Ord 45ORDINANCE NO. 45 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA AMENDING THE ZONING ORDINANCE REGULATIONS FOR THE R-S-7 ZONE TO PERMIT THE LOCATION AND INSTALLATION OF HUD CODE MOBILEHOMES WHEREAS, The City Council has held a duly advertised public hearing on September 1, 1981 to solicit and consider comments, both pro and con rela- tive to this ordinance; and WHEREAS, the City Council wishes to comply with the regulations and requirements of California Government Code Section 65852.3 relative to the location of HUD Code mobilehomes in single family zones, NOW, THEREFORE, the City Council of the City of Poway does hereby ORDAIN: Section 1: Section 2102(a) Permitted Uses is hereby amended to read as follows: a. Residential Use Types Family Residential Mobilehomes on individual lots, which are certified under the National Mobile Home Construction and Safety Standards Act of 1974 and which were constructed after October 1976, are permitted on legal lots of record 6000 square feet or less in area and zoned R-S-7; if placed on a permanent foundation system in compliance with all applicable building regulations and the Health and Safety Code, Seection 18551. The Development Review Procedure shall determine if such placement is compatible to the immediate area in which it is being placed, in accordance with Development Review Ordinance No. 42 and the following criteria: (1) The design of the mobilehome unit shall be similar in character and appearance to other dwellings in the area for such things an unit size, roof overhangs, roof materials and exterior materials. Ordinance No. 45 Page 2 (2) Ail building setbacks, parking, coverage, height, width and sign requirements of the R-S-7 zone shall apply and shall be complied with. (3) Lots larger than 6000 square feet and zoned other than R-S-7 are found not to be compatible with mobilehome usage and are not permitted as such usaqe, based upon the significant difference in unit size, heiqht and design associated with dwellings on large lots or within large lot subdivisions. Section 2: The City Council of the City of Poway, California hereby finds that this amendment will not cause significant ad- verse impacts on the environment and issuses a Negative Declara- tion for Zoning Ordinance Amendment 81-17.
