from adjacent ' 1 property and fence elevations facing
residential property are only six feet in height and similar to many
existing fences in the neighborhood.
The granting of this variance does not constitute a special
privilege ' with the limitations u on other properties in
the vicinity and zone in which such propert' is situated, in that
unusual circumstances including the large rade differential and
proximity to ' 1 development set thi lot apart from other
similarly zoned properties.
The granti g of this variance does not allow a use or activity wh ch
is not ot erwise expressly authorized by the zoning regular on

Section 3: Cit Council
The City Council hereby approves Variance 93-12 subject to the following
conditions:
Within 30 days of approval (1) the applicant shall submit in writing
that all conditions of approval have been read and understood; and
(2) the property owner shall execute a Covenant on Real Property.
The strip of land at the base of the retaining wall shall be planted
with fast-growing drought tolerant shrubs capable of reaching a
hei ht of six to ten feet. Shrubs shall be spaced no further than
fiv feet on center and shall be watered by a permanent
sys em. Planting shall be completed within 30 days of'fence
ins allation.
