WHEREAS, Minor Development Review 95-22 (Hillside/Ridgeline), submitted by
Linda Snyder, applicant, requests approval to perform additional grading on a
residential lot located at 14652 Sunset Mountain Way within the Rural Residential
B zone; and
WHEREAS, on August 15, 1995 the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Minor Development Review 95-22 (Hillsi e/Ridgeline) is not subject to the
California E ' tal Quality Act, in hat it is Categorically Exempt Class
3, as the project is grading associate with the development of accessory
structures including a swimming pool and he widening of a driveway.
By local ordinance, the areas disturbed in the grading process which contain
Coastal Sage Scrub plant community are to mitigated through the on-site
dedication of equal or better quality habitat, at a 1:1 ratio.
The proposed project is consistent with the general plan in that it
proposes the additional grading which will allow the development of a
accessory structures on a site which is designated for residential use.
That the proposed development will not have an adverse aesthetic, healt',
safer or architecturally related impact upon adjoining properties, n
that he grading has been designed to appear natural and minimize visib e
impac s. A planting plan will provide for full revegetation of a 1
visib e slopes.
That the proposed development is in compliance with the Zoning and Grading
Ordinance, in that it complies with the property development standards of
the RR-B zone.
That the proposed development encourages the orderly and harmonious
appearance of structures and property within the City, in that the
surrounding properties consist of large rural residential lots with widely
spaced hillside homesites.

Within 30 days of approval the applicant shall submit

Site shall be developed in accordance with the approved grading plans on
file in the Planning Services Department and the conditions contained
herein.

Revised grading plans incorporating all conditions of approval shall be
submitted to the Planning Services Department prior to issuance of grading
permit.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of grading permit
The westerly and southerly side of the knoll that is to be reconstructed
during the grading project shall be hydros eded with a coastal sage scrub
hydroseed mix to hasten revegetation. I the hydroseeding is not done
during the rainy season, temporary irrigat on shall be provided to ensure
gemination. This shall be accomplished pr or to grading certification or
March 1, 1996 whichever is first.
The grading of the site, specifically the City required reconstruction of
the knoll shall be completed prior to February 1, 1996.
Approximately 4,000 s uare feet of coastal sage scrub will b removed with
the project. The app icant shall mitigate the removed coas al sage sc ub
at a minimum 1:1 rat o prior to grading permit he mitigat on

City of Poway, payment of a mitigation in-lieu fee or approved off-s te
open space dedication of coastal sage habitat to the City of Poway.
Grading and clearing operations within areas containing coastal sage scrub
shall not occur between the months of February and August because that is
the nesting season of the California Gnatcatcher.
8. Future grading of the hillside portions of the subject lot shall be
prohibited unless approved by the City Council.

A grading plan for the development of the property shall be submitted to
the City's Engineering Services Department for review and approval prior
to issuance of the grading permit and start of grading operation.

Applicable fees and deposits shall be paid prior to grading permit
issuance.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
