NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: 1 Findin( : The City Council finds that the previously approved negative declaration addresses all the potential tal impacts associated with this property. Section 2: CONDITIONAL USE PERMIT 91-05M 1. The proposed project will be t with the General Plan. That the location, size, design, and operating ch tics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residences, buildings, , or natural in that the board and care use has been in for three years at that site. o That the scale, bulk, coverage and density is consistent with the adjacent uses in that it is an elderly residential care home and the vehicular traffic is minimal in relation to the number of people that reside there. That there are available public facilities, to serve the site. and utilities That there will not be harmful effect upon desirable neighborhood ch in that the board and care facility has been in operation the past three years without complaints. That the generation of traffic will not adversely affect the surrounding streets and/or the City's Circulation Element in that the amount of vehicular traffic is not substantial because the Resolution No. P-93-46 Page 2 elderly boarders will not be keeping a personal vehicle at the residence and generally the residents have infrequent That the site is suitable for the type and of use and development which is proposed in that it is a proposed 1,140 square foot addition to an existing single family residence located on a .88 acre lot and it has operated as a board and care use during the past three years. That there will not be significant harmful effects upon the 1 quality and natural That there are no other relevant negative impacts of the proposed use that cannot be mitigated. 10. That the proposed use will not adversely the City of Poway General Plan for future as well as present development, in that the General Plan calls for placement of residential care facilities within residential areas where the zoning is appropriate. MINOR DEVELOPMENT REVIEW 92-64 That the proposed development is and in conformance with the Pow y General Plan in that the proposed use is a 1,140 squ re foot ad ition to an existing single family residence which is be ng operate as an elderly residential care home. The General P an designa ion is Residential Single Family 2 which permits resident al care uses with a conditional use permit approval. That the proposed development will not have an adverse aesthetic, health, safety, or architecturally related impact upon adjoining properties in that the grading design, building placement, construction method, building materials, and elevations will be compatible with the existing dwelling and the surrounding properties. That the proposed development is in compliance with the Zoning Ordinance in that it complies with the property development standards of the RS-2 zone. That the proposed development encourages the orderly and h appearance of structures and property within the City in that all surrounding properties are also zoned for residential development. ~uncil The City Council hereby approves Conditional Use Permit 91-05M and MDRA 92-64 subject to the following conditions: Resolution No. p-93-46 Page 3 Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and of surrounding residential and ' 1 uses. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING SITE DEVELOPHENT Site shall be developed in accordance with the approved site plans on file in the Planning Services D and the conditions contained herein. PARKING AND VEHICULAR ACCESS 1. A total of seven paved parking spaces shall be provided. 2. The applicant shall submit a parking plan to the Planning Services Department for approval prior to building permit LANDSCAPING All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. EXISTING STRUCTURES 1. Provide compliance with the Uniform Building Code for property line clearances considering use, area, and f' ' Liveness of existing buildings. The board and care facility may be of a nature to require classification as a group I-2 occupancy. An I-2 occupancy must comply with all applicable requirements of Chapter 10 of the Uniform Building Code including type of construction, fire alarm systems, disabled access, etc. The applicant shall contact the Poway Fire D for State Fire Marshal that must apply to the project. Resolution No. p-93-46 Page 4 APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: A grading plan for the d of the property shall be to the City's Engineering Services Department for review and approval rior to issuance of a grading permit and start of grading operation, ough grading of the site must be completed and shall meet the C ty's Engineering Services inspector's approval prior to issuance of bui ding permit. 2. The following development fees shall be paid prior to building permit Traffic Mitigation Sewer (additional EDU) $ 222.75 2,356.00 APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Existing fire alarm system shall be expanded into the new area. 2. Existing residential sprinkler system shall be expanded into the new area. Smoke detectors, strobe/horn devices shall be installed in each room and connected to the fire alarm system. 4. The Fire Department ~ shall be ~ separate from the parking area. Red curbs and "No Parking - Fire Lane" signs shall be installed. RENENTS AND APPROVALS lhe applicant shall provide a copy of the permit from Community Care/Licensing Division of the State Department of Social Services prior to ' ~ the number of residential boarders to fifteen. The facility shall be used as a residence for senior adults only. Maximum occupancy of the residence is fifteen persons.
