WHEREA , Temporary Use Permit g4-05 submitted by Norman Osborne/The Pinery
Tree Farms, pplicant, requests approval to operate a nursery and fruit stand,
a pumpkin sa es lot and a Christmas tree sales lot on the property located at
13137 Poway oad within the Commercial General zone.
NOW, THEREFORE, the City Council does hereby resolve as follows:
This project is exempt from tal review, under Class 4 of the C E Q A
Guidelines as it is temporary in nature and will have negligible or no permanent
effects on the
Section 2: Findim
That the proposed use is in accordance with the purposes and standards of Section
17.26.020 of the Zoning Ordinance.
ouncil Decision:
The City Council hereby approves Conditional Use Permit 93-04 subject to the
following conditions:
CONPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED.
APPROVED BY THE DEPARTNENT OF PLANNING SERVICES.
CONPLIANCE SHALL BE
SITE DEVELOPHENT
Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances.
Prior to any use of the project site or business activity being commenced
thereof, all conditions of approval contained herein shall be completed to
the satisfaction of the Director of Planning Services.
The applicant shall obtain a vendors license from the Customer Services
department prior to t of business activity.
5. The applicant shall contact the County E tal Health Department and
obtain the required permits prior to the sale of any produce at the site.

A sufficient number of portable restrooms shall be provided on-site for
the customers and employees. A minimum of one restroom shall provide
accessible to the disabled .
SIGNS
1. Any signs proposed for this use shall be designed and approved in
conformance with the Sign Ordinance.
2. Portable and vehicle signs are prohibited.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
1. Provide one 2A:IOBC fire extinguisher.

The applicant shall obtain a Fire Department permit for the Christmas tree
lot prior to the sale of Christmas trees.
3. Do not block emergency vehicle access to the site.
Contact the Safety Services Department for an inspection of the pumpkin
and Christmas trees sales lots prior to any business activity for either
event.
GENERAL REQUIRENENTS AND APPROVALS
The temporary use permit shall become null and void on January 2, 1995, at which
time the site shall be restored to its original condition.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
