P-94-34 OF T E CITY NC L F T CITY OF PO'AY, CAL RNA APP OVI CONDITIONA USE PE T 4-10 AS ES 'S PARCEL r MBER 31 22 -22 WHEREAS, Conditional Use Permit 94-10 submitted by Tony Salmeri, applicant, Pomerado Properties, Owner, requests approval to operate a school in an existing building located at 12850 Brookprinter Place within the South Poway Planned Community zone; and WHEREAS, on July 12, 1994, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: : This project is exempt from 1 review, under Class 1 of the CEQA Guidelines as it is a minor alteration to existing facilities. Section 2: F : The proposed project is with the general plan and the South Poway Specific Plan in that indoor 1 uses are permitted on property designated for light industrial development within the South Poway Business Park with the approval of a conditional use permit. That the location, size, design and operating ch of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, or natural , in that the use will be located within an existing industrial building. That the harmony in scale, bulk, coverage, and density is consistent with adjacent uses, because the use will be located within an existing building and be operated on a scheduled or only basis. That there are available public facilities, and utilities, because the use will be located in an existing industrial building. o That there will not be a harmful effect upon desirable neighborhood charact in that the use will be located inside of a building. o That the g of traffic will not adversely impact the surrounding streets and/or the City's Transportation Element in that the use will operate out of a business park where existing street improvements and off-street parking are adequate. Resolution No. p-94-34 Page 2 That the site is suitable for the type and ' of the use which is proposed, in that it is in an area designated for light industrial uses and the business will operate on a scheduled or only basis. That there will not be significant harmful effects upon tal quality and natural in that the use will be contained within an existing building on a fully developed site. That there are no other relevant negative impacts of the proposed use that cannot be mitigated. Section 3: Cit Council ' ' The City Council hereby approves Conditional Use Permit 94-10 subject to the following conditions: Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and of surrounding residential and ' 1 uses. This conditional use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services D has received complaints, the required annual review shall be set for a public hearing before the City Council, to consider modification or of the use permit. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF PLANNING SERVICES. COMPLIANCE SHALL BE SITE Site shall be developed in accordance with the approved site plans on file in the Planning Services D and the conditions contained herein. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. __ 3. Prior to any use of the project site or business activity being commenced thereof, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Planning Services. ° The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. o This approval shall become null and void if business activity has not commenced or if building permits have not been issued for this project within two years from the date of project approval. o Planning staff shall review the Conditional Use Permit in 6 months to determine whether all conditions are being met and to assess the impact of the use on b SIGNS Any signs proposed for this shall be designed and approved in conformance with the Sign Ordinance.
