WHEREAS, Minor 1 Use Permit 94-01, submitted by Michael and Mary
Gordon, applicants, requests approval to legalize the installation of a
children's play structure within an open space easement within the property
located at 12737 Boxwood Court, in the Rancho Arbolitos Planned £ and
WHEREAS, on April 12, 1994, the City Council held a hearing on the above-
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: E :
The City Council finds that this project is lly exempt (Class 3)
from the California E 1 Quality Act ('CEQA).
Section 2: Fi :
1. The proposed project is with the general plan in that the
play structure is an object to a residential use in a
single-family zone.
That the proposed project will not have an adverse aesthetic,
health, safety or architecturally related impact upon adjoining
in that the is installed within an existing
mature eucalyptus grove. The is of dark
stained wood and dark green shade awnings over the climbing
apparatus. The structure blends visually into the trees.
That the proposed project is in compliance with the Zoning
Ordinance, in that it is to a residential use and is
normally not regulated by zoning standards.

The City Council hereby approves Minor Conditional Use Permit 94-01
