APPROVING MODI ICATION TO CO .TTIO ~L USE PERMIT 89-10

WHEREAS, modification of Conditional Use Permit 89-10 submitted by the City
of Poway, applicant, requests approval to a 375 square foot
blacksmith's shop within the Old Poway Historic Park, located within the 14100
block of Midland Road; and
WHEREAS, on February 22, 1994 the City Council held a duly noticed hearing
to solicit comments from the public both pro and con on the above referenced
item.
NOW,
the City Council does hereby resolve as follows:
Section 1: E 1 Findin< :
The City Council finds that the proposed Negative Declaration adequately
discusses the 1 concerns of this project and provides for
appropriate mitigation measures so as to reduce all potential adverse
impacts to a level of insignificance.
Section 2: Findin~ :
The proposed project is with the general plan in that the
building proposed is a working exhibit within the historic park
which has been specifically designed for such uses.
That the proposed project will not have adverse aesthetic, health,
safety or architecturally related impacts upon adjoining properties,
in that the design of the building is in keeping with the
architectural guidelines for , and will blend with nearby
buildings and elements within the park.
That the proposed project is in compliance with the Zoning
Ordinance, in that it complies with the development standards
adopted for the Old Poway Park .
That the proposed project encourages the orderly and h
appearance of and property within the City, the building
has been designed in an architectural style which is sympathetic to
the two adjoining buildings (the Nelson House and the train barn).

That the g of traffic will not adversely impact the
capacity and physical character of surrounding streets.
That there are public facilities and utilities available to service
the project.

That there will not be significant harmful e fects upon

coal-fired forge will either not be used or will be fueled by
natural gas.
Section 3: Cit Council
The City Council hereby approves modification to Conditional Use Permit
89-10 subject to the following conditions:
The use conditionally granted by this permit shall not be conducted in
such a manner as to interfere with the reasonable use and enjoyment of
surrounding residential and ' 1 uses.
This conditional use permit shall be subject to annual review by the
Director of Planning Services for compliance with the conditions of
approval and to address concerns that may have occurred during the past
year. If the permit is not in compliance with the conditions of approval,
or the Planning Services D has received complaints, the required
annual review shall be set for a public hearing before the City Council,
to consider modification or revocation of the use permit.

Site shall be developed in with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations ' ~ all conditions of
approval shall be submitted to the Planning Services Department prior to
issuance of building permits.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit '
The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit
During periods of unhealthy air quality the coal-fired forge shall not be
used unless fueled by natural gas only.
The blacksmith may operate the forge and related equipment only during the
hours of 7:00 a.m. to 7:00 p.m. during weekdays and between 10:00 a.m. to
dusk on Saturday and Sundays.

SIGNS
Any signs proposed for this project shall be designed and approved in conformance
with the Old Poway Park Specific Plan.
