ITIONAL SE PE T 94-06 ASSESSOR' P EL NUMBE 317-4 --55 WHEREAS, Conditional Use Permit 94-06 submitted by Steve Hirschhorn, applicant, requests approval to operate a pawn shop within an existing building located at 12845 Poway Road, in the Commercial General zone; and WHEREAS, on July 5, 1994, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application; NOW, THEREFORE, the City Council does hereby resolve as follows: Sectio : The City Council finds that the project is Categorically Exempt, Class 1 from the California E 1 Quality Act in that it involves the minor alteration of existing facilities. Section 2: : 1. The proposed project is consistent with the general plan. The proposed location, size, design, and operating characteristics of the proposed use are in accord with the title and purpose of this resolution, the purpose of the land use designation in which the site is located and the Poway General Plan. That the location, size, design, and operating characteristics of the roposed use will be compatible with and will not adversely affe t or be materially detrimental to adjacent uses, residents, buil ings, structures, or natural in that the use will be loca ed within an existing ' 1 building. That the harmony in scale, bulk, coverage, and density is consistent with adjacent uses, because the use will locate within an existing building. o That there are available public facilities, because the use will locate in an existing and utilities, 1 building. That there will not be a harmful effect upon desirable neighborhood ch in that the use will locate in an existing building. That the generation of traffic will not adversely impact the surrounding streets and/or the City's Transportation Element, in that the use will operate within a ' 1 center where existing street improvements and off-street parking are adequate. o 10. Resolution No. p-94-30 Page 2 That the site is suitable for the type and intensity of designated use which is proposed, in that it is in an area for general · 1 uses. That there will not be significant harmful effects upon 1 quality and natural in that the use will be contained within an existing building on a fully developed site. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. The City Council hereby approves Conditional Use Permit 94-06 subject to the following Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. The use conditionally granted by this permit shall not be conducted in such a manner as to with the use and of surrounding residential and 1 uses. This conditional use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services Department has received the required annual review shall be set for a public hearing before the City Council, to consider modification or revocation of the use permit. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. COMPLIANCE SHALL BE All firearms shall be stored within a locked safe during non-business hours. SITE DEVELOPMENT Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Revised site plans and building all of approval shall be submitted to the Planning Services D' prior to issuance of building permits. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. Resolution No. P-94-30 Page 3 Prior to any use of the project site or business activity being commenced thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit o The applicant shall obtain a Secondhand Dealers License from the Customer Services Department prior to the of business activity. e The use shall be conducted in compliance with the requirements outlined in Section 5.32 of the Municipal Code. 8. Disabled access shall be provided throughout the building. This approval shall become null and void if business activity J with the use has not commenced within two years from the date of project approval. SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance.
