WHEREAS, Development Review g5-12, was submitted by K rkham Stowe, Inc.,
Owner, for approval to construct a 52,475 square foot indus rial building on a
vacant pad located on Kirkham Court within the Scenic View usiness Park. The
property has a Light Industrial land use designation and s within the South
Poway Planned Community; and
WHEREAS, the City Council of the City of Poway has read and considered the
staff report and has considered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council does hereby resolve as follows:
The previously certified Final E tal Impact Report (EIR) and Final
Subsequent EIR for the South Poway Specific Plan adequately addresses the
potential tal impacts of the proposed development.
The approved project is consistent with the South Poway Specific
Plan and the general plan in that a warehousing facility is a
permitted land use within the Light Industrial land use designation.
That the a proved project will not have an adverse aesthetic,
health, saf ty, or architecturally related impact upon adjoining
rD erties n that the design of the building for the intended
ur ose con orms to the criteria of the South Poway Development
ta dards and will be compatible with existing and future buildings
n he vicinity.
That the approved project encourages the orderly and h
appearance of structures and property within the City in that he
architecture incorporates features of the existing Scenic V ew
Business Park buildings and is consistent with the general des gn
standards in the South Poway Business Park.
The City Council hereby approves Development Review 95-12 subject to the
following conditions:
Within 30 days of approval the applicant shall submit in writing that all
conditions of approval have been read and understood.
CONPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE

Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
issuance of building permits.
Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit '
Trash receptacle shall be enclosed by a six-foot high masonry wall with
view-obstructing gates pursuant to City standards. Location shall be
subject to approval by the Planning Services Department.
All roof appurtenances, including air conditioners, shall be
architecturally integrated, screened from view and sound buffered from
adjacent properties and streets as required by the Planning Services
Department.
Prior to any use of the project site or business activity being commenced
thereof, all conditions of approval contained herein shall be completed to
the satisfaction of the Director of Planning Services.
The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit
This approval shall become null and void if building permits are not
issued for this project within two years from the date of project
approval.
ACCESS
All parking lot landscaping shall include a minimum f one 5 gallon size
tree for every three spaces. For parking lot islan s, a m nimum 12-inch
wide walk adjacent to parking stalls shall be prov ded an be separated
from vehicular areas by a six-inch high, six-inch w de por land concrete
cement curb.
All two-way traffic aisles shall be a minimum of 25 feet wide. A minimum
of 25 feet wide emergency access shall be provided, maintained free and
clear at all times during construction in accordance with Safety Services
Department req
All parking spaces shall be double striped.
Upon tdentific tion of a building tenant, parking demand shall be
determined an in the event that additional parking is required the
developer shal either eliminate some of the loading doors and locate
additional par ing in those areas, or the developer shall construct
additional parking on vacant Pad "J" of the Scenic View Business Park.

Complete landscape documents shall be submitted to and
approved by the Planning Services Department prior to the issuance of
building permits. Plans shall be prepared in accordance with City of
Poway Guide to Landscape Requirements (latest edition).
Existing on-site trees shall be retained wherever possible and shall be
maintained in a horticulturally acceptable manner. Dead, decaying, or
otentially dangerous trees shall be approv d for removal at the
iscretion of the Planning Services Department uring the review of the
aster Plan of existing on-site trees. Living tees which are approved
or removal shall be replaced on a tree-for-tree asis as required by the
lanning Services Department.
Street trees, a minimum of 15 gallon size or larger, shall be installed in
accordance with the City of Poway Gufde to Landscape Requfrements and
shall be planted at an average of 30 feet on center spacing along all
streets.
Landscaped areas within the adjacent public right-of-way shall be
permanently and fully maintained by the owner.
All landscaped areas shall be maintained in a healthy and thrivi g
condition, free from weeds, trash, and debris. The trees shall e
encouraged and allowed to retain a natural form. Pruning should e
restricted to maintain the health of the trees and to protect the publ c
safety. Unnatural or pruning, including topping, is not
permitted.
SIGNS
Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVEO BY THE OEPARTNENT OF ENGINEERING SERVICES.
A grading plan for the development of the property shall be submitted to
the City's Engineering Services Department for review and approval rior
to issuance of a grading permit and start of grading operation, ough
grading of the site must be completed and shall meet the C ty's
Engineering Services inspector's approval prior to issuance of a bui ding
permit. Grading plan shall be drawn at a scale of 1" ~ 20' or larger.
A ri hr-of-way permit shall be obtained from the City's Engineering
Serv ces Department for any work to be done within the public street
righ -of-way or any City-held ,as,men . Said work shall include, but is
ot o be limited to, construction o driveway approach, sewer lateral
nstallation, water service line nstallation, street construction
including concrete curb, gutter and s dewalk). Permit shall be obtained
rior to start of work.

A road maintenance agreement, for the private driveways and parking
to the City shall be executed by the owner and/or
developer prior to building permit Said is to comply
with Ordinance No. 280, City Code Section 12.20.060]
The applicant shall process the vacation of the existing w ter easement
and dedicate a new easement over the new proposed water 1 ne. A water
systems analysis shall be performed for the new waterl ne and fire
services to new and existing buildings in the immediate a fected area.
The cost of this will probably be in the range of $2,800 to $6,000, but
may be higher.
An improvement plan for the on-site waterline and fire hydrant shall be
submitted to the Engineering Services Department for review and approval
prior to building permit issuance. A standard agreement shall be executed
prior to approval of plans.
The following development fees shall be paid to the Engineering Services
Department prior to building permit issuance. These fees are currently in
effect and are subject to change.

Roof covering shall be fire retardant as per UBC Section 3203{e) and City
of Poway Ordinance 64.
The buildings shall display their numeric address in a m nner visible from
the access street. Minimum size of building numbers is I inches on facade
of building. Building address shall also be displaye on the roof in a
manner satisfactory to the Director of Safety Serv ces, and meeting
Sheriff's Department ASTREA criteria.

Every building hereafter constructed shall be accessible to Fire
Department apparatus by way of a cess roadways with all-weather driving
surface of not less than 20 fee of unobstructed width, with adequate
roadway turning radius capable o supporting the imposed loads of fire
apparatus having a minimum of 1 '6" of vertical clearance. The road
surface type shall be approved by he City Engineer, pursuant to the City
of Poway Municipal Code.

The building will be required to install an approved fire sprinkler s stem

The addition of on-site fire hydrants is required. The location of the
hydrants shall be determined by the City Fire Marshal.
Material Safety Data Sheets shall be required for all hazardous and/or
toxic substances used in each building.
An Emergency Contingency Plan and Hazardous Materials Disclosure shall be
filed with the County of San Diego Department of Health and copies
provided to the Fire Department.
A 'Knox' Security Key Box shall be required for the building at a location
determined by the City Fire Marshal. A 'Knox' padlock shall be required
for the fire sprinkler Post Indicator Valve.

If an elevator is installed, it shall be sized to accommodate a normal
hospital gurney. Minimum dimensions for the inside car platform shall be
6'8" wide by 4'3" deep.
Fire Department access for use of fire fighting equipment shall be
provided to the immediate job construction site at the start of
construction and maintained at all times until construction is completed.
Permanent access roadways for fire apparatus shall be designated as "Fire
Lanes' with appropriate signs and curb markings.
Prior to delivery of combustible building material on site, water and
sewer systems shall satisfactoril pass all required tests and be
connected to public water and sewer ystems. In addition, the first lift
of asphalt paving shall be in place o provide adequate, permanent access
for emergency vehicles. The final 1 ft of asphalt shall not be installed
until all other construction activity has been substantially completed to
the satisfaction of the City.
N.F.P.A. Standard 704, Hazardous Materials Labeling, shall be provided as
necessary throughout the building.
The building shall be provided with approved automatic smoke and heat
vents.
A water systems analysis will be performed to establish available fire
flow.

Additional fire hydrant may be mitigated by relocating existing fire
hydrant on NW corner of proposed building to the extreme west end of
raised island (approximately 70' to west of existing location).
18.
Fire Department Connection (FDC) and Post Indicator Valve {PIV) to be
located on entry way to access roadway and to be located within 40' of a
fire hydrant or one shall be installed.
