Res P-95-11APPROVING CONDIT AS RESOLUTION NO. p-95-11 RE OLUTION OF T CITY COU CI F T E CITY OF PO' v, CALIFO I L SE PERMIT 9 --1 AND DE' LO MENT REVIEW 95-01 ~SO 'S PARCEL N ER 278-43 -3 ,37 WH REAS, Conditional Use Permit 95-01 and Development Review 95-01, submitte by the City of Poway, Applicant for the purpose of a 4,000 square oot administration building at the Operations Center/Berg ~nd Water Treatmen Plant complex located at 14521 and 14445 Lake Poway Road. T e project also involves various upgrades to the Water Plant, inc uding the construction of a 1200 square foot addition onto the control bui ding, the addition of a water storage tank and the replacement of existing chemical storage tanks, water filters and the clearwell cover. WHEREAS, the City Council has read and considered said report and has considered other evidence presented at the public hearing. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: E : The City Council finds that Conditional Use Permit 95-01 and Development Review 95-01 will not result in any significant impact on the and hereby issues a Negative Declaration with Sectic : The roject is with the General Plan in that water trea merit facilities and other civic facilities are allowed in the Publ c Facilities zone with the approval of a conditional use perm t. That the location, size, design, and operating ch of th development will be compatible with and will not adversely af ect or be materially detrimental to adjacent uses, residents, bu ldings, structures, or natural in that the site ad oins existing semi-public uses on the east and west and is separated from residential uses to the south and west by existing slopes. Approved landscaping for this project will provide additional enhancement of the site. o That the harmony in scale, bulk, coverage, and density is compatible with adjacent uses, in that the development will be in scale and compatible with adjacent and nearby semi-public facilities within the Berglund Water Treatment Plant/Operation Center complex. and utilities _ 4. That there are available public facilities, for the development. o o Resolution No. P-95-11 Page 2 That there will not be a harmful effect upon desirable neighborhood characteristics, in that the upgrades and development are located on a previously graded and developed site and along an access road that services other semi-public uses and does not serve any single-family homes. T at he § of traffic will not adversely impact surrounding s ree s and/or the City's Circulation Element, in that the new a building development will provide approximately 15 a dit onal parking spaces. That the site is suitable f r the type and ' of the use, in that a majority of the pro ect involves upgrades or replacement of existing facilities. Ther is adequate area within the complex to easily accommodate the add tional 1 development. That there will not be significant harmful effects upon 1 quality and natural in that the areas slated for development have been previously disturbed or developed. That there are no other relevant negative impacts of the development that cannot be mitigated, in that additional landscaping will be installed to help enhance and screen the site and facilities. Section 3: Cit Council The City Council hereby approves CUP 95-01 and DR 95-01 subject to the following conditions: The use conditionally granted by this permit shall not be conducted in such a manner as to interfere with the reasonable use and enjoyment of surrounding residential and open space uses. This conditional use permit shall be subject to annual review by the Director of Planning Services for compliance with the conditions of approval and to address concerns that may have occurred during the past year. If the permit is not in compliance with the conditions of approval, or the Planning Services Department has received complaints, the required annual review shall be set for a public hearing before the City Council, to consider modification or revocation of the use permit. SITE DEVELOPHENT 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. o o o o 10. 11. Resolution No. P-95-11 Page 3 Revised site plans and building elevations incorporating all conditions of approval shall be submitted to the Planning Services Department prior to issuance of building permits. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of building permit ' A grading plan for the development of the property shall be submitted to the City's Engineering Services Department for review and approval prior to issuance of a grading permit and start of grading operation unless grading involves earthwork movement of less than 50 cubic yards. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit Building iden ification and/or addresses shall be placed on all new and existing bull ings so as to be plainly visible from the street or access road; color o identification and/or addresses shall contrast with their background co or. This approval shall become null and void if building permits are not issued for this project within two years from the date of project approval. All parking lot landscaping shall include a minimum of one 5 gallon size tree for every three spaces. For parking lot islands, a m nimum 12 inch wide walk adjacent to parking stalls shall be provided an be separated from vehicular areas by a six inch high, six inch wide por land concrete cement curb. All two-way traffic aisles shall be a minimum of 25 feet wide. A minimum of 24 feet wide emergency access shall be provided, ~ free and clear at all times during in accordance with Safety Services Department requirements. 12. Plans shall be prepared in accordance with City of Poway Guide to Landscape Requirements (latest edition). 14.
