necessary shall be installed to the satisfaction of the Director of E . treet improvement plans prepared on standard size sheets by a Registered ivil Engineer shall be submitted for approval by the Director of ngineering Services. Plan check and inspection expenses shall be paid by he developer. All exterior street improvements shall be constructed prior to issuance of building permits, to the satisfaction of the Director of Engineering Services. All damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to of bonds and improvements, to the satisfaction of the Department of Engineering Services. Prior to any work being performed in the public right-of-way, a right-of- way permit shall be obtained from the Engineering Services Department and appropriate fees paid, in addition to any other permits required. The developer shall pay the Traffic Mitigation Fee at the established rate at the date of final building inspection or the date the certificate of occupancy is issued, whichever occurs later. However, a security deposit must be posted prior to parcel map approval. __ Resolution No. P-93-34 Page 5 DRAINAGE AND FLOOD CONTROL , o The proposed project falls within areas indicated as subject to flooding under the National Flood Program and is subject to the p of that program and City Ordinance. *2. A drainage system capable of handling and disposing of all surface w ter originating within the subdivision, and all surface aters that may low onto the subdivision from adjacent lands, shall e required, aid drainage system shall include any and as require by the Director of Engineering Services to properly ban le the drainage. The Master Plan of Drainage Fee shall be paid at the established rate in accordance with the Drainage Ordinance at the date of final building inspection or at the date the certificate of occupancy is issued, whichever occurs later. The westerly segment of the above-mentioned channel north of Parcel 1 shall be reconstructed to make a more direct alignment to the existing 2- 18" diameter pipe in Adah Lane. Said 2-18" diameter pipe must also be analyzed by the applicant's engineer and a copy thereof must be submitted to the City for review to check in the design adequacy. Should it be found inadequate, construction of new drainage devices are necessary. UTILITIES All proposed utilities within the project shall be installed underground including existing utilities along Circulation Element roads and/or highways less than 34.5 KV. Utility easements shall be provided to the specification of the serving utility companies and the Director of Engineering Services. Should this subdivision be further divided, each final map shall be submitted for approval by the Director of Engineering Services. The tentative map approval shall expire two years from approval date unless an application for time extension is received 90 days prior to expiration in accordance with the City's Subdivision Ordinance.
