WHEREAS, Development Review 95-04, was submitted by Lester Wiederrich,
applicant, for approval of the construction of a 2,497 square foot medical office
complex to replace the existing 1,697 square foot building located at 14103 Poway
Road, in the HS zone.
WHEREAS, The City Council of the City of Powayhas read and considered said
report and has considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council does hereby resolve as follows:
The subject project is exempt under the p of the California
E Lal Quality Act, Class 1.
The approved project is consistent with the general plan in that
medical office buildings are a permitted land use within the Poway
Road ' 1 corridor.
That the approved project will not have an adverse aesthetic,
health, safety, or archite turally related i act upon djoining
properties in that the esign of the bu~ ding util zes the
guidelines set out in the oway Road Specific lan, for s ructures
located within the Automot ye/ General Commerc al Distric .
That the proposed project encourages the orderly and h
appearance of structures and property within the City in tha the
architecture references several nearby, newly developed comp exes
which also reflect the post-modern style articulated in the oway
Road Specific Plan.

The City Council hereby approves Development Review 95-04, subject to the
following conditions:
Within 30 days of approval {1) the applicant shall submit in writing that
all conditions of approval have been read and understood; and (2) the
property owner shall execute a Covenant on Real Property.

COMPLIANCE WITH THE FOLLOWING CONDITIOMS IS REQUIRED. CONPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF PLANNXNG SERVICES.
Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
issuance of building permits.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit
Trash receptacle shall be enclosed by a six foot high masonry wall with
view-obstructing gates pursuant to City standards. Location shall be
subject to approval by the Planning Services Department.
All roof appurtenances, including air conditioners, shall be
architecturally integrated, screened from view and sound buffered from
adjacent properties and streets as required by the Planning Services
Department.
The applicant'shall comply with!tbe~at~st adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all cther applicable codes and ordinances in effect
at the time of building permit
This approval shall become null and void if building permits are not
issued for this project within two years from the date of project
approval.

All parking lot landscaping shall include a minimum of one $ gallon size
tree for every three spaces. For parking lot islands, a m nimum 12 inch
wide walk adjacent to parking stalls shall be provided an be separated
from vehicular areas by a six inch high, six inch wide por land concrete
cement curb.
Parking lot lights shall be low pressure sodium and have a maximum height
of 18 feet from the finished grade of the parking surface and be directed
away from all property lines, adjacent streets and residences.

SIGNS
Complete landscape construction documents shall be submitted to and
approved by the Planning Services Oepartment prior to the issuance of
building permits. Plans shall be prepared in accordance with City of
Poway Guide to Landscape Requirements (latest edition).
Street trees, a minimum of 15 gallon size or larger, shall be installed in
accordance with the City of Poway Guide to Landscape Requirements and
shall be planted at an average of 30 feet on center spacing along all
streets.
Landscaped areas within the adjacent public right-of-way, as well as
private street easements, shall be permanently and fully maintained by the
owner.
All landscaped areas shall be maintained in a healthy and thrivi g
condition, free m weeds, trash, and debris. The trees shall e
encouraged and a, wed to retain a natural form. Pruning should e
restricted to main ain the health of the trees and to protect the publ c
safety. Unnatura or excessive pruning, including topping, is not
permitted.
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES.
The applicant shall pay a $500.00 inspection fee to the City's Engineering
Services Oepartment prior to building permit Such fee is to be
used to pay for City Inspector's time in making necessary inspections for
the project site that are required prior to issuance of said building
permit and/or Certificate of Occupancy.
A right-of-way permit shall be obtained from the City's Engine ring
Services Department for any work to be done within the public s feet
right-of-way or construction of driveway approach, sewer la eral
installation, water service line installation, and street construct on.
A Traffic Mitigation Fee in the amount of $1,188.00, shall be paid or a
security bond posted prior to issuance of a building permit. If a
security bond is posted, payment of the fees shall be made prior to
issuance of a Certificate of Occupancy. Once payment is received in full,
said security bond could be released to the applicant.

The subject property owner shall participate in a road maintenance
agreement for Welton Lane, prior to occupancy.
The easterly side of Welton Lane, from Poway Road to the northerly edge of
the project's northerly driveway, shall be improved with concrete curb,
gutter and sidewalk. In addition, a disabled (wheelchair) access ramp
shall be constructed at the curb return. All work shall be in conformance
with the City of Poway standards and specifications.
An improvement plan, pre ared by a State Registered Civil Engineer, shall
be submitted by the Ci y for review and approval prior to start of
construction. Plan chec lng fee and additional inspection fee shall be
paid to the City at firs submittal of improvement plans.
Grading improvements to the site, s'all be made in such way that
discharge of surface water to adjacent ower property shall be hrough the
drainage mec anism of a natural swale, ollow or depression, ncrease in
volume or ve ocity by collecting the wa er in pipes or artific al ditches
must be avo ded. It is recommended that wherever possible, surface
drainage, an water from roof drains be directed toward Poway Road.

Roof covering shall be fire retardant as per UBC Section 3203(e) and City
of Poway Ordinance No. 64.
The buildings shall display their numeric address in a manner visible from
the access street. Minimum size of the building numbers shall be six
inches on the front facade of the building. Building addresses shall also
be displayed on the roof in a manner satisfactory to the Director of
Safety Services, and meeting Sheriff Dept. ASTREA criteria.
Every building hereafter constructed shall be accessible to Fire
Department apparatus by way of a cess roadways with all-weather driving
surface of not less than ZO fee of unobstructed width, with adequate
roadway turning radius capable o supporting the imposed loads of fire
apparatus having a minimum of 1 '6" of vertical clearance. The road
surface type shall be approved by the City Engineer, pursuant to the City
of Poway Municipal Code. (16' One Way parking lot is okay.)
The buildin owner will be required to install an approved fire sprinkler
system, mee lng P.M.C. requirements. The entire system is to be monitored
by a centra monitoring company. System post indicator valves with tamper
switches, a so monitored, are to be located by the City Fire Marshal prior
to installa ion.
A 'Knox' Security Key Box shall be required for the building at a location
determined by the City Fire Marshal. A 'Knox' padlock shall be required
for the fire sprinkler system Post Indicator Valve.

Fire Department access for use of fire fighting equipment shall be
provided to the immediate job construction site at the start of
construction and maintained at all times until construction is completed.
A minimum 2A:IOBC fire extinguisher is required for every 3,000 square
feet and 75 feet of travel distance.
If medical gasses are planned to be used in this building, they shall be
installed to meet requirements of the Uniform Fire Code Article 74-
Compressed Gasses.
An Emergency Contingency Plan and Hazardous Materials Disclosure shall be
filed with the County of San Diego Department of Health and copies
provided to the Fire Oepartment.
Material Safety Data Sheets shall be required for all hazardous and/or
toxic substances used in each building.

N.F.P.A. Standard 704, Hazardous Materials Labeling, shall be provided as
necessary throughout the building.
