P-94-48 A F T' CITY COUNC OF HE C TY 0 PO' Y, CALIFORN APPROVING MINO DEV LOPM T -38 (HILLSI /RIDGELINE) ASSES OR' PARC L '',BER 321-27 - 5 WHEREAS, Minor Development Review 94-38 (Hillside/Ridgeline), submitted by Elwood Norris, applicant, requests approval for the of a 16,160 square foot split-level home and 1,270 square foot detached guest house, located at the northeast corner of a 40 acre parcel at the southern terminus of Blue Crystal Trail, in the RR-A zone; and WHEREAS, on September 13, 1994, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, the City Council does hereby resolve as follows: Section 1: E 1 : The City Council finds that Minor Development Review 94-38 (Hillside/Ridgeline) is exempt from the p of the California E 1 Quality Act, Categorical Exemption Class 3, as the project is the of a new single-family home. By local ordinance, the areas disturbed in the process which contain Coastal Sage Scrub plant are to be mitigated through the on-site dedication of equal or better quality habitat, at a 2:1 ratio. 1. The proposed project is with the general plan in that it proposes the of a single-family residence and on a site which is designated for residential use. That the proposed development will not have an adverse aesthetic, health, safety or architecturally related impact upon . properties, in that the home will be stepped into the hillside so as to help conceal graded cut slopes. The planting plan indicates full revegetation of all visible slopes. That the proposed development is in compliance with the Zoning Ordinance, in that it complies with the property development standards of the RR-A zone. That the proposed development . the orderly and h appearance of and property within the City, in that the surrounding consist of large rural residential lots with widely spaced hillside h _ Resolution No. P-94-48 Page 2 Section 3: : The City Council hereby approves Minor Development Review 94-38 (Hillside/ ) subject to the following Within 30 days of approval (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant on Real Property. COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE OF PLANNING SERVICES. E SHALL BE SITE DEVELOPHENT Site shall be developed in accordance with the approved site plans on file in the Planning Services D and the conditions contained herein. 2. Revised site plans and building all conditions of approval shall be submitted to the Planning Services D' prior to issuance of building permits. Approval of this request shall not waive with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit issuance. Prior to any use of the project site or business activity being commenced thereof, all of approval herein shall be completed to the satisfaction of the Director of Planning Services. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. Planting on the slope behind the house and on the west side of the driveway shall be designed and installed so as to transition into the native vegetation in compliance with adopted City landscape guidelines. The installation of slope planting and shall be completed prior to building On-site dedication of Coastal Sage Scrub shall be accomplished in accordance with adopted standards prior to building permit ' An affordable housing in-lieu fee shall be paid in the amount of $4,500.00, prior to building permit ' .__ 9. This approval shall become null and void if building permits are not issued for this project by September 13, 1996. Resolution No. P- 94-48 Page 3 COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES. COMPLIANCE SHALL BE A grading plan for the development of the property together with the to the private road, from the improved portion of Blue Crystal Trails to the site, shall be submitted to the City's Engineering Services for review and approval prior to issuance of a grading permit and start of grading operation. The above mentioned private road shall be improved to City of Poway's Non- Rural Road Standards per Ordinance No. 280. Its completion thereof shall be done prior to issuance of building's Certificate of Occupancy. A road for said road, in a form satisfactory to the City shali be executed by the owner prior to building permit Said agreement is to comply with No. 280, City Code Section 12.20.060. Leach field layout or seepage pit layout for the residence sewage disposal system shall be submitted to the City's Services for review and approval by the City Engineer prior 'to obtaining a septi system installation permit from the County of San Diego Department o Health. If a septic system installation permit had been obtained withou a City approved layout, one shall be submitted prior to installation o leach lines. Prior to designing the public water system ' in the area, the a plicant will complete a hydraulics study for extending the public water s'stem in the area. Costs to prepare the hydraulics study will be paid to t e City of Poway and the City's consultant will complete the study. I ese costs will be eligible to be included in the reimbursement costs described below. Option #1: The applicant will install the public water lines from the site easterly and southerly to the boundary of the applicant's parcel. The size of the public water mains will be determined by the hydraulics study. The applicant will be required to install a booster pump and system sufficiently sized to provide water to the plicant's parcel. Further, the applicant will install water tank for re protection as conditioned by the Fire Department to be installed on s property. The water tank will be approximately 25,000 gallons. ublic water mains installed by the applicant which benefit other parcels Resolution No. P- 94-48 Page 4 will be eligible to be included in a reimbursement agreement upon request by the applicant and approval by the City Council. No fire hydrants will be required under this option as the booster pump system would not be sized large enough to handle fire flows. Option #2: App icant shall install public water mains in the easterly and ou herly to the applicant's property boundary. The applicant will ns all a booster pump and hydropneumatic system with the capability of el vering 1500 GPM and install fire hydrants as required by the Fire epartment. Do An easement document, in a form acceptable by the City, shall be executed prior to recordation in the office of the Recorder of San Diego County. Eo A subordination agreement, in a form acceptable to the City, shall be executed by the beneficiary of every trust deed encumbering each grantor's property. This agreement shall be reviewed by the City prior to recordation in the office of the Recorder of San Diego County. Where the access roadway cannot be provided, approved fire protection system(s) shall be provided as required and approved by the chief. o This dwelling is being built on a parcel size of more than 1 acre and is beyond 500 feet maximum from the nearest fire hydrant. The dwelling will have to have standby water for firefighting and a residential sprinkler system. Contact the Fire Bureau for details. 8. Residential fire sprinkler system is required for this dwelling. If the city water system is extended to this dwelling, the new system and fire hydrant should be designed to deliver 1500 GPM. 10. Wildland/Urban Interface Fuel Plan/Landscape Plan shall be submitted meeting Poway Landscape P~an Criteria.
