Res P-93-45 RESOLUTION NO. P- 93-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 93-5g WHEREAS, Temporary Use Permit 93-59, submitted by the Poway Days Committee, applicant, requests approval of the Poway Days events to be held at various locations throughout the City. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Pursuant to the procedures of the City of Poway, implementing the California E 1 Quality Act, the above-referenced project is lly exempt, Class 4e, in that the Poway Days events are temporary in nature and have negligible or no permanent effects on the Section 2: Fi : That the proposed use is in accordance with the purposes and standards of Section 17.26.020 of the Zoning Ordinance. Section 3: The City Council hereby approves Temporary Use Permit 93-59 subject to the following conditions: APPLICANT SHALL CONTACT THE COUNTY HEALTH DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONOITIONS: All food and drink operated for profit shall secure the necessary Health Department permit and State seller's permit. 2. Provide a list of food if applicable, prior to each event. 3. Inform all food to contact this department prior to opening. 4. Require waste water disposal from food units to acceptable sewer or holding tanks. 5. Request that non-profit food booths comply with same req · 1 booths. as o Inf rm all vendors using mobile units that heir vehicles must comply with Cal fornia Administrative Code, Title 17. pecifically, all doors must be sel -closing, service windows must be 21 square inches or less, and sba terproof guards are required for all 1 ght bulbs. Resolution No. P-93-45 Page 2 Vendors preparing food in temporary booths must provide floors, walls, and ceilings for the entire stand. APPLICANT SHALL CONTACT THE SHERIFF'S DEPARTMENT FOLLOWING CONOITIONS: COMPLIANCE WITH THE One or more identifiable members of the event shall be on-site at all times when the parking areas are in use to assist with security of parked vehicles, to aid in the movement of vehicles in and out of the lots, to provide information to motorists, and to minimize traffic on surface streets. All beverages shall be dispensed in paper cups -- no bottles or cans are allowed. The event shall designate an on-site location for police, fire, and paramedic units out of the main activity areas and maintain sufficient access for emergency vehicles at all times. All music activities shall be terminated on or before 12:30 a.m. on the day following the event, and at no time shall the noise level exceed the permissible decibel (dB) level for the area's zoning designation. The event shall have personnel designated at all times and at specified locations to provide liaison with representatives of the City's Fire and Sheriff's Departments. APPLICANT SHALL CONTACT THE WITH THE FOLLOWING CONDITIONS: OF SAFETY SERVICES COMPLIANCE 1. All fire hydrants shall remain clear of obstructions 25 feet in all directions. o The storage and removal of all trash material shall be provided so as not to constitute a fire hazard. 3. All materials used for decorative purposes shall be non-flammable. All electrical cords and manner. shall be utilized only in an approved APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONOITIONS: 1. Any necessary building or electrical permits shall be secured. In all unpaved parking areas, temporary markers shall be provided to delineate parking areas and aisles and to ensure that no parking occurs within 100 feet of any existing residential structure. __ Resolution No. P-93-45 Page 3 A minimum of two trash receptacles per acre of parking area or per single parking area, whichever is more restrictive, shall be provided. o All signs for the events must be approved by the Director of Planning Services prior to installation and shall be removed promptly, within ten days, following the event. The rep of the event shall meet with representatives of each of the City departments concerned at least one week prior to each event to ensure that all conditions of approval will be met. The sites shall be utilized in accordance with this resolution and the approved site plans on file in the Planning Department, except as may otherwise be provided herein, prior to t of the activity. Provision for temporary electrical power will require an electrical permit and an approval by the Building Inspection Division. The applicant shall obtain an bond indemnifying the City from possible liability in an amount not less than $1 million for events which utilize City property. o Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable City ordinances presently in effect. 10. The event sites shall be left free of debris, litter, or any other evidence of the temporary use upon completion of the use. The following conditions shall be applicable to the Poway Day's Rodeo Bar-B-Que to be held at the Poway Valley Riders' A arena: 1. One chemical restroom per 200 visitors expected shall be provided. A copy of the Alcoholic Beverage Control license for "Beer Sale Only" shall be provided no later than September 17, 1993. o A copy of the agreement with the adjacent property owner(s) for parking rights shall be provided no later than September 17, 1993. The following conditions shall be applicable to the Poway Days' Parade to be held on September 18, 1993 and beginning at Pomerado and Poway Roads, and ending at the intersection of Poway and Bowron Roads: The westbound lanes of Poway Road shall be kept open for emergency vehicles. Street ' along the parade route will be kept clear of spectators for emergency traffic. 2. The Chamber of Commerce, sponsor of the parade, shall place all necessary barricades and cones along the parade and detour routes. Resolution No. P-93-45 Page 4 The following conditions shall apply to the Poway Day's fireworks display to be on Saturday, September 18, from South Poway Sports Park. Extra security shall be provided for crowd control purposes and to maintain a "clear zone" where no spectators of authorized persons will be allowed around the firing site The applicants shall obtain of the adjacent property owner for parking rights if and a copy of that agreement shall be provided to the Planning Services Department no later than September 10. The area shall be kept free of debris, litter, or any other evidence of the temporary use upon completion of the use. The following conditions shall apply to the Poway Days' Rodeo and dance to be held on October 1 and 2 at the Poway Valley Riders' A arena: 1. One chemical restroom per 200 visitors expected shall be provided. A temporary "NO PARKING - TOW-AWAY ZONE" shall be established on the west side of Tierra Bonita Road from Donart Drive north to Poway Valley Road, to provide a wider pedestrian walking area into and out of the PVRA grounds, and to ensure sufficient access for emergency vehicles -- fire, paramedic, and law enf "NO PARKING" signs shall be placed along this area approximately 250 feet on center. The rodeo shall designate an on-site location for police, fire, and paramedic units out of the main activity areas and adjacent to the south vehicle gate of the PVRA property. All music activities shall be terminated on or before 12:30 a.m. October 2 and 3, 1993, and at no time shall be noise level exceed the permissible decibel (dB) level for the areas zoning d i.e., RR-A and RR-C zone. 7:00 a.m. - 10:00 p.m. 10:00 p.m. - 7:00 a.m. 50dB 40dB A waiver of Poway Municipal Code Section 5.12.110 is granted to allow the sale of alcoholic beverages and the attendance of minors at the dance following the rodeo performance on Friday, October I and Saturday, October 2 between the hours of 9:00 p.m. and 12:30 a.m. A copy of the Alcoholic Beverage Control license for "Beer Sale Only" shall be provided no later than September 29, 1993. The rodeo grounds shall be patrolled by uniformed private security guards (a minimum of two private security guards) to assist with crowd control inside the rodeo area during hours of operation, and by members of rodeo and dance committee to maintain security of equipment and control of personnel remaining/residing on property after hours of operation. o The Poway Valley Riders Association shall areas during hours of operation. A fire inspection will be conducted the day before the rodeo opening. 13. A copy of agreement with the adjacent property owner{s) for parking rights shall be provided no later than September 29, 1993.
