P-93-62 OF TH CITY COU CI CITY OF POW" CALIFO NI G TENTATIVE CT MAP 1-0 TE R'S PARCEL N ,~ER 3]4- 92- 8 WHEREAS, Tentative Tract Map 91-03TE, hereinafter "Map," submitted by Diroma Inc., applicant, for the purpose of subdividing real property situated at 14469 Midland Road into five lots, regularly came before the City Council for public hearing and action on December 14, 1993; and WHEREAS, the Director of Planning Services has recommended approval of the Map subject to all conditions set forth in the Planning Services report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Se( A Negative Declaration with M' Measures was issued on June 8, 1991. New tal information has become available and evaluated and it has been determined that no significant tal impacts will result with the granting of the time extension. The City herby issues a Negative Declaration with Mitigation Measures incorporating the additional ~al information. Sectio) : 1. The proposed project is consistent with the General Plan. The tentative tract map is with all applicable general and specific plans because the proposed lots meet the standards of the RS-4 zone. The design or improvement of the tentative tract map is ~ with all applicable general and specific plans in that the lot size and configuration and access to the site meet Zoning Ordinance and General Plan standards. The site is physically suitable for the type of development proposed in that the property is gently sloping and has access from existing streets. The site is physically suitable for the density of the development proposed in that the proposed lots meet the acreage requirements of the RS-4 zone. Resolution No. P-93-62 Page 2 e The tentative tract map is not likely to cause serious public health problems because City water and sewer systems will be provided to the new parcels. Low flow plumbing fixtures will be required throughout future buildings on the site. Landscaping plans will eventually be prepared with minimal water consumption and incorporating low volume irrigation techniques for trees and shrubs. The design of the tract map will not conflict with any easement by the public at large, now of record, for access through or use of the property within the proposed subdivision. Section 3: :ision: The City Council hereby approves Tentative Tract Map 91-03 Time Extension subject to the following conditions: Within 30 days of approval the applicant shall submit in writing that all conditions of approval have been read and understood. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. Approval of Tentative Tract Map 91-03TE is based on its conformance with the conditions contained in City Council Resolution The developer shall have an archaeological study prepared on the subject property prior to an additional tentative map time extension or final map approv l, or t e issuance of any permits which will result in physical distur ance o the site. The study shall thoroughly assess the signif cance o the cultural consider the project impacts and determ ne whet er further mitigation is required. The tentative map approval shall expire on June 18, 1996. Application for time must be received 90 days prior to expiration in accordance with the City's Subdivision Ordinance.
