R. Irwin, owner, requests approv 1 for the con truction of a 31,000 square foot, two story, medical office uilding, inc uding an outpatient surgery center, on the property located at 12 74 Monte Vis a Road, in the CO {Commercial Office) zone; and WHEREAS, on October 5, 1993, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: The City Council finds that the project will not have an adverse impact on the t and hereby issues a Negative Declaration with mitigation. Section 2: : T'e proposed development is in conformance with the Poway General P an, in that the General Plan designates the site for ' 1 o fice development and the proposed project is a permitted use in t e CO zone. That the proposed development will not 'ave an adverse aesthetic, health, safety, or architecturally rela ed impact upon adjoining properties, in that the proposed bui ding is architecturally compatible with surrounding ' 1 o lice developments. That the proposed development is in compliance with the Zoning Ordinance, in that all development standards will be met through project construction. That the proposed development encourages the orderly and h appearance of structures and property within the City, in that the building materials and colors, and the landscaping and parking lot design will be complementary to surrounding development. The City Council hereby approves Development Review 93-03 subject to the following conditions: Within 30 days of approval {1) The Applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. -- No. P-93-47 Page 2 APPLICANT SHALL CONTACT THE DEPARTHENT OF PLANNING SERVICES REGARDING COHPLIANC[ WITH THE FOLLOWING CONDITIONS: S]TE Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. Approval of this request shall not waive compliance with all sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of building permit ' Trash receptacle shall be enclosed by a six foot high masonry wall with view-obstructing gates pursuant to City standards. Location shall be subject to approval by the Planning Services Department. All roof app including air cond shall be architecturally integrated, shielded from view and sound buffered from adjacent properties and streets as required by the Planning Services Department. Prior to any use of the project site or business activity being commenced thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit ' The emergency generator shall be screened by a masonry wall, in the location indicated on the proposed site plan near the west property line. The generator shall be kept in good operating order so as to minimize hydrocarbon Maintain effective measures for the handling and disposal of all hazardous materials. 10. This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. No. P-93-47 Page 3 PARKING SS All parking lot landscaping shall consist of a minimum of one 15 gallon size tree for every three spaces. For parking lot islands, a minimum 12 inch wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a six inch high, six inch wide portland concrete cement curbing. Parking lot lights shall be low pressure sodium and have a maximum height of 18 feet from the finished grade of the parking surface and be directed away from all property lines, adjacent streets and residences. 3. LANDSCAPING A detailed landscape and irrigation plan shall be submitted to and approved by the Public Services Department and Planning Services Department prior to the issuance of building permits. A Master Plan of the existing on-site trees shall be provided to the Planning Services Department prior to the issuance of building permits and prior to grading, to determine which trees shall be retained. Existing on-site trees shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees hall be approved for removal at the discretion of the Planning Services epartment during the review of the Master Plan of existing on-site trees. hose trees which are approved for removal shall be replaced on a tree- or-tree basis as required by the Planning Services Department. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the City of Poway ordinance and shall be planted at an average of every 30 feet. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. e The property shall be annexed into the appropriate landscape maintenance district prior to final building occupancy. -- No. P- 93-47 Page 4 SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. APPLICANT SHALL CONTACT THE DEPARTMENT OF ENGINEERING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT For a new ' ]deve]opment, the app]icant sha]] pay deve]opment fees at the established rate. The roi]owing fees, including but not limited to, traffic mitigation, drainage, water base capacity, sewer ]ine charge, and reimbursement agreement fees shal] be paid prior to building permit Permit and plan check fees shall be paid upon submittal of improvement and/or grading plan, as applicable. All other fees, including but not limited to, water service fees, remaining sewer connection, sewer clean out, and sewer inspection fees shall be paid prior to building permit GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan and geotechnical report, and accepted grading practices. A soils report shall be prepared by a qualified engineer licensed by the State of California to perform such work at first submittal of a grading plan. A geological report shall be prepared by a qualified engineer or geologist and submitted at the time of application for grading plan check. The final grading plan, prepared on a standard size sheet, shall be subject to review and approval by the Planning Services and Engineering Services Departments and shall be completed prior to issuance of a grading permit. o A pre-blast survey of surrounding property shall be conducted to the satisfaction of the City Engineer prior to any rock blasting. Seismic recordings shall be taken for all blasting and blasting shall occur only at locations and levels approved by the City Engineer. A final compaction report shall be submitted and approved prior to issuance of building permits. 7. Site grading shall be certified by the project civil engineer prior to issuance of building permits. -- Resolution No. P%3-47 Page 5 8. All new slopes shall be a maximum of 2:! (horizontal to vertical). Non-supervised and/or non-engineered fill are specifically prohibited. Rock disposal areas shall be graded in compliance with ' ~ soils investigations and recommendations and grading plans. !0. The tops and toes of any graded slopes shall be constructed with a five foot minimum setback from any open area and property lines. STREETS AND SIDEWALKS Parking lot 1 sections shall be submitted to, and approved by the City Engineer. Pavement sections shall conform to the minimum required by the Poway Municipal Code using a minimum traffic index of d.5. All damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to of bonds and improvements, to the satisfaction of the Department of Engineering Services. Prior to any work being performed in the public right-of-way, an encroachment permit shall be obtained from the Engineering Services Department and appropriate fees paid, in addition to any other permits required. 4. The developer shall acquire an encroachment permit for any private improvements placed within the public right-of-way. DRAINAGE AND FLOOD CONTROL A drainage system capable of handling and disposing of all surface water originating within the property, and all surface waters that may flow onto the subject property from adjacent lands, shall be required. Said drainage system shall include any easements and structures as required by the Director of Engineering Services to properly handle the drainage. Portland cement concrete cross gutters shall be installed where water crosses the roadways. Concentrated flows across driveways and/or sidewalks shall not be permitted. UTILITIES ]. All proposed utilities within the project shall be installed underground. Utility easements shall be provided to the specification of the serving utility companies and the Director of Engineering Services. 3. No. P-93-47 Page 6 Water, sewer, and fire protection systems plans shall be designed and constructed to meet requirements of the City of Poway and the County of San Diego D of Health. The applicant shall pay for a water system analysis to establish the proper size and location for the public water system. The amount shall be paid upon demand by the City. The ap licant shall, within 30 days after receiving pproval of the develo ment view, apply for a Letter of Availability LOA) to reserve sewera e ava ability and post with the City, a nonrefund ble fee eq al to 0% of the appropriate sewerage connection ee in effect at the time the OA is issued. Cable television services shall be provided and installed underground. The developer shall notify the cable company when trenching for utilities is to be accomplished. No. P-93-47 Page 7 The builders will be required to install an approved fire sprinkler system and stand ipe system. The entire system is to be monitored by a central monitorin company. A system post indicator valve with tamper switch, also mon ored, shall be located by the City Fire Marshal prior to installat on. Every building hereafter constructed shall be accessible to Fire Department apparatus by way of access roadways with all-weather surface of not less th 20feet of unobstructed width, with adequate roadway turning radius capau e of supporting the imposed loads of fire apparatus having a minimum of 1 '6" of vertical clearance. The road surface type shall be approved by he City Engineer, pursuant to the City of Poway Municipal Code. The addition of two (2) o -site fire hydrants is required. The location of the hydrants shall be etermined by the City Fire Marshal. Approximate locations will be at the riveway entrance into the project site and near the northeast corner of t e project site. A 'Knox' Security Key Box shall be required for the building at a location determined by the City Fire Marshal. A 'Knox' padlock shall be required for the fire sprinkler system Post Indicator Valve. Material Safety Data Sheets shall be required for all hazardous and/or toxic substances used in each building. A "Business Plan" and Hazardous Materials Disclosure is required to be filed with the County of San Diego Department of Health and copies provided to the Fire Department. Fire Department access for use of fire fighting equipment shall be provided to the immediate job construction site at the start of and maintained at all times until construction is completed. Permanent access roadways for fire apparatus shall be designated as 'Fire Lanes' with appropriate signs and curb markings. If an elevator is installed, it shall be sized to accommodate a normal hospital gurney. Minimum depth/width to be seventy-five (75) inches.
