A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 97-34
WHEREAS, Temporary Use Permit 97-34, submitted by Richard Muir, applicant,
requests approval of a high school age band perf ~ich is to be held within the
former K-Mart/Mega Foods building located at 13630 Poway Road. The concert is to be
held on Saturday, June 14, 1997 between the hours of 7:00 p.m. and 9:00 p.m.
NOW, THEREFORE, the City Council does hereby

The City Council hereby approves Temporary Use Permit 97-34 subject to the
following conditions:
APPLICANT SHALL CONTACT THE COUNTY HEALTH DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:

Inform all vendors using mobile units that their vehicles must comply with California
Administrative Code, Title 17. Specifically, all doors must be self-closing, service
windows must be 216 square inches or less, and shatterproof guards are required
for all light bulbs.

Vendors preparing food in temporary booths must provide floors, walls and ceilings
for the entire stand.

APPLICANT SHALL CONTACT THE SHERIFF'S DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:

Uniformed private security guards shall be on duty to patrol the exterior of the
building and parking lot, and to provide crowd control within the building until the

APPLICANT SHALL CONTACT THE DEPARTMENT OF SAFETY SERVICES
REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS:

The storage and removal of all trash material shall be provided so as not to
constitute a fire hazard.
A plan indicating the seating arrangements, location and width of exit ways and
aisles shall be submitted for approval and an approved copy of the plan shall be
kept on display, on the premises (UFC 2501.14) - subject to approval prior to the
event.
If the number of fixed seats are greater than 300, they shall be fastened together
in groups of not less than three(UFC 2501.10.2).

APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING SERVICES
REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS:
1. Any necessary building
permits shall be secured.

All signs for the event must be approved by the Director of Planning Services prior
to installation and shall be removed promptly, within two days following the event.
The applicant shall meet with representatives of each of the City departments
concerned at least one week prior to each event to ensure that all conditions of
approval will be met.
The sites shall be utilized in accordance with this resolution and the approved site
plans on file in the Planning Department, except as may otherwise be provided
herein, prior t I of the activity.
Provision for temporary electrical power will require an electrical permit and an
inspection approval by the Building Inspection Division.

The event site shall be left free of debris, litter or any other evidence of the
temporary use upon completion of the use.

APPROVED AND ADOPTED by the City Council of the City of Poway, State of
California, this 10th day of June, 1997.
