P- 97-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 97-25 WHEREAS, Temporary Use Permit 97-25, Poway Chamber of C applicant, requests approval to hold a street fair on Midland Road on May 25, 1997; and WHEREAS, on May 20, 1997 the City Council considered the ab item. NOW, THEREFORE, the City Council does hereby follows: Pursuant to the procedure of the City of Poway, the al: :1 project is not subject to CEQA, because it is categorically exempt, Class 4(e) and 11(c) in that the event is a temporary use of land that will involve the temporary siting of portable That the proposed Jance with the purposes and standards of Section 17.26.030 of the Poway Municipal Code. ~cil Decision: The City Council hereby approves Temporary Use Permit 97-25 subject to the following conditions: APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Site shall be developed in accordance with the approved site plans on file in the Planning Services Department and the conditions contained herein. 2. Fire and County Sheriff's Departments shall be contacted for appropriate permits and inspections prior to th I of the activity. 3. Temporary signs shall be reviewed by the Planning Services Department for compliance with the Sign Ordinance prior to installation. 4. The barricades can be placed at 6:00 a.m. and must be removed by 6:00 p.m. on May 25, 1997. The Poway Chamber of Commerce is required to provide to the City, prior to the event, an ' policy naming the City as ADDITIONALLY INSURED for a · ' I $1,000,000. The Poway Chamber of Commerce is required to sign a City of Poway waiver of liability 1' ' ;] the event and City equipment used during the event. The Poway Chamber of C participant to sign : require each separate booth or presenting ~ liability form. A refundable $500 security/cleaning deposit is to be paid to the City to ensure proper cleanup after the event and to cover possible equipment damage. A detailed site plan for Midland Road booths must be provided. Signs on Midland Road, giving particulars of dates and times of closure, must be posted one week prior to the event. The applicant shall notify in writing the Midland Road b and residents affected by the road closure (Adrian, Eastern, Edgemoor, Sycamore, Temple Streets, and Brighton Avenue). The notice shall detail the dates and times of the event and the road closure. Portable are required at the ratio of I to every 50 people up to 500 people. After 500 people, the ratio is 1 per 500 people. A sign showing location of the rest : be posted. Any dumpsters used for the event must be removed by May 26, 1997. The event sites shall be left free of debris, litter, or any other evidence of the temporary use upon completion of the use. All food and drink 3erated for profit shall secure th 'y Health Department permit and State seller's permit. Non-profit food booths shall be requested to comply with same req booths. Resolution No. P-97-26 Page 3 19. The vehicles of all vendors using mobile units must comply with California Administrative Code, Title 17. Specifically, all doors must be self-closing, service windows must be 216 square inches or less, and shatterproof guards are required for all light bulbs. 20. Vendors preparing food in temporary booths must provide floors, walls, and ceilings for the entire stand. 21. W disposal from food units shall be acceptabl holding tanks. 22. Provision for temporary electrical power will require an electrical permit and an inspection approval by the Building Safety Inspection Division. 23. The surfaces of th :1 public right-of-ways shall not be marked with paint, tape nor any other type of marking materials. APPLICANT SHALL CONTACT THE DEPARTMENT OF PUBLIC SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Public Services Department will provide th ¥ barricades and signs for the detour, stockpiled at the various locations for placement by others during the street closure time. Public S I pick up the barricades. APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. All barricades are to have attendants at all times. Maintain emergency vehicle access to all buildings, streets, fire hydrants and sprinkl ' fected by the Springfest Street Fair. 3. All tents are to be tagged with State Fire Marshal approval. All booths or tents having electrical power, using any kind of flammable fuel, or doing any cooking will have a fire extinguisher rated not less than 2A10BC. 5. Secure all compressed gas cylinders, i.e. helium, air, etc. APPLICANT SHALL CONTACT THE SHERIFF'S DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: Resolution No. P-97-26 Page 4 Barricades shall be located on Edgemoor Street to the west of Midland Road to prevent traffic other than residents. The barricade shall be manned by persons capable of removing the barricades. Barricades shall be placed on Midland Road at Edgemoor Street on the north side, on Midland Road at Adrian Street on the south side, and on Temple Street at Midland Road on the east side. One or more identifiable members of the event committee shall be on-site at all times when the parking use to assist with security of parked vehicles, to aid in the ~ of vehicles in and out of the lots, to provide information to and to minimize traffic congestion on sud' "No Parking/Tow Away" barricade signs shall be placed on Aubrey just west of Midland Road to the existing No Parking signed area along Park side near Midland Road to help prevent a bottleneck. The event committee shall have personnel designated at all times and at specific locations to provide liaison with representatives of the City's Fire and Police Services. APPLICANT SHALL CONTACT THE ENGINEERING SERVICES DEPARTMENT, TRAFFIC DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 1. Provide traffic control plan for traffic Engineer approval two weeks prior to event. Provide warning signs notifying of Midland Road bound ends on Midland one week prior to event.
