P- 94-31 OF T E CITY COUNCIL F THE CITY OF PO'AY, CALIFORNIA AP ROVING TENTATIV TRACT MAP 94-02 ASS SSOR'S PARCEL N BER 317-211-02,04 WHEREAS, Tentative Tract Map 94-02, hereinafter "Map" submitted by Douglas Keyes a plicant, Poway Land Company owner, for the purpose of subdividing the real pr petty located at the northeast corner of Pomerado Road and Metate Lane, situate in the City of Poway, County of San Diego, State of California, into 62 single amily lots plus one park lot and one open space lot, regularly came before the City Council for public hearing and action on July 12, 1994; and WHEREAS, Tentative Tract Map 94-02 meets the as amended on November 9, 1993; and of the RS-7 zone WHEREAS, the Director of Planning Services has recommended approval of the tract map, subject to all conditions set forth in the Planning Services D report; and WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E 1 Find' : The City Council finds that the previously certified EIR of June 26, 1990 adequately addresses the 1 concerns of this project. Section 2: Findin~ : The proposed project is consistent with the general plan in that a residential land use is proposed by this application. The design or for the tract map are t with all applicable general and specific plans, in that imp adhere to the development standards of the City of Poway Zoning and Subdivision Ordinances. The site is physically suitable for the type of development proposed, in that the site is flat and bounded on two sides by public roadways. The site is physically suitable for the density of the development proposed. It contains for 62 single-family lots on 9.22 net acres, which is a density of seven lots to the acre, where eight to the acre are permitted. The lot sizes and configurations all conform to the minimum RS-7 zoning standards. The design of the subdivision is not likely to cause substantial 1 damage and avoidable injury to humans and wildlife or their habitat, in that the site has been previously disturbed, that No. p- 94-31 Page 2 major portions are being dedicated for open space and drainage along Poway Creek, and that a comprehensive revegetation plan to restore the creek area is being required of this map. o The tract map is not likely to cause public health problems because City water and sewer systems will be provided to serve the new parcels. The design of the tentative tract map does not conflict with any by the public at large, now of record, for access through or use of the property within the proposed subdivision. Section 3: ~cil Decision: The City Council hereby approves following conditions: Tract Map 94-02 subject to the Within 30 days of approval (1) the shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department at the development review stage. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and alt other applicable City Ordinances in effect at the time of building permit o Street names shall be approved by the Planning Services Department prior to the recordation of the final map, and street addresses shall be provided prior to the issuance of building permits. A pedestrian link shall be dedicated to provide access between Pomerado Road and the interior of the new neighborhood within the utility/fire easement over proposed Lot 37. The pedestrian path shall meander through the lot. LANDSCAPING The develo er shall revegetate and maintain the creek bank and stream area in compli nce with permits issued by the State and Federal resource agencies or the required length of time and to the required performance specif' Resolution No. P-94-31 Page 3 SIGNS Any signs proposed for this development shall be designed and approved in conformance with the Sign Ordinance. ADDITIONAL APPROVALS R Development review shall be accomplished prior to the issuance of a building permit. All sales maps that are distributed or made available to the public shall include but not be limited to trails, future and existing schools, parks, and streets. The developer shall provide a noise display board in the sales office to the satisfaction of the Director of Planning Services. The display shall include the site plan and noise study inf o At the Development Review stage working drawings shall include a certification by a recognized acoustical expert that the requirements of the City of Poway's Noise Ordinance will be met. The developer shall set aside 15 percent of the new lots for low income housing and shall be subject to a on the face of the map providing such set aside. An in-lieu fee has been adopted by the City Council and the developer may opt to pay an in-lieu fee at the established rate in place of setting aside 15 percent of the units for low income housing. All new slopes shall be a minimum of 2:1 (horizontal to vertical). 7. A final report shall be submitted and approved prior to issuance of building permits. o A certification of line and grade, prepared by the project civil engineer, shall be submitted prior to issuance of building permits. Buildings and parking surfaces shall be at least five feet from tops and toes of slopes, unless waived by Planning and/or Engineering Services Departments prior to grading permit issuance. 10. The proposed drainage easement over the proposed Lot 40 need not be paved. GENERAL AND Final maps shall conform to City standards and procedures, City subdivision ordinance, Subdivision Map Act and Land Surveyors Act. Application for time extension must be received 90 days prior to expiration in accordance with the City's Subdivision Ordinance.
