A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR CONDITIONAL USE PERMIT 96-06
ASSESSOR'S PARCEL NUMBER 323-262-01
WHEREAS, Minor Conditional Use Permit 96-06 submitted by Henry Rose, Premier
Recovery Services, requests approval to operate a vehicle rep h the
portion of the property located at 13977 Poway Road within the ,~
General C and Residential Single Family-2 zones; and
WHEREAS, on March 4, 1997, the City Council held a hearing on the above

NOW, THEREFORE, the City Council does hereby
follows:
The City Council finds that this project will not have a significant adverse impact on

compatible with and will not adversely affect or be materially detrimental to

adjacent uses, in that the project will not involve additional development and
the use will occupy a site that has been in recent years has been a

The City Council hereby approves Minor Conditional Use Permit 96-06 subject to
the following conditions:
Within 30 days of approval (1) the applicant shall submit in writing that all
conditions of approval have been read and understood; and (2) the property
owner shall execute a Covenant on Real Property.

COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
The Planning Services Department shall conduct an annual review of Minor Conditional
Use Permit 96-06 for compliance with the condition;s of approval. If the department has
received complaints, or the use is not in compliance, th I be forwarded to the
Council, who may add conditions to the permit or amend existing conditions of approval.
SITE DEVELOPMENT
Site shall be developed in accordance with the approved site plans on file in the
Planning Services Department and the conditions contained herein.

The applicant shall comply with the latest adopted Uniform Building Code, Uniform
Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire
Code, and all other applicable codes and ord ~'ect at the time of building
permit issuance.
5. Vehicle repair is prohibited on the site.
Large transport trucks (built to carry more than two vehicles) shall be directed to
load vehicles from the use at an approved off-site location. Large transport trucks
shall not load veh ,1 with the use on Sudan Road or any streets where
parking is prohibited.
C related use is prohibited on the residentially zoned portion of the
property (the southerly half of the lot).
8. All vehicles shall be stored or parked on a paved surface.
An adequate amount of space shall be maintained in the vehicle storage lot to
allow for easy .;I of vehicles into and out of the lot. Business related
vehicles shall not be stored or parked on Sudan.

Any signs proposed for this use shall be designed and approved '
Sign Ordinance.

LANDSCAPING
The required 20 foot front yard setback along the Poway Road frontage shall be
landscaped and irrigated. Fast growing evergreen shrubs shall be installed along
the existing chain link fence on the eastedy and southerly boundaries of the vehicle
storage area. The required landscaping and irrigation shall be installed before June
3, 1997.
Complete landscal: (~ (planting and irrigation plans) shall be
submitted to and approved by the Planning Services Department prior to the
installation of any required landscaping and irrigation. The landscape plan check
fee shall be paid at the time of the landscape plans submittal. Plans shall be
prepared in accordance with City of Poway Guide to Landscape Req '
(latest edition).

The required landscaping and irrigation shall be installed before June 3, 1997.
Landscaped areas within the adjacent public right-of-way shall be improved and
permanently and fully ,I by the property owner.
All landscaped areas shall be maintained in a healthy and thriving condition, free
from weeds, trash and debris. The trees shall t: ,~ed and allowed to retain
a natural form. Pruning shall be restricted to maintain the health of the trees and
to protect the public safety. Unnatural pruning, including topping, is
not permitted.
AND VEHICULAR ACCESS
A defined 31oyee parking area shall be provided before May 25,
1997. The applicant shall submit a parking lot plan to the Planning Services
Department 1' :1 approval prior to the stdping ofthe lot. Standard parking
spaces shall have a minimum dimension of 18.5 feet by 8.5 feet and accessible
parking space shall be provided in accordance with the A :h Disabilities
Act.
2. Directional signage shall be installed to identify the 31oyee parking
area.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE
SHALL BE APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
The building shall display a :ldress in a 31e from the access
street. M :the building numbers shall be six inches on the front facade
of the building. Building address shall also be displayed on the roof in a manner
satisfactory to the Director of Safety Services, and meeting Sheriff's Dept. -
ASTRE^ criteria.
A fire lane shall be provided along the building from the front entrance to the rear
of the building.
3. A "Fire Lane - No Parking" sign shall be attached to the gate.
4. A 2A10BC fire extinguisher shall be provided within the business.
