P-94-26 OF T'E CITY OU C L F CITY OF PO'AY, CAL FO N A APP OV CONDITIONA USE PE MI 4-05 AS ES 'S PARCEL N MBERS 3 7- 7 -58 WHEREAS, Conditional Use Permit 94-05 submitted by Ford Finishes of California, applicant, Tech Business Center, owner, requests approval to establish a paint warehouse within an existing building located at 12185 Dearborn Place, in the Tech Business Center portion of the South Poway Planned zone; and, WHEREAS, on June 21, 1994, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, the City Council does hereby resolve as follows: Section 1: E 1 : This project is exempt from 1 review, under Class I of the CEQA Guidelines as it is a minor alteration to existing facilities. Section 2: : Conditional Use Permit 94-05 The proposed project is with the general plan and specific plan, in that paint warehouse is a use which is permitted with the benefit of a conditional use permit within the South Poway Community Plan. That the location, size, design and operating ch of the proposed use will be compatible with and will not adversely affect or be materially d 1 to adjacent uses, residents, buildings, or natural in that the use will be located within an existing industrial building. That the harmony in scale, bulk, coverage and density is t with adjacent uses, because the use will be located within an existing building. 4. That there are available public facilities, services and utilities. o That there will not be a harmful e fect upon desirable neighborhood ch in that the use wi 1 be conducted in compliance with required safety procedures and ot er of this permit as well as State and local fire regu ations. o That the of traffic will not adversely impact the surroundin~ streets and/or the City's Circulation Element, in that the use is allotted 12 parking spaces where the number of employees is projected to be ly four. Resolution No. P-94-26 Pa§e 2 That the site is suitable for the type and intensity of designated use which is proposed, in that it is in an area for light industrial uses. o That there will not be significant harmful effects upon tal quality and natural in that the use will be contained within an existing building on a fully developed site. go That there are no other relevant negative impacts of the proposed use that cannot be mitigated. Section The City Council hereby approves the following conditions: 1 Use Permit 94-05 subject to Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and of surrounding industrial uses. COHPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. COMPLIANCE SHALL BE SITE DEVELOPMENT This 1 use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services D has received complaints, the required annual review shall be set for a public hearing before the City Council, to consider modification or of the use permit. Site shall be developed in accordance with the approved site plans on file in the Planning Services D and the conditions contained herein. o Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit Prior to any use of the project site or business activity being commenced thereof, all of approval contained herein shall be completed to the satisfaction of the Director of Planning The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code and all other applicable codes and ordinances in effect at the time of building permit ' Resolution No. P-94-26 Page 3 The applicant shall Division prior to obtain a business license from the Customer Services of business activity. Adhere to Fire Code regulations/recommendations per the technical manual which was submitted for City review. Provide warehouse storage and rack plan as well as tenant improvement plan for Fire review. All applicable local Fire Code amendments will be applied. APPLICANT SHALL CONTACT THE DEPARTMENT OF PUBLIC SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONOITIONS. Floor drains and/or area drains in material storage area cannot be directly connected to storm drain or sewer systems. Verify compliance with the Public Services Department. 2. Limit transportation of hazardous materials to certain roads in the business park as determined by the Director of Public Services.
