Res P-93-63 RESOLUTION NO. P- 93-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW 93-05 ASSESSOR'S PARCEL NUMBER 316-120-32 &-33; 317-153-16; 317-521-01 & -05 WHEREAS, Development Review 93-05, submitted by Centex Homes, applicant, requests approval of the development review to allow the construction of 46 single-family dwellings in Tentative Tract Map No. 88-03, located north and west of the ' of Oak Knoll Drive and Poway Road; WHEREAS, on December 14, 1993, the City Council held a hearing on the above-referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: There are no new impacts beyond those discussed within the initial study f tal review for Tentative Tract Map 88-03 and Development eview 89-13. The Negative Declaration with mitigation measures issued or TTM 88-03 is found to be adequate to address all tal impacts or this project. The proposed project is consistent with the general plan in that it proposed construction of single-family homes in an area designated for residential use. That the proposed development will not have an adverse aesth tic, health, safety, or architecturally r lated impact upon adjo ning properties, because rooflines, mater als, and building loca ions will be varied, and the colors, archi ectural styles, and bui ding materials are compatible with nearby evelopments. That the proposed development is in compliance with the Zoning Ordinance because the homes meet the development standards of the underlying zoning. That the proposed development encourages the orderly and h appearance of structures and property within the City, because it is similar to and complements other residential development in the vicinity. That the slopes exceeding 30 feet in height are acceptable so long as benches are installed on such slopes, contour grading is used on all manufactured slopes over 15 feet in height and adequate landscaping is installed. Resolution No. P-93-63 Page 2 Sec,' The City Council hereby approves Development Review 93-05 subject to the following conditions (with added text being highlighted and deleted text being lined through): Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood. All conditions of Resolutions No. P-89-121 and P-88-92 shall apply except as modified by this resolution. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF PLANNING COMPLIANCE SHALL BE SITE DEVELOPMENT This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. A masonry wall of five feet in height shall be installed along the top of slope on the south side of Lots 49 to 54 to reduce the noise impacts from the ' 1 area. The height, design and material utilized for the wall shall be subject to the approval of the Director of Planning Services. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. COMPLIANCE SHALL BE GRADING Grading of the subject property shall be in accordance with the Uniform Building Code, City Grading Ordinance, approved grading plan G548-89, geotechnical reports, and accepted grading practices. Erosion control, including, but not limited to desiltation basins, shall be installed. The developer shall make p to insure the proper maintenance of all erosion control devices throughout their intended life. S All damaged public facilities (off-site and on-site), including parkway trees and retaining walls, shall be repaired or replaced prior to exoneration of bonds and improvements, to the satisfaction of the Department of Engineering Services. Resolution No. P-93-63 Page 3 The developer shall maintain with the City of Poway Engineering Services Department current liability and workers' compensation ' policies. The developer shall execute a modified "standard agreement" and ost equired securities for the value of all uncompleted public imp he developer is required to com lete all improvements require y entative Tract Map No. 88-03. The greement shall be executed with n 0 ays of this approval. If agreemen is not executed within that perio , all building permits may be suspen ed. No occupancies may be granted without the in place. Record drawings shall be submitted and approved for both the grading and improvement plans prior to release of the bonds and securities. Record drawings will be obtained by the developer based on full obtainable by the developer.
