WHEREAS, Conditional Use Permit 94-13 submitted by J. N. Mechling,
applicant, requests approval to operate a martial arts studio within an existing
building located at 12657 Poway Road, in the ' 1 Office zone; and
WHEREAS, on July 12, 1994,
hearing to solicit comments from
application;
the City Council held a duly advertised public
the public, both pro and con, relative to this
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: E 1 Findin( :
The City Council finds that the project is Categorically Exempt, Class ] from the
California E 1 Quality Act in that it involves the minor alteration of
existing facilities.
Section 2: :

The proposed location, size, design, and operating ch
of the proposed use are in accord with the title and purpose of this
resolution, the purpose of the land use d in which the
site is located and the Poway General Plan.

contained within an existing building on a fully developed site.

That there are no other relevant negative impacts of the proposed
use that cannot be mitigated.

The City Council hereby approves Conditional Use Permit 94-]3 subject to
the following conditions:
Within 30 days of approval (1) the applicant shall submit in writing
that all conditions of approval have been read and understood; and
(2) the property owner shall execute a Covenant on Real Property.

The use conditionally granted by this permit shall not be conducted
in such a manner as to interfere with the reasonable use and

This conditional use permit shall be subject to annual review by the
Director of Planning Services for compliance with the conditions of
approval and to address concerns that may have occurred during the
past year. If the permit is not in compliance with the
of approval, or the Planning Services Department has received
complaints, the required annual review shall be set for a public
hearing before the City Council, to consider modification or
of the use permit.
SITE DEVELOPMENT
Site shall be utilized in accordance with the approved site and floor
plans on file in the Planning Services Department and the conditions
contained herein.
Revised site plans and building floor plans ' ~ all conditions
of approval shall be submitted to the Planning Services Department prior
to issuance of building permits.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit '

Prior to any use of the project site or business activity being commenced
thereof, all conditions of approval contained herein shall be completed to
the satisfaction of the Director of Planning Services.
The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit '
Disabled access shall be provided throughout the building.
All parking spaces shall be double striped. The disabled parking space is
to be repainted and properly signed per current standards.
Trash receptacle shall be enclosed by a six foot high masonry wall with
gates pursuant to City standards. Location shall be
subject to approval by the Planning Services Department.
This approval shall become null and void if business activity ~
with the use has not within two years from the date of project
approval.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.
LANDSCAPE IMPROVEMENTS

The buildings shall display their numeric address in a manner visible from
the access street. Minimum size of the building numbers shall be 6 inches
on the front facade of building. Building addresses shall also be
displayed on the roof in a manner satisfactory to the Director of Safety
Services per Sheriff ASTREA specification.
2. A 'Knox' Security Key Box shall be required for the building at a location
determined by the City Fire Marshal.

Permanent access roadways for fire apparatus shall be designated as 'Fire
Lanes' with signs and curb markings.
The building shall meet all current Building and Fire Codes. Submit
tenant improvement drawings for all work. Occupancy use shall change from
a B-2 to A-3 requiring additional exiting req and emergency
lighting. New sign shall be posted.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
