Res 15-009RESOLUTION NO. 15 -009 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, RATIFYING THE CITY MANAGER'S DECISION TO APPROVE THE CITY'S REVISED LANDSCAPE WATERING SCHEDULE AND RESTRICTIONS, CONSISTENT WITH CHAPTER 8.94 OF THE POWAY MUNICIPAL CODE WHEREAS, the City of Poway imports nearly 100% of its potable water supply from Northern California and the Colorado River via contractual arrangements with the San Diego County Water Authority and the Metropolitan Water District of Southern California; and WHEREAS, on January 17, 2014, Governor Edmund G. Brown issued a Governors Proclamation No. 1 -17 -2014 declaring a State of Emergency to exist in California due to severe drought conditions; and WHEREAS, the January proclamation calls on all Californians to reduce their water usage by 20% compared to calendar year 2013 regardless of previously achieved water use reduction percentages or local water supply enhancements that may have been implemented since the 1991 drought; and WHEREAS, on July 15, 2014, the State Water Resources Control Board adopted regulations requiring urban water suppliers to activate water shortage contingency plans to a level that activated mandatory outdoor irrigation restrictions so long as they achieved desired reductions, or risk penalties up to $10,000 per day; and WHEREAS, on July 22, 2014, the Poway City Manager declared a Level 2 Water Shortage Alert, and on August 5, 2014, the Council ratified the declaration; and WHEREAS, on March 17, 2015, the State Water Resources Control Board expanded and extended emergency water conservation regulations originally established on July 15, 2014; and WHEREAS, the State Water Resources Control Board is expected to announce its water allocations from the State Water Project in early April; and WHEREAS, on April 14, 2015, the Metropolitan Water District, which distributes water to Southern California, is expected to decide on water allocation amounts; and WHEREAS, on April 23, 2015, the San Diego County Water Authority will determine mandatory water cutbacks for its member agencies including the City of Poway; and WHEREAS, since Poway's outdoor watering restrictions went into effect in August, 2014, water use in Poway decreased by about 4% when compared with 2013, which falls short of the Governor's mandate of 20% savings; and Resolution No. 15 -009 Page 2 WHEREAS, Chapter 8.94 of the Poway Municipal Code provides that landscape watering shall be conducted only in conformance with landscape watering schedules and restrictions for commercial and residential properties approved by the City Manager; and WHEREAS, Chapter 8.94 of the Poway Municipal Code states that the watering schedule and restrictions may address factors such as how many days during the week, which days of the week, the amount of time per watering station, and other pertinent details; and WHEREAS, the City Manager approved a revised landscape water schedule. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: 1) As set forth in the Poway Municipal Code Chapter 8.94 — Water Conservation Plan — the City Manager's decision to approve the City's revised landscape watering schedule is hereby ratified, and takes effect on May 1, 2015. 2) The revised landscape watering schedule will restrict outdoor irrigation to two days per week, before 8 a.m. and after 8 p.m., and not during or within 48 hours after measurable rainfall. 3) The revisions to the landscape watering schedule become effective beginning May 1, 2015.
